  1. Hi guys,

A lot of people told me that I can sponsor my mom to the US even when I am only a permanent resident, they asked me to open the case the provide more documents when I am a citizen. Problem here is that I only have a 2-year green card at the moment. Would it be possible to open a case to sponsor my mom now? Or I have to wait until I have a 10-year green card?

    Thanks a lot.

    JH

  2.         Hi guys,

I am currently a permanent resident in the US, I just got my 2 year green card. I am considering to sponsor my mom to come visit us, since we can't visit my home country at the moment. Is it possible to sponsor her when I only have my 2 year green card?!? If so, can someone instruct me to the link of the instruction or something?

Thank you very much in advance, guys.

    Sincrely,

    JH

  3. I too came in through same-sex marriage but we filed the I-130. I am in the process of removing the conditions on my GC. Here's my concern:

Trump (and the Republicans in general) oppose same sex marriage nationally, preferring to leave the decisions at the state level. If the decision to nationalize same-sex marriage is reversed, then I am only considered legally married in the states who recognize same-sex marriage. The issue is that the USCIS is federal, and therefore wouldn't recognize my marriage as legal. If I have my full GC at the time this potential change happens then I'm good because I'm a legal resident. What I'm concerned about is if this (again, potentially) comes into effect before the USCIS review my petition to remove conditions. After all I checked the box which says I've been legally married to the same person on the original petition, and because of my legal marriage I request they remove conditions. If the marriage isn't recognized at a federal level then they may have the power to deny my petition on the grounds that I am not legally married and therefore have no claim to residency in the US.

All we can do is sit back, watch from afar, and hope for the best. Or I guess move back to the UK and start a petition for my husband to come over.

I didnt even file for the ROC yet. Same case like yours, but I just got my 2 year GC 4 months ago..this sucks.

  4. Hi everyone.

I came here as a K-1 visa (same-sex marriage), I already got a 2 year green card last July, and kept hoping that Trump would not win. Well, now we have this forum and I'm kinda worried if my 10 year green card will be effected or even if I would be deported to my country when my 2 year GC expires since Trump does not seems like LGBT community.

    .

Any smart idea if it would happen?

  5. Hi there,

Can you tell me why you get RFE?? Did you forget to submit vaccination supplement letter/missing shot (on Yellow paper). The only thing I provided is the Yellow paper for Vaccinations record I got from Vietnam so I am worry I will get a RFE too

    Hey,

It's because I didn't get enough vaccination when I was in VN. :))

There was 4 required vaccinations + TB test.

If you had your vaccination before going to IOM, they would transfer your vaccination into the I-693 and seal it, but if you had your vaccination AFTER going to IOM, they would not do it (cause they didn't get the yellow paper from you) and you would have to go to the civil surgeon here in the US to have them transferred to your I-693. I didn't, so I had to do it.

  6. Dont worry to much, This kind of stuff happens all the time at interveiws. They giv you an RFE and when you sedn it back they grant you your green card.

It sounds to me like watever doctor report was filed with Uscis didnt meet their tandards, or they made a mistake.

1.how long until I can get the sealed package: for us it was a couple days

    2. They told me on the phone something about TB test? What is it? Do I need it?: all I-693's include a tb skin test. basically they poke you with a little needle, then you come back within a certain amount of time(I think its 2 days) and they see if you had a reaction to the test. They will measure the bump it creates. If the bump is a certain size it just means you have been exposed to TB OR had a Bcg vaccine when you were younger which creates a "false positive" result. It happened to us , its not a big deal they just take an xray to make sure you dont have TB

    3. On a RFE they usually give you a letter with what you need and where to send it. If they didn't I would try to contact someone at uscis to find it where it goes, my guess is that it would go back to the officer at your local office but I am not sure.

4.as soon as they have the evidence they will produce the card. it takes a few days to make and send it to you.

    Harry

Thank you very much, Harry! Your info is really helpful...:)
  7. Hi VJ friends,

My husband and I had an interview this morning (June 30), and something went wrong...:(, which was a lil bit disappointing.

I had an issue with my vaccination stuff, the interviewer claimed that she did not see any "doctor approval" on the I-693 submitted to them at the stage when I applied for my K-1 visa. Back to then, I had my health checked in Vietnam, then went to the K1 visa interview, got my visa and then got vaccination, so all the vaccinations were not transferred to the I-693 and that was the reason why I sent my vaccination record to the USCIS in a package of AOS. I read somewhere in this forum that as long as my vaccination record (from my home country) is still valid, then I do NOT need to file I-693.

So, when we had an interview, she gave us an RFE and asked us to file I-693 then send to her asap..that sucks, cause my vaccination record is still valid until this Dec.

Anyway, we have to file it and send to them, I have some questions which would be much appreciated if you guys can help us:

    - I found and booked an appointment with the civil surgeon office, when I go there and ask them to file my I-693, how long until I can get the sealed package? They told me on the phone something about TB test? What is it? Do I need it? Can I refuse taking it since I don't see it on the I-693 form..:(..I live in Alabama, and the office is in Montgomery, AL.

    - After getting the package, which address of USCIS should I send to? I reside in Alabama, and my USCIS field office is in Atlanta, but I sent my original package (I-485, I-765 and I-131) to Chicago lockbox, so I should send it to Atlanta office or Chicago office??? I'm confused, hope you guys will help me.

    - How long does it usually take since they get the addition evidence until I get my green-card? Cause she said she only need my I-693 then we'll be approved. (She actually gave us the approval notice then took it back :( )

I look forward to hearing from y'all.

    Thank you

  8. My wife is not working and is a joint account holder on our bank accounts and one CC and not simply an additional auth user

    Thank you heo luoi.

What bank are you using? and what do they need to add me as a joint credit card holder? Can you share a lil bit more?

I am a joint account holder in my husband's account (with debit card), but for credit card, I am only an authorized user.

Look forward to hearing back from you.

  9. You will not need a lot of bona fide marriage evidence for AOS. They know you do not have a lot. Showing some finance co-mingling and co-habitation documentation should suffice. Keep saving that stuff though. You will need all that and more for ROC down the road.

You are having an interview, so ask the IO at your interview if you can have your green card printed with your married name. Explain you mistakenly used your maiden name on the adjustment forms, but wish to use your husband's name instead.

sure will, thank you very much for your advice..:)

  10. Hi VJers,

10 more days and we will have an AOS interview; my husband and me did this ourselves, therefore, we would like to obtain your opinions to make sure that we had everything needed for an interview.

So, besides all the original documents (vaccination forms got from my home country, birth certificates of us, passports, Marriage license), what else do we need?

About the evidences, we tried to collect everything that we think they may need:

    - hotel receipts that we have.

    - presents, letters we sent to each other (before marriage when we were apart)

    - our wedding invitation cards.

    - theme park tickets, (we traveled to Atlanta but I lost the city pass :( ), however, my husband can check his bank account and show them the receipt he paid for the city pass + the bracelets they gave us in atlanta zoo + our photos. Can those be counted?

    - Life insurance, vision insurance, dental insurance, retirement insurance, car insurance.

    - Joint bank account.

    - We do not have joint credit card account since I have no job yet. but, we set up me as his authorized user, though. Can it be counted?

    - Messages we sent to each other. (before and after marriage)

    - Some letters from my friends who met my husband.

    - Greeting letters form our friends to our apt.

    - and tons of photo of us with his family, my friends, my family.

We are currently living in an apt, and the contract is ending soon, so my husband wants to add me to his "next contract" with another apt because he does not like this apt, so we are moving to another apt; therefore, we won't be able to provide lease contracts with our names on it, either utility bills, or cars..:( . Will it affect much? I'm kinda worried. :(

Beside those evidences, what else should we need?

The third concern is about having my last name changed, since we did not know about this, I wrote my last name in the marriage document which means I had my last name in our marriage license, how can I change my last name later? I read some of the posts, and I think that the best step to change my last name is when we apply for the naturalization, however, I wonder if they will base on our marriage license (which I had my original name on it - without my husband last name) to change my last name, then how can I change my last name to my husband last name? I am so confused about this issue. I hope you can offer us explanations. They would be much appreciated.

I hope to hear from you guys soon. Thank you very much in advance, VJers.

    Best Regards,

  11. Hey guys, just got my EAD card in the mail, a week before my AOS interview. I can't get my social security card by that time. And I'm not going to be able to get ID. Do you guys think it will be a problem for me? ??????

I think you are able to apply for an ID card already, since you already had your EAD. Otherwise, you can go and apply for a driver license test, they would need to see that as your ID card. :)

In some state, they allow taking the learner permit and the road test at the same time, after finishing the test, you will get a temporary card. I think it helps.

  12. It depends on where you live, usually it takes around 4-5 months. You can always call them, but the customer service officer does not know anything about your case and they will for sure ask you to continue waiting.

You can take a look at the similar cases on Visajourney to see how long it usually takes in your area, but I think it takes around 4-5 months in the south..lol

    Hope it helps.

  13. Hi. I think you are lucky that your Green card will be directly processed. You won't need the combo card (EAD and Travel permit) if you have the green card. :) and looks like you don't have to attend an interview so you're likely ahead. :) Congrats.

He/she will have an interview for sure, if not, they will say "Your case was approved", and that online notice is just for his/her I-485, there are two other online notices for his/her EAD and travel permit, though.
