  1. Can anyone who filed for AOS for their children clarify the fee? My wife came here on a K1 visa. I understand her AOS fees are $1010.00 but I am unsure of the fee of the children, who came with her on a K2 visa. I will be filing for AOS for my wife and children at the same time.

I have read the instructions on the I-485 application but it lists two different fees for children under the age of 14 years, $930.00 if filed independent from other family members or $600.00 if filed with the application of the parent under sections 201 b (A)(i), 203(a)(2)(A)or 203(d). Does K1 and K2 visa holders fall into one of these categories? Thanks for any info.

  2. We have completed all the paperwork for the AOS process. We used my wife's new last name (my last name) on all the necessary forms. We also used my last name for her children's new last name. Now that I am all done, I am not sure if I can change her children's last name by virtue of her marriage to me. I am trying to avoid an RFE if possible. There are many posts on here regarding using the wife's new last name on the AOS forms but I cannot seem to find any info regarding what to do for the children.

Does anyone know if I should use the children's last name as indicated on their visa, or can they use my last name now that I have married their mother? Thanks for any info.

  3. I understand that the AOS paperwork will reflect my wife's new last name but does this apply for her children also? I finished all of the AOS paperwork using her new last name for the children but now wonder if this will be a problem with USCIS, since I have not legally adopted them. Maybe I am over thinking this issue but I am trying to avoid an RFE if possible. Thanks for any info.

  4. Kampong received her Packet 3 @ 2 AM my time. Needless to say, she called me all excited an woke me from a deep sleep and I ended up working today on only 2 hours sleep.....zzzzzzzzzzzzzzzzz I couldn't get back to sleep because I was going through the checklist over and over in my head and then something clicked in my head.......I realized that she needed to renew her passport, DAMN!! It expires in September and it needs to have 8 months validity on it prior to the issue of visa. #######!!

She is going to head off to BKK this weekend from Lamduan and apply for her new passport, fortunately it only takes 3 days for the new passport and she will also get her police check done while she is there. Once she has her new passport, she will send in the DS-230, pictures and copy of the photo page of her new passport.

We can see the light at the end of the tunnel now, I hope that she will have her interview by the end of March but that may be just some wishful thinking.

    Chok dee to all.............

Sqdnguns, just want you to know that it will take two to three weeks to receive your police certificate from the BKK police department. Have them send it to your fiance by EMS. Good luck on getting your interview soon.

    Thanks!

She applied for her new passport yesterday and will pick it up Thursday morning then head over to get the police check done. She spoke with them yesterday and they told her she could pick up her police check on Monday but she does not want to hang around BKK any longer than she has to, she will have them mail it to her.

I was surprised when they told her she could pick it up on Monday.:blink:

Wow, apparently things have changed since my fiance applied for her police certificate in December of 07. Doesn't surprise me though. Good luck on the rest of your journey.

  6. This is so wonderful that so many have been approved at the interviews as well as many of you now have dates!

    Wont be long now.

To anyone who has recently went along to the interview, what did you wear? Or what did you see people wearing?

I'm really trying to pack light so that my fiancée can use my second suitcase for more of her stuff. Because of this, I'm trying to only bring what I would need for the interview, and a couple other sets of clothes.

    Suit, Tie?

Nice Pair of pants and a tucked in white shirt?

I'm just wondering what everyone wore, or saw people wearing while they were there.

I never thought about what to wear. I showed up in levi shorts and a polo shirt. Personally I do not think it matters what you wear, since your visa is approved based mainly on your paperwork. When I went, I did not see anyone dressed in a shirt and tie. Dress the way that makes you comfortable.

  7. Congratulations afterforever. Best wishes for the wedding and get well soon.

Thanks ThaiStyleUSA. I am really glad the wait for the visa is over. I think it will be a lot easier to wait for the AOS now that everyone is here. I have been procrastinating on starting the AOS. It just feels nice to be able to somewhat relax for awhile.

Good luck to you on your interview. It was very easy for us. Hopefully your finacee will have no problems.

  8. congratulations afterforever! hope you feel better...did you ever figure out what you had?

Thanks Kang Lang. I was told by the doctor here that a strain of flu virus on steriods was going around. He said it is taking people about 6-8 weeks to completely recover. I took a flu shot in September but the doctor said it did not work against this super flu. Hope no one here gets it. It kicked my........

Have you started your AOS yet?

wow 6-8 weeks that's a long time to be laid low but i bet it doesn't matter now that you have your visa sorted! no we had to wait a bit, some unforseen expense but we are gathering our docs and are filing this month :D . i plan to sack our attorney this week but am nervous about it. either way we will just follow the guides here and file aos on our on. can't wait to update our timeline with the next process. at least we are together for this part.

are you planning your wedding yet?

No, we have not set a date for the wedding yet. I wanted my fiancee and her children to get settled in first. I am hoping we will have a date before the end of the month though. At this point I have not even started the paperwork for the AOS. Maybe I will start that at the end of the month also.

  10. Hey everybody. I have not posted on here for awhile because I have been sick. Got sick in Bangkok while waiting for the interview. Thought I had the bird flu because I was so sick. Still recovering.

We had our interview on the 14th of January. It was very simple. We were out in about one hour. Got the visas on the 16th for Yutipha and the 2 children (took about 15 minutes). Flew back home on the 23rd. Long flight when you are very sick. It took about one hour to get through immigration at LAX International Airport in Los Angeles.

Applied for social security card for Yutipha on February 4th. No problem. One daughter started 1st grade on Wednesday this week. Hopefully we will marry next week. Not looking foward to starting the ton of paperwork for the AOS but I think the hard part is over now.

Glad to see everyone is getting their interview dates. Good luck to everyone. It's a long road but it is a lot easier when we can all discuss issues together. Thanks everyone for your support.

  11. Finally, the day is near. I will be leaving for Thailand on Sunday night (1/6). Our interview is on the 14th. We will be returning to the USA on the 23rd. I cannot believe this part of the nightmare is almost over with.

I am more than confident that the interview will be no problem. I have everything the embassy needs and then some. Better to have to much than to little.

    Good luck to everybody.

  12. Hey ThaiStyleUSA and Tmc225usa, hope you guys get your interview dates soon. It seems like it takes 2-3 weeks after sending packet 3. You can always email the embassy and see if they have received your packet 3. That is what I did. They are good about responding back in a prompt manner. Most likely your interviews will be around the end of January. Good luck to everyone.

  13. The ever patient one is now back among the living on Visa Journey. I have a DHL tracking number that CONFIRMS that our packet arrived at NVC this morning (Dec. 17)!!! At last the horror of USCIS is over!!!!

Hopefully our documents will be on their way to Moscow very shortly!!! I am hoping (optimistically) that Ramzis can be here yet in February!!! The patient one, Alane & Ramzis :wacko:

Congratulations Alane. Hope the rest of your journey goes at lightning speed. Good luck everyone!!

  14. Hello there! I'm located in Bangkok, Thailand...and just completing the steps for the DS 230.

Problem is my fiancee has a 5 year old son who is currently being raised by his grandmother. We are not planning to take him to America now, as well...financially we aren't prepared yet and two-- the son is in official custody of his mother (my fiancee's ex wife).

We are hoping to take him in a couple of years. In the DS 230 do I fill out his son's name for "person who will accompany us later." I would definitely do it, but I'm not sure if his son needs to accompany us to the interview (although I took note that another Sawasdee visa journey member's fiancee didn't have to take their child to the interview). The reason this is a problem is although his exwife is not actually raising the child, nor supporting the child financially-- she also does not want him to go to America.

We are currently financially supporting the child, and hoping that his mother and grandmother will change their mind in the future...if they see the benefits of providing him with a few more opportunities than in his current household (and as cynical as this sounds, that his son would eventually be able to provide much more if he were afforded an education) .

But with the current state of affairs, we can not take him to the interview as the grandmother and mother feel we are trying to "steal" him.

    2 questions.

    1) what should i fill out on the ds 230?

    2) does his son need to accompany him to the interview?

Thank you for your help.

I would definitely check the box that your fiance's son will "follow later". I do not believe it will be a problem if you do not bring the son to the interview, especially considering the circumstances. You can email the embassy as to whether he will need to be at the interview but like I said, I do not think it will be a problem.. They always respond quickly to my emails (in one day).

    .

    Good luck!
