  1. You need to answer Yes to both questions 9 & 10.. That is positive.

    It was a past K-1 and will also need to provide ALL copies of the Final Decree between you and the former spouse. Get this from the Courthouse in which you filed. Get a Certified Copy, signed and dated by the Clerk with a Seal from that Court. This should have already been required for the initial 129-F submittal in your application/petition. Did I miss something?

    You in the past did file for another party so take my words as best you can whether that worked out or not.

  2. Yes you would list your EX in 9 & 10 being you completed an I-134 (and for AOS an I-864?) and the I-129F for her.

    Did you complete AOS (complete the I-485 & I-864?) with your EX, and has it been less than 10 years ? Is she still in the USA? If yes, is she still an LPR? If yes... you will have to consider her as a dependent, even if you are not supporting her.

    Hank, im sure I did file for I-485 & I-864, and less then 10yrs and I don't know if she still here....she took all the documents and abandon the relationship less then 2 yrs of the marriage. She only received a 2 year green card, I think its expired by now..

    10. I have submitted a visa petition(s) to U.S. Citizenship and Immigration Service on behalf of the following person(s). If none, state "NONE"

    I was divorce and married thu K1 I-129F on my first marriage. Unfortunately it didn't work out, so I filed for divorce and withdraw my petition less then 2 years of marriage..

    Do I need to put her name on question 9 and 10 ??? Remember I withdraw my petition and divorce her under 2 year marriage..

  5. 1) Yes you need to complete the I-134 and send it, original signed form. (Send this DHL, UPS or FEDEX) You only need to list your income if it meets the 125% poverty guidelines of the I-864P, don't need to list assets or bank balances. You need to have the W-2 (or 1099) to substantiate the income. If you are missing your copy of the 2013 W-2 then request the transcripts for 2013 from the IRS and sent that instead of the 1040/W-2.

    2) NO.... as in NO! You only need your most recent tax return and W-2 (which currently is 2013) (Can email these)

    3) An employment is nice to have but not required, no harm in having it. Optional o

    4) For sure not needed. If you want to include copies of your bank statements, just make copies of your regular bank statements (these can be emailed as well)

  6. Guys, I have a question. my fiancée from the Philippines said I need to send these documents to her ..read blow

    1. form I-134 (AFFIDAVIT OF SUPPORT) original ink not scan copy

    2. internal revenue tax ( 2011, 2012 and 2013)

    a. form 1040

    b. W2

    3. Certificate of employment (indicate the annual salary)

    4. bank certificate (signed by manager

    (indicate the open account date and current amount

    a. bank statement in a year)

    my question is:

    1. do I need to send her all 3 tax years 2011, 2012, and 2013 ???? I heard I can only send 2013 tax documents

    2. I can provide 1040 tax forms all does years but I don't know if I can find my W2 ..is it going to effect me if I only send her my 1040 forms ???????

  7. 93% of the background checks are returned within 2 weeks (10 business days). The remaining are "positive" hits that require further review. The majority of the work is done quickly, but less than 1% end up having to dig through paper records or get the paper records from the correct agency, which can cause delay.

    I've seen people on here get to NOA2 in under a month, with no expedite, and I've seen people get stuck a year waiting. There seems to be no rhyme or reason to the out of order experience many have expressed frustration over. If they said it was the background check holding it up, that means they are waiting for some paper records to be retrieved. If it was your fiancees name that triggered the delay, it wouldn't be denied at this stage.

    The good news is that they have completed it and your RFE means as soon as you get those G-325As in, you should have your NOA2 in under a month.

    ^^^^ YES !!!! Im just glad RFE IS done.. i have been patient long time and im glad i didnt lash out to USCIS call center or send any nasty emails to them.

    went to visit my fiancee to ease the pain from being apart for so long ..but saying good bye at the airport for the 2nd was the worst feel. i felt so sad leaving her behind again

  8. hank yes i did, they said they cant talk about my case coz it was in pending background check.....lol..... i did everything i could but i get the same answers.... i just laugh bout it now coz im so stress n missing my fiancee so much.. we do skype everyday after i get home from work but it not the same of being together ... i even went to visit her in the Philippines the 2nd time in Oct 1 2014 ... only stayed for 12 days coz my job wont allow me to stay longer...we were so happy together i didn't want to come back to chicago...lol

    i thank god the backgound check is over n my case is moving forward

  9. Hope you weren't calling/emailing since the beginning. :unsure: (squeaky wheel doesn't always get the grease, sometimes it's file gets moved to the bottom of the stack ;) )

    It is all speculation, no one knows exactly what was going on at USCIS with your file, I can guess as can the next guy. You sent in the wrong form, no one noticed at first, maybe that caused a delay in the background check... all guessing.

    Reality - you fixed the form issue, now things should be moving along. Hopefully soon you will get you NOA2 and the fun can start! :thumbs:

    hello everyone, I sent my I-129F petition last year Nov. 29, 2013 and still no NOA2 . i did everything by calling them and congressman getting involved and their response was they can not move forward on my case until background and security checks are completed.. (are they checking mine or my fiancee?I have no criminal records )

    ​on Oct 1st 2014 I received a RFE stating that i need to send them a new G-325A form coz i sent them a G-325 form, apparently that's was my mistake.. thats the only thing they ask for !!!!! so I sent them the new G325A form..

    em i getting close for my NOA2???????? and i want to know why my our background and security checks took almost 1 year.. coz i been reading posts on here and most of you guys get approve in 5 to 7 months only !!!! so happy for you guys when i read your approval but sad when i think bout my fiancee coz we been waiting for so so so long...

    ​anyone in the same situation or in the same boat waiting for this long for NOA2??????

  10. Serious doubt it has anything to do with you getting a divorce, if that were the case over 50% of the folks filing petitions would be waiting a year for approval ... I will stick with the folks at USCIS did an :oops:

    You included a complete copy of your divorce decree with the petition...

    Hank from all those months i was waiting i called and email USICS 3 times a month ..and also emailed n wrote a letters to the contacts below.. they gave me the same answer..so thats why my case was stuck in background check but why so long i ask them but they couldn't give me an answer. im just so glad the background check is over n they are moving forward on my case...

  11. Almost a year and no action until Oct 1st...? I would say someone dropped the ball, lost your file, or fell asleep at the wheel. Yikes! Background check? Ya they do them, but it doesn't take a year unless you were "someone of special interest", I will stay with ... they misplaced your file, then after your congressman contacted them they when :oops: found your file THEN noticed the wrong form.

    Couple more weeks of being patient, if no NOA2 I would give a call again.
