    Nobody said anything after we left and came back 5 months later.  We got waved thru.

     

    We were out 4 YEARS and still got an SB1 to come back.  If:  You are still married, have a home, and you still qualify for immediate immigration benefits plus you APPLIED for a travel document before you travelled which is de facto proof that you do not intend to abandon residence it will be next to impossible to lose your green card. 
     

    Try to keep it under 6 months, definitely undet a year, you won’t lose your green card.  Do not, under any circumstance, surrender it.  Ask for a hearing, always.  Only a judge in a court can take it.

    I am planning to stay out of the country just for 3 months and I will never surrender my green card!!!!!!!! I have my house and all my life in the US and I can definitely proof that of course!!!!!

     

    I was a little bit worried about my travel history but your words really helped me  thank you!!!!!!

     

    I hope they will approve my reentry permit for the time I ll get back to the US.

    It has been almost 9 months of waiting!!!!!

    3. That said, you were in the USA 7 straight months. You left without your re-entry permit. If you ready to come home in August, you should come home with or without the re-entry permit.  In August if will be 10 months after applying. If you haven't received the re-entry permit, then I don't know what CBP expects you do. You have a family emergency and you followed CBP's instructions. CBP's sister agency can't process a simple document that takes 5 minutes to print and send in the mail.

     

    4. Re-entry permit or not, nothing prevents a secondary inspection. Nothing prevents CBP from pressuring you to sign an I-407. Just say no.

     

    5. Worst case you will lose your LPR status in immigration court. You accepted that risk when you left the USA without the re-entry permit.

    1-Yes I am a 10 years green card holder , I dont know how to update my status in the forum.

     

    3-There are some delays due to the Covid, that's why is taking this long but my question is,there is a chance to be denied because of my travel history?

    as I told you I have everything in the US (husband,house,business) and I have been home for 7 straight months and I applied as they asked me.

    I dont know what to do more than this.

     

    5- I do not want to lose my status, I had an emergency but I have all my life in the US.

    I am just trying to have some feedback from someone that had a similar experience.

    I read the form, but as I wrote, not this time but in the past I traveled overseas for long time and last time I entered the US (7 months ago) they told me to get a reentry permit for next time because of my history.

     

    This time I have been in the US for 7 months waiting for the permit, and I left just a week ago, still waiting for the permit but worring about reentering without my reentry permit in August.

    I have all my life in the US (Husband, business, house...) but because of my travel history I am really afraid.

     

     

     

  5. Can a reentry permit be denied after fingerprints were taken?

    Do they deny the application before fingerprints or after?

     

    Asking these questions because I have applied last october,

    My fingerprints were taken on january.

    Still waiting for my permit.

    Left the US in May.

     

    It's my first time applying for it, but in the past I had to leave the US multiple times in order to take care of my family in Italy.

     

    I have just left the US after 7 months there.

     

     

    I am planning to go back home to the US first week of August.

    Should I be ok when entering again in August?

     

    I have a house, a business and a husband in the US.

    But a lot of history of travelling unfortunately.

     

    This is should be my last time overseas for longtime.

     

    Any feedback would be very appreciated!

     I had a 2 year permit in the last 5 years. According to law is goes like this:if you've spent more than 4 of the previous 5 years since gaining a green card outside the United States, you'll only be issued a re-entry permit valid for a single year. So baisically you can get up to ( 2) year permit twice during the first 5 year since gaining Green .

     

    also I applied in September 2020, biometrics appointment was Dec 29th so you are right behind me. Hopefully something's comes up soon

    That's why I am asking, could I be denied event if as you wrote "if you've spent more than 4 of the previous 5 years since gaining a green card outside the United States, you'll only be issued a re-entry permit valid for a single year" ???

Since you applied in  july you will have 10 months by May. What i would recommend is to file an inquiry next month . I'm actually surprised you havent gotten your approval yet, I've seen so many persons from july/Aug getting approvals lately 

    I have actually applied in october and got my bio in January.

    I am afraid to be denied because I have been already out of the country for almost 2 years (not continuosly) in the last 5 years and thats why I am concerned and try to understand if the fact that they took my bio is a good or bad sign.

    Yes Nebraska! And the processed my bio on January 22.

     

    Is a good sign that they took my biometrics? It means that the application has not been denied right?

    Why taking my bio if they would not approve the form right?

    I am in the same situation, I applied in october, in January my case changed in fingerprints, but no appointment received.

    Are they using my old finger?
