  2. If she has her AP, then she should not have any problems returning. That is what it is for, to use to be paroled back into the US while waiting for the green card to be approved.

    My concern is if they are going to ask her for any paperwork other than her AP card and her passport. she did not travel with our marriage license only her AP and passport.

My Finally received the letter requesting evidence, the letter says my income does not meet the requirements for our household size since we had a baby a few months ago, but since I submitted my documents I started a new job with a big pay increase, but of course that wont reflect on my taxes, should I submit my resent pay stubs with my new salary, or should I just save the headache and have my be one of my sponsors, also if somebody can explain to me how to do this co sponsor with my mother, will she fill out the same affidavit of support form as me, please any help counts.

USCIS sent us an email about a month ago saying that they sent my wife a request for evidence noticed, than we received a noticed saying the post office returned the letter to USCIS I called USCIS to confirm the address they have and htey have the correct address, they said they will resend the letter, again today for the second time I get a notice saying the post office returned the letter, I would like to know what can we do they have the right address but the letter keeps being returned.

My wife sent her I485 along with I-765, I-131, she received an email saying that we would get a letter in the mail requesting initial evidence, it says it was mailed out on 3/21 we still have not received it, can anyone tell me what this initial evidence usually means or what they might be asking for or if this is going to put a whole on all the forms(I765 & I131) or only the I485, please any help is appreciated.

  6. I have another question completely of topic, with our AOS papers we are also submitting the work permit papers and the papers for advance parole to get a travel permit, each set of documents ask for two pictures do we have to submit six pictures in total

    No, you're fine. We didn't file our AOS right away either; you're not out of status or anything. As long as you married within the 90 day window you can file for AOS anytime after that; obviously the quicker the better, but you two are fine. You don't have to file for AOS within the 90 days. We waited filing ours so we can build up some evidence in our package like joint accounts, bills and insurance, etc.

    if you wife came in under K1 as is appears from your timeline, and her medical is less than 1 year old she had all the necessary vaccines done when she came in. If her medical from the K1 is expired go get a new one and get the civil surgeon to certify that she has all the necessary vaccines.

    We front loaded with our joint auto insurance, joint health insurance, joint bank accounts and bills. Our lease with both our names listed. We sent some wedding photos and proof that I've legally changed my name on my SS card. We sent my husband's (the USC) tax returns for the previous 3 years (that was optional, they only required one year). I've read that there's a good chance that we may not even get an interview so we wanted to try to convince them we don't need one. ;)

My wife came into the US on a K1 Visa we got married two months after, we are now applying for adjustment of status, however her K1 visa expired I know we took long to file status change but we had some financial issues and were not able to file right away, so my question is the following: will we have any issues applying for green card because her visa is expired, and how about for a travel document?.....please help.

    The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

    You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.
