    I know from experience that "work and travel" participants are not subject to the 2 year home requirement. So no waiver needed.Check your visa in the passport. It should say "not subject" on the bottom. Your DS 2019 form should also have a check mark on "not subject".
    Even if you needed the waiver, it's not that hard to get, unless you're a doctor or if you received money from the U.S. Government for your program.
    Also, if you're married for real, you're ok. They probably won't care that you overstayed

    Sadly, infopass is often as useful as the first tier as USCIS phone customer support..if this happens to you, ask to speak to a supervisor

    But can't your husband travel between the U.S. and Canada just with his Canadian passport or ID? Does that cause problems for his residency application?

    Come to the U.S. on J1 to work during the summer. You are allowed by law to have a girlfriend at any time and of any nationality, and if you decide to get married and apply for residency at some point, you have the right to apply.
    Just make the summer job your purpose for coming to the US on J1, not being with your gf

    Fees are wrong...
    I485 is $1070 (985+85)
    I131 and 765 are $0 if adjusting status.
    Sorry, you must have looked at old fees

    I am not from Chile, but as someone who has been through the j1 waiver process recently, I can tell you that it is merely a bureocratic inconvenience, and should not cause you problems,as long as you are not Fulbright or some other U.S. government sponsored scholar.
    Once my embassy issued the no objection statement, the state department sent a favorable recommendation in about 2 weeks, but then USCIS took 2 months to send the final approval. Worst thing about it is that it is entirely out of your control, and between the DOS and USCIS receipt you have no way of tracking your case.
