    This is the thing, really. Belinda nailed it, as always -
    just remember, for a K-1 visa holder (her), she cannot adjust status without you. For now, file a divorce petition or annulment, and don't talk with her.
    If you wanted to submit something to USCIS, reference her A#, show copy of filed divorce petition with the courthouse stamp, in a letter noting that you two are divorced and you will not be filing anything with her, for her.
    The I-134 has a limitation of duration, only the duration on the I-94.
    The I-864, otoh, nails you for some time. Since no AOS set was filed, there is no I-864 in effect, at all.

    This is divorce court- nothing to do with immigration or the I-864 or USCIS. Her lawyer is using that as a sort of "pain and suffering" story to get more money. You need a lawyer to fight ridiculous claims. You did the right thing. She should not be here and spousal payment for a short term marriage is silly.

    As the others have stated, the I-94 is your arrival/departure record and this is the document that shows your legal status in the US. You are given this by the US Customs and Border Protection (CBP) upon arrive in the US with an expiration date--you can get a copy here which you will need for adjustment of status (AOS). You are legally in the US until it expires. Given that you are on a K-1 visa and not a tourist visa, your situation is a bit different. You have until the I-94 expires to get married. Once you are married the I-94 does not really matter except that you are out-of-status until you get the NOA1 after filing the I-485 AOS. You have no time limit on filing the AOS except that you cannot work nor can you exit the US and re-enter until you receive your GC or advance parole (AP). You also run the risk of being detained by the CBP if you find your self at an internal check point. So that is why it is recommend that a K-1 visa holder applies for AOS ASAP after marriage, plus it allows the immigrant to begin their life in the US sooner.
    The I-94 is also needed to get a social securiy number (SSN) using the K-1 visa. As long as it is more than 2 weeks from expiring, you can go to the local SSA office and apply for a SSN using the K-1 visa, foreign passport, and the I-94. Apply in the name on the visa to prevent any problems as most SSA employees are clueless about the K-1 visa. As a K-1 visa holder you are an alien eligible to work. One thing to keep in mind for the SSA employee is that the K-1 visa is no longer valid as it exipred when it was used to enter the US as it is a one entry visa. So it does not majically become a K-3 or anything else as it is null and void. All it does is show you are eligible to work and are therefore eligible for a SSN.

    When you enter the US, they will activate your visa. They won't let you use ESTA, from what I've heard.

    Once USCIS receives the file back, one of two things will occur:
    They will simply reaffirm their original approval of the petition and return to the Embassy for another interview. They will agree with the finding and issue you a Notice of Intent to Revoke (NOIR). If you receive an NOIR, the notice will specifically state why it is being sent (i.e. why the CO didn't believe your relationship was genuine). You will be given a deadline to submit a rebuttal (usually 30 days). An NOIR rebuttal must specifically rebut the points that were made in the notice itself.
    Failure to properly respond to an NOIR will result in the petition being revoked.
    A proper response to an NOIR does not guarantee reaffirmation and reaffirmation does not guarantee a visa will ultimately be issued.

    Congratulations Ko Zaw,
    For me, mine was approved on Oct 29th. NVC processed my paperwork on Nov 20th. By Nov 24th, US Embassy in Yangon had already typed up their instructional sheet (found out that later on). I e-mailed them on Dec 3rd inquiring about my paperwork and they replied within a few hours saying my fiancee can pick them up.
    My suggestion for you is after two weeks from now, start checking status of your case by going to the website below. Your case number starts with RNG******. Make sure you select "IMMIGRANT VISA (IV)". Once it shows "READY", e-mail US Embassy. They will let you know when to pickup.

    She will need to do the following....
    1) Fill out DS-160 online and print out confirmation page.
    2) Fill out DS-157, DS-158, and Additional Page. They will provide her with the forms.
    3) Need 2 passport size photos.
    4) Original birth certificate, original notarized translation, and copy of each documents.
    5) Original marriage/divorce/death from previous marriage (if any).
    6) Original police certificate in Burmese and original notarized translation certificate.
    7) Affidavit of Support I-134, which includes your W2, 1040, bank balance dating 1 yr, current employment letter. Also get letters from your bank. Ask them for verification letter.
    8) Any court records (if any).
    Drop them off at the embassy guard shack once she has put together. If they are satisfy with your documents, they will call your fiancee in two days and ask her to go for her medical exam. They will ask her to choose from International SOS or Parami hospital. Medical costs about approximately 170 USD. You can also pay in Kyats. Oh, and also be sure to have three more passport size photos to take them with her for medical.
    Later on she will also need 265 USD for visa fees. She doesn't need it right away. I think she would have to pay when she goes for her interview. I will update you once I find out myself. Good luck!!

    I just happened across your thread and thought I'd offer some thoughts (as the U.S. female getting ready to marry a Pakistani - although it is not an arranged marriage in our case). I met my fiancée while working in Pakistan, and have quite a bit of insight into the culture there, so hopefully this information will be of some use to you.
    In the U.S., as I'm sure you were aware before you got married and came over, women have far more rights and freedoms to enjoy. You may not have realized just how many/much. Perhaps you and your wife did not discuss your expectations and hers about what she would and would not give up to be married to you, and come to an agreement on what would happen when you arrived and how you would live as husband and wife. Unfortunately, if your expectations were that she would stay home and be the traditional Pakistani wife (no job, no friends outside of the home, only interacting with women), you didn't have realistic expectations, as about zero U.S. females are interested in leading a secluded home life. And I'm sure she had no idea of what your expectations would be if you did not directly state them.
    In the U.S., a wife has as many rights as the husband. And therefore, you and your wife should talk about - and agree upon - what your life together will be. Otherwise, you will be unhappy, and end in divorce. And it doesn't sound, from what little I've read, that that is what either of you would like.
    That said, if you talk and then decide that your relationship won't work with compromise, then that's what needs to happen. However, I wouldn't count on being able to stay in the U.S. The conditions of your visa/stay are based on your marriage to this woman. I'd be surprised if Immigration let you stay when that marriage fails in such a short time. It calls into question how serious you were in the first place, and that your application may have been a fraud.
    I also agree with most others here that you should be more worried about fixing the marriage than getting your green card. That's not a good sign at all.

    When immrsregi said "Your fiance is free to apply for a tourist visa", immrsregi was't referring to the cost. Immrsregi was just saying OP's fiance has nothing that would prevent him from applying visa.

    I received my NOA2 hard copy yesterday. Have a few questions...
    01: For K1 petition, am I suppose to have a priority date? Mine is blank.
    02: In the PETITIONER and BENEFICIARY boxes, they have our names printed and A numbers.
    What do these A and nine numbers mean?
    03: In the Notice Type box, it says Approved Notice Valid from mm/dd/2014 to mm/dd/2015.
    What should happen during the time frame and what happens after it expires?
    04: In the main message box, it says the following...
    "The above petition has been approved, and forwarded to the listed consulate."
    My questions are....
    a) Do all NOA2s say that, or mine is exceptional?
    b) Although it says forwarded to listed consulate, there is no where in the notice it mentioned which consulate they forwarded to.

    CSC has been busy processing transfers lately. Looks like they are giving transfers priority over CSC petitioners. With that said, petitioners who are transfers to CSC have better chance of getting approved faster than CSC petitioner.
    Good news to transfers.......bad news to CSC petitions like me.

    We haven't scheduled the interview yet, but my fiance just made the payment online. Her tips are to either make the payment through a CITIC ATM if it is available. If not, a payment can be made online, but your fiancee will need to have a debit card that can do online payment.
