  1. So if my status shows "Case is ready to be scheduled for an interview," it does not mean that interview may be very soon? I am with Denver office and according to everybody's deadlines, it takes at least 8 to 9 months from the date of submission to the date of an interview. Any thought?

    It looks like there isn't a rule for that. Some Ppl dnt get any case update online and get interview date quickly, others get "ready to be scheduled..." And wait months. The good thing about having it "ready to be scheduled" is they won't ask for more evidence. Other than that all you can do is wait.

  2. Has anyone had any updates on your case status from USCIS website since the original submission? Mine still says "on March 13th we received you forms......"

    We already did biometrics on April 8th, I guess it's just a matter of waiting :(

    Same here, it says received forms March 10th. Today is the 56th day, I would assume we still have another week or two before hearing about EAD.

  3. Today is 56th day since we sent our package.

    If there is no update until 25th, we'll contact our congressman. I know it would be soon but there is nothing to lose, so why not do it.

    Our timelines so far are basically identical. People from February group that reached 75th day without news called and placed a case inquiry and had it approved shortly after. That could be a first step before reaching for congressman.

  4. Honestly I'm not even thinking about the interview, it could take 1 year I wouldn't care. I'm really looking forward to the EAD card and can't wait to go renew my license. I got pulled over 3 times aready with expired license. 1st for a burnt tail light (got away with no ticket) 2nd for not wearing a seat belt (I had just left a parking lot and was about to buckle but he saw me as I came out and pulled me over, also gave nothing) 3rd going trough Alabama-Florida state line, got the ticket for driving with expired license $273 and court appearance.

  5. We filed for the EAD & AOS on 23rd March 2015, and had our bio-metrics on 22nd April 2015. And, a day later we had a RFE saying out AOS is put on hold, we got the letter yesterday and it says the joint sponsor doesn't have required income. The joint sponsor files 1040 form, and he's self employed he makes well over required. I bet they are looking at adjusted gross income instead of gross which doesn't makes sense because he files 1040 form.

    And, do u think that RFE will effect EAD? on the RFE it's just our AOS case number.

    My wife is also self employed they r looking for line 22 on 1040.

  6. I did my bio 10 days ago, but nothing has changed, however, I also noted some march filers who have received interview letters already, especially those from California, and Washington state. So I think it depends on how busy your local office is. I also noticed, those adjusting from K-1, are having theirs AOS processed faster.

    I think K1s are processed either in California (which they say is going super fast) or Texas.

    Anybody knows at what point our application goes from NBC to the local office where the interview will be held?

  7. Sure! On page 8 of the instructions, section 4 : what if i cannot meet the income requirements, part b. talks about the use of intending immigrant's income to sponsor the application. The only issue is that the income has to be legal to be considered. I hope this helps :)

    Like I said, I couldn't use my income because I was self employed and out of status, I wonder if after I receive the EAD my income automatically changes to "legal". But anyway, good luck to you hopefully your RFE is not about I-864 and it's very simple.

    USCIS allows the use of intending immigrants income to support him/herself. As long as the beneficiary works legally in US. And in my case, my USC husband is still the one who sponsors me, he has no income but he is still the one who has to file form I-864.

    Because Im his wife, I dont have to file another form, I can just put my income together with his on form I-864. I just work in US for around 2 years now, so I havent worked enough 40 quarters. But I guess USCIS isnt very fond of cases where the beneficiary sponsors themselves.

    I really understand what you are saying and it makes sense to me. Only reason I am saying all that is because after consulting with a lawyer he told me otherwise. And I never found information saying intending immigrants income could be used. Do you mind share where you got it from? I have waited 3 years to AOS because my wife had no income and I was the only source of income to our family but mine wasn't considered "legal"
  9. Well you are legally allowed to work on H1b and if you make above the poverty line then what they would want to know is if you prove that your current income will continue after getting GC (basically up to 3 years atleast).

    You can also use assets (savings in banks, bonds etc) to sponsor yourself as well.

    Anyways You probably should wait for RFE and see what it says. You can check from Lettyana's signature that they got the RFE a week after the online notification.

    I am sorry but i fail to understand how the beneficiary can use his own income on the I-864. The I-864 is a contract signed by petitioner saying that he will support beneficiary financially so that beneficiary won't become a public charge. You can read on the I-864 instructions the cases where you dnt need an I-864 like if you have worked 40 quarters. In that case you would fill an I-864W and wouldn't need to submit I-864. If you submit an I-864 at least the minimum income HAS to come from petitioner, they dnt care if you work legally, if you were to lose your job petitioner has to be able to support you.
  10. Thanks RnZ, I thought so too. I'm working as H1b Visa and my husband is unemployed now, that's why i use my income to sponsor myself, maybe no luck this time. When I submit, my employer did write a letter to state my position and how much I make, but didn't state the prospect of future continuous employment. But I will wait to see what the RFE is about, for now that's the only thing I can think of.

    I dnt think you can sponsor yourself, you might wana check on that. For how long have you been working? I'm on my phone so I can't look it up now but I believe you need to have worked 40 qualifying quarters (10 years).
