Gotcha. I guess what made me think that was the word “start with a tourist visa”. Their mom/ dad would have to apply for him. It’s a tricky situation because they’d have to disclose that they have family ties in the US, and by law, DHS presumes immigrant intent with tourist visas. They’d have to prove strong ties to their home country, which is contradictory to having family in the US.
    They can still try though.

so his parents has to apply for a tourist visa and bring him? is that what. you're saying? thank you for this dialogue and insight!

Nope. Bringing the child on a tourist visa with the intent of moving him here is fraud. And you'd actually hurt him more than help him.

Does said child have parents? There is no IR petition for nephews. Your wife can petition her sibling (parent of the child), but siblings are not immediate relatives and it can take 13-16 years to have a brother get a green card. Once the parent gets a green card, the child is eligible too (if unmarried and under 21 I think)

not exactly what i'm saying. i was trying to not write a long thread. We want him to come to start getting acclimated. We want him to come each year. So we want to know if he can come visit without his parents. They all can't come right now. Eventually, we hope they will all be here atleast with tourist visas with the goal of a green card.

No. The applicant needs to show they have the money to support themselves and show strong ties. It comes down to the CO confident that the applicant will return to their country. Showing strong ties is vital.

    Thank you so much!

  5. Hello,

My sister in-law has an interview tmorrow at the US embassy in Dominican Republic for a B2 visa. We want her to come visit for a couple of months. She has 2 kids and works as a hairdresser at home.

    Thanks so much!

  6. Hi,

I want some family to come visit me this year. We applied for a B2 Visa.

Can anyone give us pointers for passing the interview? How much money does one need to have in the account? Does a beautician that works from home considered to be employed? What is the profile of someone that will get approved for a visa.

    thanks!

  7. Hi 👋🏽

My wife has a graduation this summer and we would like her sister and nephews to come visit. Her sister is a hair stylist and works from home. How do we validate that this is real employment? Not sure what elese she needs to take to the interview.

Can anyone offer suggestions to help her get approved?

    blessings!

  8. Hello and blessings to all,

my wife and I submitted I-751 at the end of January. We sent it overnight 4 days before her resident card expired. The check was cashed but we haven’t received a receipt letter.

Is anyone else waiting for an NOA from I-751?

    thanks so much!

  9. Hi,

We had our infopass appointment on tuesday. We were denied the I-551 stamp because we didnt have a pending case.

Apparently, the best course of action is to file the I-751 with all the evidence and the police report along with an explanation letter as to why there isnt a copy of the green card. Then once we receive the receipt letter take that in along with the police report to the local USCIS office to get the I-551 stamp. Btw, we had the letter of explanation for the stolen green card notarized. It only costs $4 at a UPS store.

  10. Thank you so much for your reply. We will do just that!

The local field office hasn’t had an available appointment for 30 days almost. We’re just gonna show up tomorrow early and bring all our documents.

We will definately make a copy next time and keep it in the “vault” :)

This stolen wallet incident has been a total nightmare. We can’t get a replacement social security card because we don’t have  the resident card. :/

Thanks again! Many blessings to you!

  11. Hello,

As we were preparing the I-751 package to remove conditions, my wife’s wallet was stolen which contained the green card along with other valuables.

We don’t have a copy of the card can we send the package without it along with a letter of explanation and a copy of police report?

And I would also like to know if a new green card is sent when the conditions are removed or do we have to apply for a replacement anyway? The fee is almost $600 for a replacement. Which is almost as much as the cost of I-751.

Thanks for any help you can offer!

I don't think the OP is a USC, according to their timeline. Also, an immediate visa is not available for IRs of an LPR, so they will have to wait until their PD is current. This is more complicated than just filing for AOS. I suggest seeking a good immigration attorney.

A hardship waiver (I-601) is not available for an overstay of an LPR.

I am U. S. Citizen. What steps do I take?

Do I need to submit the form to pardon the expired visa? And then based inthat reponse apply for AOS?
