    That said, I think you can just add more evidence at the NVC stage. Many people front load and then "side load" at NVC as well.

    You won't be able to "side load" at the NVC stage for a K-1 Visa.  They just create a case number and forward the petition.  Side loading is for CR-1 or IR-1 when it's required to send documents to the NVC for processing.

    Refiling without doing so first will likely have the same result.

    This is exactly what to do.  You are not eligible for that petition because you're not "legally" married.  You will have to marry "legally" and file a new petition. 

    Step 1 - Cancel the current petition

    Step 2 - Register in Ghana for marriage

    Step 3 - travel and marry legally

    Step 4 - return and file CR-1 petition

He then said it doesn't make sense. Another question was why we allowed some to take pictures of us along the beach when I visited? She answered he is a friend who was with us because we needed a chaperone. That too didn't make sense in his ears. Our case was then DENIED. I have already contacted my senator's office and the reply they can't ask for second interview, but they will communicate with the embassy to know the reasons for denial and if it could be possible to schedule a second interview which I can be part of. For now its a sad moment, but am still hopeful  for our future because am  planning to extend( really costly on my part- work) my stay in Ghana and get married if its the last option before flying back to US. Thanks friends for your wonderful support during this process.

     

    You see your problem right here?  This is the type of thing that gets an automatic denial in Accra.  You lost contact in 2008, but then the date was 2010.  Anything that was stated like this either at the interview or in any evidence is the quick reason for 221-G

  4. My wife was approved this morning for her CR-1 Visa in Ghana. Thank you everyone here for the support and information. We sent a lot of information when filing, and I also sent additional information at NVC when I submitted the IV and AOS packets. NVC sent the information with our case file to the embassy. My wife went in with even more documentation and photos. She says the woman doing fingerprints commented that she had more than enough evidence. When she was called to the window, she was asked only a couple questions and told that she was approved. We thank God.

  5. So my wife's interview for CR-1 Visa is coming up in July. According to the official letter we received from NVC with the interview date, these are the only documents that they are requesting. Can someone with experience of CR-1 interview in Ghana please advise me what else we should have on hand that they may ask for?

    - passport photo's x 2

    - original passport

    - original birth certificate

    - original marriage license

    - original police certificate (they state if it's older than one year to get a new one, but the one's in Ghana state on the form that they are valid for 6 months, so we will get a new one just to be safe)

    That's all they ask for. In addition to what we send with the I-130 and then what I side loaded at NVC for evidence, we are also including;

    - Photos from all visits

    - My passport stamps for all visits

    - proof of holiday together in S. Africa

    - Chat logs

    - Screenshots of call logs

    - proof of joint bank account with activity

    - MoneyGram receipts

    - copies of evidence already submitted including affidavits from both sides family members

    - Proof of life insurance with wife listed as partial beneficiary along with my daughter.

    Should I include tax transcripts even though they are already confirmed at NVC? Do I have to re-submit evidence of prior marriage termination again? Is there anything else I am missing that anyone has been asked for at the US Embassy in Ghana? I appreciate the help, thanks.

  6. They always want all originals at the embassy at the interview, regardless of what was submitted to USCIS. Should be original marriage certificate, birth certificate, police report, and anything else you can think of. It's always better to have it and not be asked for it than to not have it and be delayed further. I know this doesn't help much now, but it may help anyone reading this thread that has an interview coming up. Please keep us posted as to any progress, best wishes.

    Did you get married on the first time you met face to face in 2015? This has been a historic "red flag" in Ghana CR-1's. The other large rate of denial's for a "red flag" seem to be American woman much older that Ghanaian man. Haven't seen one of these cases on VJ been approved from Ghana being on this site over 2 years. Close to 100% denial on these two factors. Stay strong, your journey has at least a year or two until the possibility of a second interview. I am sorry for the bad news.

  8. It's offensive to servers to receive no tip because generally they are paid around $2 - $3 per hour just to cover taxes and deductions. So essentially she worked to serve you for free. The tips are the entirety of the salary of a server. However, it is very unprofessional to chase you down and demand a tip. This generally results in immediate termination of the employee. It's crazy how they don't have the option to add a tip to a card, I feel bad for the servers there as it's quite common nowadays not to carry cash.

  9. I believe you were looking on the non-immigrant visa section for the US Embassy in Accra. For non-immigrant visa's, the only person that can be in the consulate area is the applicant. For immigrant visa's you are allowed in the building as a US Citizen. You just show your passport and go through security with your fiancée. You may not be able to participate in the interview, that will be up to the CO if they want to include you in the questioning. I attended the second interview for my then fiancée in February 2015. The only issue I had was that it was scheduled in the afternoon, and they typically only let US citizens in from open until 12 noon. But I was able to talk my way through the first two levels of security convincing them that since I was the petitioner and was accompanying my fiancée, technically I do have an appointment indirectly. I told them I traveled all the way from the US to attend and I was definitely going inside. All first interviews are scheduled to arrive early so you will be able to get in. This was just a follow up appointment after two months of A/P that was scheduled at 1pm.

  10. No I am sorry, your wife would need to send you the w7 and notarized passport that has been notarized by an authorized agent-which is typically the US embassy although you should check the IRS website to verify. It is probably easier in your case to file MFS and enter her SSN as NRA

    Do you mean she can go to the US Embassy and obtain a notarization of her passport and send that to me? Not the original passport correct? They will look at her document and provide a notarization form of some sort?

  11. I need assistance filing for the ITIN number for foreign spouse. I read the requirements and they are requiring original or certified copies of supporting documents. My wife is in Ghana and I do not have her original passport. I only have scanned copy. I do have certified copies of our marriage certificate as well as her birth certificate. If I submit these two certified copies and scanned copies of other documents with photo such as passport and police report, will they accept that as evidence? Please has anyone done this without possessing the original passport? I have read the requirements on IRS website but it looks like we wouldn't be able to come up with any other documents on the list.

    1- voter id is the old style and no longer used

    2- she has been waiting over a year for her drivers license in Ghana - so we don' t have that

    3- I don't have possession of her passport nor do I have any faith in her mailing it from Ghana.

  12. You have several problems. They need divorce documents to two different men whom which you have never been married to or even met. So you obviously cannot produce those documents. The option now is to tell the truth about what you have said here. But then the problem is that you have misrepresented yourself on a US Visa application. This is usually a ban of some sort, could be a lifetime. I'm sorry to say that you have an issue that you most likely cannot overcome. Can anyone think of any waiver or anything that can help in this situation?

  13. Don't worry, they have it if it shows received Dec 1. The issue is actually getting it processed into their system. It takes several weeks for them to put the file in the system and get a letter out to pick up the packet from the embassy. Probably about five weeks from the December 1 date. They will say they don't have it because the person responds to the email just looks it up on a computer, not physically trying to lay eyes on it. If it hasn't been entered, they will say they don't have it yet. They will not go look for the paper copy.
