You may want to look at this link to help you decide what to do, though I'm sure an Infopass will help, it seems from this person's case, the word of a USCIS officer is not always good enough!

Checked my husband's case status online and his EAD and AP have been touched for the first time in two months. I am so happy! I thought it would never happen. I know it doesn't mean much, but it's what I've been hoping for.

I just called that number and got a person (was shocked, it seems like you never get a person when you call someone, I was totally flustered) and after I finally got Immigration out she said "o you want to check the status of your background check" and connected me. Unfortunately the department was closed (closed 4 minutes before I called
) but my question is, are the fingerprints the same thing as the background check or could the background check be connected to this infamous namecheck holding us all up and is there really some glimmer of hope in finding out info on it from this FBI line?
Not the same thing. The fingerprints are supposed to be received and returned by the FBI on the same day they are taken.

This is for AL, not Virginia, but I just called to ask about getting James a drivers license (since apparently my car insurance won't insure him without him having a US license for a year, which is insane) and the lady was telling me that he can get his US license either with a valid I-94 or with a greencard, the EAD is no good. Which makes no sense, greencards can take years, so you're telling me that people in the USA waiting for a greencard may not be able to drive for years? Anyways, she gave me another number for an immigration guy to call back tommorow so I'll report and maybe I can help out someone else in AL. I hope you get your Virginia drivers license thing resolved, they make this all such a pain for us!
Really??? In VA you can definitely use the EAD, in case other VA residents are reading.

Confirming Prints received
1-304-625-2000
Select the option of Immigration on the auto-attendant, get a
switchboard operator, tell them you want to speak with someone
regarding immigration fingerprinting. A rep will answer and look
up your "A" number and confirm when/if prints were received and
returned.

What I would be concerned about would be him getting charged for driving without a license. But could that happen? I mean even if he was outside the time that our state specifies, that's not the same as not having a license....right?

Thanks, all. I know VA allows it per the DMV website, just not sure for how long. I sure wish we could get his EAD soon!

OK, so my husband hasn't gotten his EAD, which mean he hasn't been able to show legal presence, which means he has not been able to get a Virginia Driver's liscense. How long can one drive using an International Driver's Liscense? The DMV website for Virginia doesn't specify a limit. Could he be charged with driving without a license? That's a misdemeanor, and after Scotty's recent post, I'm feeling freaked out.

[Yes indeed, voice does make a big difference. I think Samra just was having some fun. If she's feeling anything at all like me - well about the only thing that settles you on some days is a stiff drink and big 'who the hell cares anymore' let-it-all-out woo hoo! It'd be nice to think that people who have been 'waiting' a couple of months would allow that.

You know, ":BO1@L30, 2006" in computer-programming-speak might actually stand for, "We don't really know. We just put a date up so people think we might actually be doing work."

Sarah, I understand about the EAD thing. Really, I'd suggest you take a look at those numbers. There's no reason to assume his EAD isn't being handled. But it IS in line. A long line. I don't see EAD's getting lost or dropped. There are new mandates on those and the process has much more accountability than it did a year ago.
As far as belittling goes....that's all in the eye of the beholder. It's a two-way street you know. I've had my husband called all but a terrorist on here by virtue of the country of his birth. Suppositions are made as that's why his security clearance isn't done. I really don't think its out of order to ask some posters to calm down and take a deep breath. There really are times when people don't need to worry and agitate.
What bothers me about the EAD is that I have seen so many people getting theirs approved around 30 days after biometrics. Does the namecheck affect EAD?
As the resident seemingly expert on namecheck, what about when someone else from the same country of origin with the same name has also been granted a U.S. visa? Is this a big problem? I happen to know that this is the case with us.
And I don't have any problems with the suggestion to relax and calm down, just the way that it was must across. But then again, that could be largely due to the lack of any voice-related cues like tone, etc. T hat's a limitation of this kind of forum.

OK, I guess I should be a little more explicit. I have to defend myself, however, by saying that nowhere at any time in this forum have I given anyone reason to think that I expected to have anything approved expeditiously. I have often said I've hoped, but that's it. What i really, really have wanted was to see a touch anywhere on our file. Yes, yes, I know, they don't mean anything. But that's what would make me feel better. I don't even care if it's on his AOS-- I would just like to know that his being able to be employed is in the works.
But I will continue to stand by my original point here. High expectations or no, I don't feel, nor will I ever, that sarcasm and purposeful belittling have a place in this forum.

Actually, I thought I made it pretty clear when i said, "It's not like I want us to be approved tomorrow."
And what rebeccajo says is true : "Everyone wants a piece of it." Isn't it natural to feel that way when people ARE getting approved so quickly?

I guess they think it for the same reason that seems to be upsetting everyone...because a lot of cases DO seem to be getting approved in 30 days, as rebeccajo said.

If all that had been said was "OMG what the heck are you worried about," then I wouldn't be participating in this conversation. And I don't think that lending a little support is molly-coddling. That's the way I see it.

If you are a therapist, I'm sure you understand the concept of screaming outloud when something is beyond your control? Of that being somewhat 'thereaupeautic'? There are a lot of people who could use that these days when it comes to AOS.
Well yeah, rebeccajo, that's kind of my whole point. People complaining here doesn't bother me, even when they have applied relatively early. BUT....the question I guess I was posing is, is it really necessary to be purposely unkind to other to make one's self feel better?
I certainly agree that people who insinuate that they were approved quickly because their relationship, documentation, etc. are perfect is galling. But I didn't see anyone do that in this thread. And I don't think that VJers asking, "Is this normal?" or "I'm worried about this" is cause for a beat-down. I know everyone is human. I guess we all just need to cut each other a little slack (me included).

I know, rebeccajo, and really I don't fault anyone for that. It just bothers me when people (not you, BTW) seem to set out to make other feel small on this forum. We are supposed to be supporting each other. Sorry, but I can't help it, it's in my blood (I'm a therapist

I know that hearing complaining from those who have recently filed is irritating to those who have been waiting for a year or more, but this whole process is fraught with anxiety, it's natural to be worried, and I don't think there's anything wrong with people expressing that. Threads like this one also help people who have filed around the same time to compare their processes and alleviate some fears when they see that they're in the same boat. That's part of what VJ is all about right? Sarcasm is unkind and unnecessary.

ajmc, I wonder if we are already in Name Check Hell? I keep seeing all these others approved, including cases with my same DO. Makes me wonder.....We may be in for a long wait.

Despite having other seemingly necessary "qualifications' for a CSC transfer, we weren't transferred. I starting looking at Devilette's previous thread asking who hadn't been transferred, and I saw a lot of Russian beneficiaries. Are there any K1ers from Russia who did get a CSC transfer? Ultimately it doesn't matter, but I'm just trying to satisfy my curiousity as to why we weren't transferred when other K1ers with our same DO who filed at the same time were.
