The people who are responding have been on this board for a long time. We've seen many similar situations. Some 6 months, some just less than a year, some more than a year. Invariably people report back that they're questioned at length at POE. Some get turned around, some get let through. What everyone is telling you is that it's a gamble. If you like to gamble, then you're probably fine. Get turned around just go back to your home in Italy and define the next steps, like filing a new CR1. Your fate is entirely in the hands of an IO who can let you through, or not.

Again, if you're looking for someone who got through after 364 days, I can assure you that more than one person on this board have been allowed back into the country in that situation.

Back where? in the US or back to the country you are coming from?

It's a pretty big deal. As someone above said, 6 months without a re-entry permit is the guideline, and you can no longer obtain a re-entry permit. So yeah, returning on June 5 is better than June 14, but there's still a lot of risk of being denied entry at 364 days. Returning next week would be even better than June 5. Something to think about.

I cant come back next week... I have to fix few things with my old parents in Italy ...I was planning june 13 but maybe I ll be back one day before the one year...just to make sure to be fine...anyone with similar experience?

  3. Dear all,

I really need help from you!

I am a conditional resident, I am abroad (family matters) , since june 6 2017

I am planning to come back to the US june 14 2018.

Do you think I will need a rentry permit? it is going to be 1 year and a week out of the US.

How long is going to take if I apply for a rentry permit at the embassy?

there IS any chance I can go back without any problem at the port of entry? Its just a year and a week.

anyone has any experience like mine?

    What you guys recommend me?

Is maybe better going back june 5 so in this way it will be less than a year?

I don't know what to do....

Thank you in advance for your help!!!

From when they received it back, it's only  been 4 business days (not including weekends and date of delivery) so they may not have gotten around to cashing the check yet.

Don't worry about your green card expiring, that doesn't mean your status expires.

When you get the package sent back, it's as if USCIS never received it in the first place so they may or may not quickly realize why the resubmission was sent after the correct filing date.  It's good that you sent back the rejection notice with your application as well so they can refer to that if needbe.

What about the fact that i sent the same package with their notes on it?

or i should have sent a new form for my i751?

i instead sent the same form and i noticed some notes on it…..that they made….

  5. Here is my situation.

My 2 years green card expired october2.

    I filed i 751 september 23,

on september 26 i recived  a letter from uscis saying that the amount guarantee was not correct.

I corrected the check(there was a misspelling between the amount in number and the written amount).

I resubmitted everything as it was and they received my package on october 16.

    No news.

    The check was not cashed.

Now i am afraid of something… i resubmitted everything as it was,and in the form there were some notes that they wrote on my i751… should i have sent a new form?

they wrote on the letter resubmit the form with the correct check and i just did that…. but the fact that i have no news and they didn't cash my check make me worry...

The first time they were very fast…this time its already been a week and my green card is expired.

Also i didn't send a letter of explanation for filing late because i filed on time the first time so i just sent the same package with the letter that they sent me about the wrong amount guarantee….so they should know why i refiled late...

    Anybody with the same experience?

    thank you

  6. Hi!!

I understand you may feel homesick. However if I were you, call your relatives using skype or facetime or any other thing that you can see them, maybe this will help a little but Do not go without a green card!! you are risking too much!! if you have to stay out and wait for the embassy... this might take a lot of time!

    i went in Italy ..

    I stayed for one month….

i came back with advance parole after 3 years of illegal presence...

    no problem at all!!!

took 10 minutes just make sure that my advance parole was real!

    Stop get people scared everybody!!!

    good luck!

  7. Sorry, but you have waited this long, you will have to wait a bit longer if the second part of your post is to come true. If you leave now before getting the GC, you and your husband will be separated for approximately 1 year while you wait for a spousal visa to re-enter the US. I would play it safe IMHO. All those telling you that it will be fine have no dog in tis fight and will not suffer the consequences--only you and your husband will be impacted.

Up to you and how much risk you are willing to accept compared to the reward.

    Dave

Just talked with U.S Customs and Border Protection.

They say as long i have my combo card and my approval notice everything is going to be fine. You will be back!

    Great new!!!!!!!! :)))))

But are u talking about experience of somebody else or just like this?

i NEED SOMEBODY ELSE EXPERIENCE PLEASE USING ADVANCE PAROLE AFTER A OVERSTAYED

  9. Hi everybody,

i need some advice but please don't start saying something like you waited for long time why not wait anymore…etc… THANK YOU!

So i came in Us with Esta 3 years ago, got married with a US citizen in March and sent my paper in May.

I just got my EAD combo card for work and advance parole and my i-485 is ready to be scheduled for an interview .

So everything is going very well,my only problem is this …i need to go to italy next week i miss my family so much and i cannot wait anymore.

My husband is coming with me,I'm going to use advance parole…i read a lot about a risk to travel with advance parole after a overstayed but most of people came back with any problem…i also talked with a lawyer that also told me should be ok ,you have your travel permission and you are with your spouse should be fine…because you are not a criminal etc…. they have big fish to catch etc...

anyway I'm a little bit afraid of course ,i want to go but i don't want to be separate from my husband when we will back…so

anybody in my situation have used advance parole to travel?????

    anyadvice???

    THANK YOU SO MUCH !!!!!!:)
