Gosh...
First of all, this is not my case. I am currently living in U.S. if I had issue, I would go see courthouse clerk, lawyer, and etc. Simple is that..
it is way too easy to solve this problems if the person is living in U.S. However, she is living in somewhere that she needs to have visa to enter
the U.S.
Second, I told her many times to upload her story in the visa journey to get helped (Obviously, she did not.. Some people have poor research skills
that's why I am trying to help her out.)
Guys, I want to see what is the best option to do.. I posted here to get advice instead of getting criticism.
I wanted to help her out but I've never dealt with this stuffs before to be honest...
The reason I posted this subject is that I've had great experiences with VJ. That's all.

Each individual is issued a visa or not based on their own circumstances.
There might technically be an appeal process, but in practice it just isn't a thing. One can always reapply when denied under 214(b). A 214(b) decision is entirely at the discretion of the CO.
214(a) depends on the subsection. If it is prostitution, then a waiver would be needed unless they can convince them that the inadmissibility is incorrectly being applied. I'm not sure if such a waiver exists for a non-immigrant visa or not (sorry).
Anyway....first step is getting clear information on the reason for refusal. Is it due to prostitution? If so, why do they believe she was involved in prostitution? A lawsuit is a civil matter...presumably there's much more to the story here unless it's a mistaken identity.
Thank you..
I am sorry what is CO stand for?
It was crazy because she never got arrested, never had lawsuit but I want to give her direction where she can find a way that she is innocent.
Such as, go get Court report (if she has any) or contact to this or that place...

I'm not sure where they got prostitution from, but they are basing it on something (biometrics? same name as somebody else?).
If she was denied for a crime that did not occur, she can submit evidence to the contrary and try to appeal. Note that it's very, very difficult to do so for any non-immigrant visa, especially a tourist visa. She would have better luck with an immigrant (or K class) visa IMO, but obviously that doesn't apply to her right now.
Basically, she would be inadmissible and an inadmissibility can be overcome (either via showing it does not apply or via a waiver Edit: in general...not that one would apply here).
If she was denied under 214(b), then there's no appeal. She can reapply, but this is discretionary based on the CO's understanding of the circumstances and her ties to return home.
Basically, she would have been determined not to be eligible for the visa at this time.
soo.. is it going to affect to her family as well since some people said she intend to immigrate & and 214(B) or 214(A)?
And I saw 214(b) has appeal....I believe..

Hello, This is not my situation but my friend need help.
She got student visa & studied in CA around 2016 to 2017.
after that, she went back to the country where she was working... She got denied her B1/B2 visa application
The officer said she did illegal activities in the United States. The officer gave her the reason code
214(a) & received new email from U.S. Embassy that she was actually denied under section 214(b) which is prostitution.
She never did anything but the officer said she got into lawsuit which involved in prostitution...
If that case, where she needs to contact & find out?
The officer did not care even She got her criminal record from FBI which contains fingerprints & states that there are no criminal record at all.
Does she need to find court case from the state she was living in between 2016 to 2017 ?
if she did not do anything but her name & Her identity related... what she can do the best?
She cannot come to U.S. to get her record & her all visas got cancelled ever since she got denied B1/B2 visa application.
Thank you.

That's why i said idk about sb-1. But. Transportation letter she still can try tho. But im not 100 percent sure to get it or nah
OP let her 2-year conditional GC expire without filing I-751. On what basis is she supposed to get an SB-1?
-
You can enter U.S. But you have to get transportation letter from C.B.P. (U.S. Embarry or not) Or returning visa. Sb-1(not sure about sb one)
Google it how to get it. Explain your situation with letter. Collect all your plane ticket receipt whatever w/ all supporting doc tax return. Your bills. Anything. That you left U.S. But you are actually didnt intend to terminate your green card. However. Therr is no guarantee to bring your kid. Also. No guarantee to get transportation letter or not. I understand your situation. However. You COULD ask someone. Or police. Before you left. I know it sucks. But. We gotta be realistic.
Plus. If you go back to U.S. That means you gotta re-apply it. But if you are no longer staying in U.S. The best way is giving up your card.

So!!!! I just got updated as USC. U should check it too
-
Yeah my SSA didnt copy of my certificate
They just asked me to scan it and i did lol smh. They asked my passport as well but i dnt have passport yet
Smh.
That's very strange. Back in 2010 I went to a local SSA office with my naturalization certificate, they made a copy of it and updated my status. Got a card two weeks later.
Must be a new procedure.
-
Did i get it yet. I didnt get it tho
Still nothing here, either. She called the SSA today and they claim that they've tried to confirm her USC status with USCIS 3 times but have still received no response. They told her she could come in with her US passport, if she'd like.
Frankly, I think it's stupid that the Department of State can issue a US passport based on the Naturalization certificate but the SSA can't update a person's status (which basically means nothing in everyday life) using the same official document (without separate confirmation from USCIS.)
-
I havent heard anything it's been over a month too...
Idk why but thats why i coildnt even get physical card as well.

I gotta call there smh. This is insane!!!
Nothing yet. She's going to wait, at least, one full month, then go back with her US passport that she just received as proof of citizenship. The lines at our local office are wrap around the building ridiculous, even an hour before they open, so she doesn't want to waste any more time there, if possible.
If you are only worried because you lost and don't have a physical card, it's not a big deal. As long as you know your number (which will not change), you are OK. An employer (or anyone else for that matter - banks, etc.) can not demand to see the physical card for an I-9 as long as you can show them a US Passport, Passport card or combination of state driver's license/ID and your naturalization certificate and can tell them your SSN.
It's frustrating but it seems to be normal these days. Don't stress! It will get updated.
-
Did she get it ??? Can u update for me. ? Ima go check there tmr
My wife is going through the same thing. 4 weeks ago next Tuesday, she updated her status and received the same letter - applied for an SSN (no, not applied for SSN) and it could be up to 4 weeks to verify. Since it is so close to the 4 weeks, she called again yesterday and they said they are still waiting on USCIS.
Don't worry!!! I think it is (unfortunately) completely normal.
USCIS is slow even with other government agencies. They told her that if she had her passport (which should arrive today), it would be faster. I do wonder, however, why one Federal government agency (SSA) puts zero faith and credit in the official documents of another (USCIS) but the Department of State can issue a passport, which the SSA will accept as proof, in far less time using the very same Naturalization Certificate?

Oh my god..... It is crazy!!!they told me 2wks to verify and call or email back. Then 2wks later i will get issued smh. I guess it will take forever and ever. Wow

SO... I got citizenship. Almost a year ago. I had my SSN card. I was 10 years greencard. Holder. I went to training and lost my SSN stupidly. But i had to update my SSN at that time. So last week. I went to office. Brought my citizenship. Tell them i brought thks and another my ID. Everything seemed so smoothly. All of sudden my officer told me. I gotta wait till. USCIS verify me. And 2 or 3 wks later i gotta call or email back to SSN OFFICE to ask if uscis verify and approve or not. What .. Is that i am panic.
Then gave me letter this
This is to acknowledge that you applied for a SSN on aug 22,2016.
Before we can issue you a social security number card, we must verify the focument(s) you gave us to show your Citizenship with the federal, state,or local office in the united states that issued the documents. This may take up to 4 wks. If that office verifies the authenticity of your documents we will mail you a social security number card. If that office does not verify your documents you are not eligible for a social security number card and we will inform you of this in writing
My officer told me. It prolly your name too. Cause i got two first name. No hypen. Just space. Hopefully my citizenship name wasnt wrong. Hopefully they didnt put my another first name as middle name i still dnt know. Is that common things btw????

No one who came from this website believed my experienced too I had that same exact happened. 1 year extension letter isn't green card. I had to get transportation letter from embassy so I could come back to u.s. and u.s. officer told me why did u need this letter? Your 1 year extension letter could let u get in to the u.s. and I said yeah... I believed that too but they never let me get into the airplane because my gc was expired. Even tho I hav 1 yr extension letTer.
Don't travel while your gc is pending case. No one cant guarantee your visa issue.

let me tell you something sweetie.
you eventually received k-1 visa then entered U.S. for marriage. you both were waiting so long time for it.
but now he wants you to go back your home.
even if you marry him, it isn't that easy. he wouldn't care of your all visa, money, and food anything.
he is not your man. you are not his one love too. sadly..
it isn't that easy I hopefully you go back to your country again. then live there .... even if you marry him you still have to file green card. also after 2 years of green card you should get 10 years GC too. whenever you have to do it you should proof your both relationships... from all material stuff.
I don't think it is easy also. why would you do that? you are the most important girl in this world. you can't just be sad and devastated because of one guy who doesn't respect his fiancée.
One of my friend. ( not anymore..) she was pregnant and hers husband went back U.S. alone.
but eventually she came to the U.S. with tourist visa then she married him even if he was cheating on her while she was pregnant.
everything was alright. we couldn't just blame what she chose. however, things were getting worst than before.
he didn't file green card for her so she was overstayed in U.S. for 2 months but yeah eventually she filed it and received gc. but before that she was pregnancy woman. but He never ever helped her to get meal.. buy food anything. so she lived hers life horrible. the only thing she could do is using internet website so everyone was helping her until hers baby born... also, when baby was born she was about to die. because of too many blood I guess. while I was sleeping hers friend asked me to reach hers parents yup. hers husband wasn't there while she was having HIS baby.
idk what's going on right now. but I bet she and baby are happy now. but it was sooo miserable at the first time.
Hopefully you won't choose your life in a hell. you don't deserve it.
I am super sad now. I arrived at chicago in May 21 with K1 visa. July 17 my boyfriend brought me to get the marriage license. Yesterday he said the he did not want to get married with me and hope I go home on Sunday. And ask me to buy tickets by myself. His excuse is that we could not get along well just because I want to use his library card. 1 week ago he gave me the library card to me and said I can use it to borrow books in library. Yesterday he wanted it back with very bad attitude. So I asked why he acted like that. He could borrow the books with his driver license. Then he began to say we could not get along well and he would never get married with me . i am speechless.
I know something wrong after I came here. He never answer phone call and text in front of me. And after he come back from work, he spend almost half hour in rest room with the door shutting several times each day.
When we go buy something, he keep saying that he is short of money and stressful . Then I paid them because i think since we will live a life together , it is ok for me to spend money.
last Saturday, his daughter asked money from him. He told me that he was very stressful and not get pay yet and could not send the money to his daughter. His daughter need the money on Monday. Then I asked him to use my money .
And before we went to get marriage license , someone friend me on instagram . I went there to check that I found some photos of him with another woman on there. I asked who she is. no response. I asked him, he said I should trust him. Just some friend. But I asked him what kind of friend to hug to take the photos . He said that I am too jealous and could not endure me; another thing I got email with the content as this "keep in mind that Paul had screwed me over on d whim, it's only d matter of time before he does the same to u. Just wait and see.keep in mind that Paul had screwed me over on d whim, it's only d matter of time before he does the same to u. Just wait and see."
I am speechless. I do not know what I should do . I kind of want to give up this relationship. kind of can not let it go.
His back is not good .so I learn the therapy massage to help him. Search online for the back surgery information and epidual shot for him. Search the stretch methods to release the pain.
He like chocolate brownie, I learned to bake for him.
I learned how to cook american food for him.
try my best to reduce his stress and try to understand with him. not argue with him.
But now he asked me to buy a ticket by own to fly to home. Asked him why ask me to come here if he does not want to get married with me. I asked him : "do you know this is not a game? How much I sacrifice? I quit a good job at my country. Do you know that? you even asked me to buy ticket by myself.". Guess what he said. He said that I could find a job easily with my experience and education and I had money to buy my own tickets.
Should I buy my own ticket to fly home? He definitely to cheat on me ,right ?I did not tell anything to my family and friends yet. I do not want them to worry about me.

it would be better to stay together. why she cannot be a nanny around your area?
also, even if she stays relative house. it would be better to keep every address with you. if its not it would be complicated when she remove hers conditional green card.
-
we are.
am still waiting for bct.
I've been waiting for my 10 yrs green card over 8 months.
It wasn't easy at all. I went to my country with 1 year extension letter however CBP wouldn't let me come back to U.S. so I had to get transportation letter from U.S. embassy.....
I did biometrics over 3 times... and I went to the office for getting another 1 year extension stamp. then... nothing was changed so I started to keep bugging USCIS officer eventually one of the officer helped me to look over my case then eventually I got it.
ohoh i see .. your RFE make it longer than average.speed.
-
If you worry about only photo. Dont worry of it. My husband forgot to send all evidence. Such as joint bank account. Photo. Tax returns.. etc. We got rfe. And I sent for 3 years bank account transaction also 3 yrs tax returns transcript with tax return. Plus. Photo. With affidavit letters from 2 friends.... you are fine.
