hi, i need some advice regarding to the change name, so im filing for my roc waiver and i want to use my single name coz im already divorced, do i need to change my name to in my ssn and in my drivers licencse name too before filing for roc? thank u.

    Hey!

I actually ended up being asked for further evidence to support my case. Whilst I was super scared of being denied, I took it as an opportunity to send in a copy of my new marriage certificate and a picture of my ssc with my new name on it along with a letter explaining that I had changed my name back legally. I received my green card a month later with the correct name on it!! Such a relief.

I am VSC filer. May 8, I got a RFE on August 3. I filed with multiground waivers: divorce and extreme cruelty. I do not write much on this thread because there are other threads for my case.

Anyway, the RFE was for a more detailed affidavit of the abuse case. Which I already submmited and got confirmation yesterday that it was received by USCIS. Hope they waibe tbe interview...if not, I will attend interview and that will be it.

I'm so sorry to hear that you went through that. I wish you all the luck in the world with your application xxxx

This indicates that you have a max of 12 weeks. However they can request a response in less time so there's really no way of knowing :c

"USCIS officers may reduce the response time from the standard timeframes only after obtaining supervisory concurrence. This discretion should be used on a case-by-case basis when warranted by circumstances as determined by the adjudicator and the supervisor.

The maximum response time for an RFE may not exceed 12 weeks (84 days). However, when an RFE is served by mail, USCIS officers should include additional mailing time for the RFE to reach the applicant/petitioner and for the response to reach USCIS."

If you're filing with a waiver they might be requesting a copy of the divorce decree.. Is this something you submitted with your initial application?

    This is what I sent to them;

    image.png.f12822391dd4e1dca648b48b4b3b185d.png

I've no idea what else could be needed. When we broke up I had to leave the house in a hurry and all of our bank statements and a lot of official documents were in there and he wouldn't allow me to have any of them and he wouldn't let me in the house to get the rest of my belongings.

I'm a little worried as I am now married again and pregnant and have bought a house and have started a business over here. I will be shattered if I get rejected.

I guess only time will tell....

  4. Hey everyone. I just saw that I have an RFE. I am may 17 filer WAC17238...

I just saw it on the case tracker, I haven't actually read the letter. I work in music and tour all the time and won't actually be home until Mid November. Do you know what the time limit is on the letter and getting further evidence to them?

I was divorced in December 2016 so filed with a waiver as we are no longer on speaking terms. I can't even remember what I sent the first time so I have no idea what I could be missing. If anyone has been through an RFE, please can you help. I'm so worried now that I will be rejected :(

Some states have different rules for non citizens and would use the validity period of your legal status. That's why you got a 10-year DL, which was the validity period of your green card.

For some reason when I went to get a new license I was given one that expires in 2025 even though my extension was only up until 08/18. Maybe she made a mistake. I’m not complaining though.

Did you get any updates from infopass today? If we can get the card or any approval or any interview by Christmas, it will be the best gift for me this year.

I just got home. I had to get an extension because I am heading to the UK in a month and I won't be back until 1 day after my first extension expires. I was hoping to get a full year extension because I will be going back to the UK in November for 6 months or more but they only gave me 3 months and said that I will have to come back before I leave again to get the full year extension.

Whilst I was there, I asked if there were any updates on my file. They just said that it still says "received biometrics...". I thought as much. She agreed with me that we wouldn't hear anything until Christmas.

Sorry guys! Not a very fruitful fact-finding mission.

  7. Hello!

I apologise if this has been answered a million times before but I am not great at this and can't work out how to search for it...

I started my ROC in April 2017 and filed with a waiver as my ex and I were divorced at the end of 2016 and are no longer on speaking terms. I have since then changed my name legally and I would rather not have my married name on my CG (if I am approved of course). I have heard that having a GC reissued costs a lot of money and I don't want a constant reminder of my not-so-great marriage every time I look at it.

I have tried so many times to get an infopass appointment, even trying at midnight as it worked for me once before but I just can't seem to get an appointment.

I am CSC so I have probably another 5 months of waiting until I hear anything but I'd love to get it out of the way if possible.

If you have advice or if you can point me towards a thread that can advise, I will be so grateful.

    Thanks so much in advance!!

Did you file I-751jointly with your spouse?  VSC received my file on May 8th 2017.  Case was transferred to local office on April 9th but I haven't heard anything. I filed I-751 with divorce and abuse waivers. Any idea on how much extra time cases like mine take?

I would like to know this too. I am in the same situation.

Actually my friend sent me a message because her husband´s case was transferred. Then I checked my status an hour ago. I´ve checked yesterday and it was still at CSC.

For the check I had to use the other WAC number....

Are you an early May filer? My case was received on the 26th so maybe I won't hear anything for another few weeks. Either way, this is so exciting!!!

Is there any way to make an Infopass appointment other than online? I've been trying via https://my.uscis.gov/appointment but every time it just says "Currently, there are no available appointments. Please check again tomorrow."

Since current process is from September 2016, it seems unlikely they will get to us by May. https://egov.uscis.gov/cris/processTimesDisplayInit.do

And we can't make an appointment to get stamp or even just basic info (since I don't see any way to check i-751 online)?

I had this same problem what I needed to get my extension from them. I found that waiting until midnight was the way. I guess the system resets at midnight so it releases the appointments for the next week. If midnight doesn't work, try 1am or 11pm as it could be a different time zone...

Do you mean I can just show up at a local USCIS office and pick a number for my turn like at a DMV? I'm sorry for so many follow up questions. I'm desperate - never received my NOA1 letter like it got lost the mail while I received my Biometrics letter and already completed Biometrics last June.

Oh sorry. I no meant I waited until midnight to make an appointment with infopass. That was the only time I could find available appointments.

  12. Hey every one!!

Please could someone point me in the direction of a thread that could answer this question (I can't find one) or if you have the answer that would be awesome!

My green card will expire on the 18th Aug 2017 and as of that day so will all of my government ID's (drivers license, state ID). Is there any way to renew these IDs with the extension letter? I don't really want to carry my passport around with me as I have a tendency to loose things and getting a new one would be rather annoying.

Thank you so much in advance!!

  13. Oh wow! What an amazing show of support from all of you. I have had two very hectic days at work so havent been able to reply. My apologies.

Thank you all so much for your valuable advice. It really makes a girl feel loved and supported.

I have reached out to a few lawyers on avvo.com but havent had a reply as of yet. I think I am going to get together as much evidence as possible and then, if I feel confident in what I have managed to gather, I will seek advice as to whether or not to file with an attorney.

I've tried to get copies of my joint bank account but as it was closed back in November, they won't allow me to get copies unless I go into a branch. The nearest is an hour away so its not as bad as driving all the way to Chicago. I also have a few credit cards where he was an authorised user if that helps

Also, The utilities i have called so far won't send me copies of any statements as they say i should just go online and print them off. I'll keep working on that one....

    Other than that I have

    - a joint tax return

    - a sales receipt for our car in both our names

    - joint credit card statements

    - loads of travel items from our vacations

    - proof of a 50 mile walk we did on our own for charity (the fundraiser page etc)

    - emails from our join bank account whenever our comcast bill came out cause it was always over our alert limit (it's a long shot)

    - millions of social media status updates about how much he loves me and how great a wife I am (another long shot)

    - I'm sure I can find friends who would be willing to write an affidavit

    - joint health insurance bills

    - Joint car insurance

    - vet bills (?)

    - all the little things like birthday cards, anniversary cards etc etc.

I'm sure i will come up with a lot more after thinking about it a little more. Any suggestions are welcome. I will surely be doing a lot more research on here to see what other goodies I can include in my package. Then I'll see if I have enough.

You guys really have brightened up my week with all your support. Thank you so much!!!!

  14. Damara! You angel. I was beginning to feel defeated.

I wasn't on the lease as it was a verbal tenancy with a friend of his, but we did live together for the entirety of the marriage.

So if I were to call the bank (for example) and ask for a copy of a past joint statement to be sent to me, that would work? If so that is amazing. I have plenty to show that we were connected in every aspect of our lives. I just thought that once they were gone physically, they were gone forever.

    I will start making calls.

Also, you seem to know a lot so you may know this, I just read this on the I-751 instruction sheet. "Filing with a request that the joint filing requirement be waived or individually filed. You may file Form I-751 without your spouse if they are deceased, you are divorced, or you and/or your conditional resident child were battered or subjected to extreme cruelty. You may file this petition at any time after you are granted conditional resident status and before you are removed from the United States.". Do you know if that just means people who are divorced due to battery? Or is this something I should call and ask USCIS about. It would be great to get a head start on the process but I wouldn't like to have my petition returned.

Thank you so much for your help

  15. I said I have records of his abusive messages. We rarely got physical and I never had to call the police. There are more forms of abuse than just physical and as I'm sure you know, relationships have their ups and downs, we just happened to be on speaking terms when we decided to end it.

When i mentioned the bills in our name, this includes our joint medical insurance and all the other things that were in both our names. I'm sorry if that was not clear. I think I have the receipt from our car and i have one joint tax return that i managed to get him to send me. This is why i am freaking out because, as you say, "the burden of proof is on me" and i have no idea how to go about getting it back without having to speak to him again.

If you would like me to send you a PM with the last few weeks of messages from my ex just so you can see exactly why i do not want to see him again, then I will. I'm sure you would understand.
