  1. Hmm, it seems a bit weird that they would RFE you after you sent all that. But they thought you didn't have enough, but you DO, so you need to convince them of it. Once you send everything on that list, they should be able to figure it out.

why is it weird that she got a RFE? If you read her first post you will see where she says that her husbands income for 2014 was a little short of the 125% poverty guidelines, but now her husband is making enough money to stay above it and that's what she's trying to prove.

Littyana, have you sent your answer yet?

I am following your case closely because I believe I have a big chance of getting a RFE for the same reason.

I wish you the best luck.

  2. I'm concerned about my I-864 as well, all I included was copy of 2014 tax return ( most recent one is required, 2 years before that are optional) we had only filed 2 days before sending the whole application so transcripts were not available at the time. Yesterday I ordered the transcript in case we get a RFE in the future. I'm worried because my wife dnt have pay stubs or anything else to prove the regular payments, all we have is a 1099.

  3. hi

it's not necessary, but if you're sending the i864 for petitioner and the i864 for joint sponsor now, the most recent tax is 2013 not 2014

after tax season is over, April 15th, only then the most recent tax will be 2014, now it's 2013

you have to write down the amount of the last 3 years of taxes, but then you check the box that you are only submitting the last one

You could be right but it doesn't make sense to me what you said. The "most recent" isn't the latest one someone filled? If one filled 2014 already isn't it the "most recent"? Why tax season has to end for 2014 to become most recent?
  4. Hey ggodoi,

Our filing date is almost same as yours,

Did your case status on USCIS website mention anything about your Biometrics letter before you received it?

or did you receive any email or text regarding your Biometrics letter before you received the actual hard copy?

We have signed up for email and text alerts but we have not received any email or text about Biometrics nor do we see any update on case status on the website, So I was wondering if you got any email or text regarding your Biometrics before you received the actual hard copy of the letter.

I have only checked my case status on the website once when I got the NOAs in the mail, so I can't tell if anything changed since then. I have not received emails/texts for the appointment date, just the letter in the mail today. You will be getting yours soon for sure.
  5. You pretty much answered your own question haha, but you're right, the best is not to start in debt. But to each his own, right?

Some ppl (like myself) try to pay everything possible with a credit card to stack up on the rewards, but I won't use the credit card if I didn't have the money to pay it right off in full when it's due so I'm not paying abusive interest fees. Also OP could have a credit card with an offer of 0% interest rate for a period of time and would like to use it to pay ( If it was possible). What I'm trying to say is, we can't assume OP doesn't have the money just by his simple question.
  6. What is the reason you wana use a credit card? Buying a many order with a credit card is not possible, I wouldn't take a cash advance for that because it usually comes with really high fees. And there is a limit to cash advances I believe as a fraction of your total credit limit. If you don't have the money right now save it little by little dnt put yourself in a hole with credit card debt.

  7. My situation is very similar to yours, I came to the U.S. in 2008 on a F1, December 2012 I got married (I was never in a OPT tho) We found out my wife was pregnant in January 2013 she didn't qualify for I-864 nor had anyone that could be a joint sponsor. I went out of status and started working and my wife stayed home and went to school. There was nothing we could do to get my situation straighten up as she had no income. Finally in 2014 with baby getting bigger she was able to start working and this month (March 2015) after filing taxes where she met poverty guidelines, we sent all paperwork to AOS. It wasn't easy going through this couple years I can't put in words how good it felt to finally be able to start the process. My DL expired in May 2014 with my F1 Visa but I was out of status long before that since I was out of school already.

I wanted to share my case because it seems really close to what you are going through.

My only concern is why your now husband dnt want people to know you both r married? It seems like you need to seat down with him for a talk and get things on track. Good luck to you.

  8. Hello all,

My I-485 package along with I-765, I-131 and I-485 got delivered to the Texas lockbox at 3:39am on March, 11th, 2015 by USPS priority mail. I did file the G-1145 along with my application.

I am yet to get any notifications about my application. Should I be worried? My check has not yet been cashed. When can I expect to get notified about the acceptance of my application?

    Thanks,

R u adjusting because of marriage? What visa you adjusting from?
  9. I got a secured credit card through First Progress. I sent them $500 to open an account and then got a second one a few weeks later with another $500. They will go as low as $250 I think but I'm not certain. As soon as I used those for about 2 months I was able to get a non-secured credit card. My credit is slowly getting better. I have several cards now and pay them all off each month. Paying them off entirely is good but not good enough to pull your rating up very high as the length of time you have credit comes into play as well.

If you set up a credit karma.com account it will actually show you a list of good cards based on your own situation.

First progress is known for really high annual fees and other fees, if I were I would cancel it as soon as possible. People should stay away from first premier, first progress, credit one and other lenders like these that charge crazy high fees. I have grown my credit history for 3 years and just now applied for AOS so it's possible for anyone to do it without the gc
  10. I decided not to risk it i'm going to take my money from the money orders back and will send 2 checks.

    1 for $420

    and

    1 for $1070

    That should be OK :)

Thank you all for your answers.

I sent my packet last week with money orders $1000 + $70 and $420, I got the emails and texts with my receipt numbers yesterday so I would say there is no problem in sending more than one money order as long as total amount sums up correctly. Good luck.

  11. I just sent my AOS package yesterday,

    Yes I chose A for the I-485 part 2.

On form G325A like in any other form if you need to add any extra information to which there is no space you should attach a sheet of paper, write to what part that extra information belongs and sign the sheet as well. ( that's how I was advised to do) I dnt think you should send a second G325A just because you need to add another address to that part.

When sending proof of bona fide marriage I sent everything I thought was relevant but I did not have bills from previous months I just sent one copy of each and they were from last month ( I'm not sure if 10 or 5 or 1 copy of the same bill just different month is relevant) I heard if your address on your drivers license is the same to send a copy of those too.

    Regarding the I-131 I can't help as I didn't filed that one.

  12. What visa are you adjusting from? If you are working legally, then your income can be used on the USC sponsor's I-864. You will need to provide proof of the income and proof that the income will continue from the same source once you become a permanent resident.

    .

If you are not working legally, then your income cannot be used on the USC spouse's I-864.[/quote

I am current out of status, I was on F1 visa, I met my wife in 2012 we got married the same year, december 2012 we found out she was pregnant, 2013 I started to work selfemployed being paid cashand givrn a 1099. our daughter was born august 2013, my wife have not worked since beggining 2013, we are well above poverty guidelines but all income comes from me. my wife gona fill form 864 and attachhed gona be the transcript of our joint return. we have nobody to co sponsor. I work and provide for my family, I dnt intend and never will be a charge to th e government.

  13. Anybody??

After doing some more research I believe there is not such a thing as self sponsor on this case, since we dnt have anybody to joint sponsor we will have to go with only one I-864. Its gona be my wife and on income I will use amount of our last year joint return. Will it be a problem that 1099 is in my name? is it ok to use income of our joint return as her income on form 864? Do I send copy of 1099 in my name or only transcript of the tax return?

I am really confused and a joint sponsor would make it a lot easier but we dnt have anybody really. Another confusing point is, I consulted an immigration attorney and he said my case wouldn't be difficult and that our joint return was perfect and it wouldn't be a problem, but then I read many threads where people are saying somebody out of status cant be working (which I know, but have no choice) and that beneficiary's income cant be used if from illegal employment. I dnt know what to believe at this point and I need this form 864 figured out before I move on.

Any help would be much appreciated.

  14. Hi,

My wife and I are preparing the package for my AOS. Our most recent tax return is jointly but all income came from me through a 1099, she is a stay at home mom (hard work but no income). Question is, do we just need one form 864 where she will use the amount from our joint return? do I need one as well? Do we need a letter from the company I perform work to?

Thanks in advance for the help, reading this forum has helped a lot.
