  1. The exact same thing happened to me but it was moving from Idaho to California and we filed change of address for both of us at the same time, this was back in 2012 and I still have the notices they sent me. It's unbelievable they manage to do this in the first place!

    Once you notify them and they start to look back into it then it gets reversed real quick! We had verbal confirmation the same day we called and I think it was maybe 2 days between my denial notice and the motion to reopen letter plus an apology letter. Annoyingly though it would end up taking them another 2 months to issue me a new appointment date.

  2. I have my maiden name on my pp and married on my GC, I always book with the name listed on my pp and never have had to show my marriage certificate to prove I am the same person. It does take them a little longer to input it into their system but it's not an issue.

    To Ian H : no she would not have problem entering or exiting her home country because she is a citizen of that country and as long as she can show why the gc name is different to her pp then she will be fine. Since she is only omitting a name it should not be as big as issue as an entirely different name.

    For example on my birth certificate I have my first name, 2 middle names and 2 last names. However I only use my first name, first middle name (sometimes I use both) and 2nd last name. In Australia I do not have to file a legal name change to omit those names, I similar write a letter explaining why I omit the names when making legal documents and this is accepted.

    If a similar practice is accepted in Brazil then it should not be a problem.

I can't say my parents love the idea that I chose to move to the US and it probably doesn't help that half my husband's family is the stereotypical extreme Christian-gun toting-red neck either lol but I know they will have my back if I ever need help. Just ignore the BS and prove them all wrong. Back when my hubs and I were newlyweds there were probably a lot of people on both sides that thought we would never last but I couldn't give a f about they thought then and what they think now because obviously what matters is how you both feel about each other and building a life together.

  4. 6 months or more total every year to maintain residency but you will be eligible for naturalization next year so if you are able to meet the requirement then go ahead (dual citizenship). If not then start over when ready to move, I totally missed the part about waiting till baby is older. Ultimately it's up to you.

    Ugh Vermont is only up to Feb cases and really slow so you could be waiting a long time in US to make it to the approval stage. At that rate you would meet the residency requirement but not ideal for your situation.

  5. Personally I think everything from before and now because the fact you show that you are willing to work on your relationship again could help prove it was bona fide in the first place. It still shows a lot of trust in each other to have things in both your names even though you are no longer married. Either way it wouldn't hurt your application and is there really such a thing as having too much evidence? :)

  6. I don't actually spank her, more like gently tap her on the hand and say NO or pat her on the butt and sit her down in one spot (or try too) - it really depends on the behavior. I try to explain to her why she shouldn't do the said naughty thing but she's only 17 mo and doesn't quite understand. She's currently undergoing that rebellious toddler stage where when you tell her not to do it the first time, then she thinks it's funny and tries to do it again. She behaves 90% of the time so rarely discipline her.

  7. I would wait till your bio was done first before leaving again, do you have an address you will receive your letters and have someone who will tell you when you receive and letters while away?

    The reason why is say what till after bio is because even though you can travel with the NOA, you won't be able to track the case online without the other case number assigned to you after you complete biometrics. Also you are usually sent an appointment date within 30 days of filing.

    I'm currently away again for 8 weeks and left after my bio, it did not impact my case in any way but I can't say the same for continuous long absences. Make sure you have your NOA with you, as you will need this to re-enter the country.

    You will need to have a plan on what to do if you receive a RFE or interview while away. I was lucky and did not have to worry about this but as with USCIS there are no guarantees as every case is different so try to include as much evidence you can think of when you file.

    P.S I see you are filing with CSC, they are moving really fast but there is no set approval time so if you decide to wait it out in the states then better start planning now. Mine was approved in 2 months but some people have had to wait almost 6 months.

  8. Honeykitten, we also had to get a loan but luckily my parents were able to loan us the money. It sucks borrowing money but you will be able to work and pay it back once your EAD is approved and will have peace of mind knowing they can't deport you once you file plus when approved you will get a 10yr GC and save money not having to file ROC on a 2yr. Lastly I don't know how much your hub earns but if your financial situation isn't too good then you may need to think about getting a co-sponsor. Good luck!

  9. The line is the same for PR and USC or at least in LAX it didn't matter, enter the same line together as a family. They will ask why you have been gone so long (they want to know you intent to live in the US not abroad). I was gone 7 months and told them the truth that we were on holiday (my husband had an Australian working holiday visa.), they just said ok and stamped my pp. Our daughter is also a USC.

    Definitely get back to the US as fast as you can and file ROC, it will be hard and expensive to start over.

    P.S we hadn't filed for the last financial year's tax return when we filed so I didn't include it but I did send past years joint tax returns. Maybe you could send those in instead?

  10. I met my husband online on this silly website called hot or not in May 2010, he was deployed (Afghanistan) at time. We started talking just as friends but then realised we meant a lot more to each other than just friends, we met in LA on his leave (late Sep 2010) and spent a month together in his home town (Boise). He popped the question 2 days before we were set to fly back (me to Aus and him to Okinawa) and of cos I said yes!

    We skyped everyday and even went to sleep together on skype, I went to visit him in Okinawa that Dec/Jan and we had so much fun, you really cherish those moments. In March 2011 he PCSed to Twentynine Palms and he managed to rent a house off base so I came to visit for 3 months in early April and we decided to elope a day before his birthday (our wedding certificate is stamped my birthday - we are week apart) and even adopted a puppy to keep him company while I was away. Ironically I was the one doing all the leaving and he was the one in the military! Ha. We continued this way till we finally decided to look into filing paperwork for me to join him by then it was Sep 2011, we really didn't know what to do. I came to visit in late Oct 2011 and he really started to look into it (he couldn't take me leaving again), we attended an immigration session on base in San Diego Nov 2011 and that really got the ball rolling. We filed AOS Dec 2011, everything went quite fast but our interview was delayed by a mix up with our old ASC and CSC after an address change. We were finally approved at our interview at Chula Vista July 2011 and by then I was 8 weeks pregnant with our daughter (she is now 17 MO and a handful).

    My family adore him (they came to visit us in California several times and we even did a road trip together CA to ID via Vegas - it was crazy and awesome!) and he finally made the trip to Australia last Sep and met the rest of my family.

    We have been married just over 3 years and been together a little over 4. I am thankful for everyday I get to wake up next to him and not have to worry when I will see him next. We filed ROC end of May 2014 and were approved July 23rd (2 weeks after my GC expired).?
