  1. Hey guys, so the weirdest thing just happened.. I received packet 4, but i am the petitioner, not the beneficiary. I am so confused. There were 3 papers, and it had my Fiances name and my name and address on top, so I don't know what to think. Can I just photocopy the papers and email it to him so he can print it out and take it to pay at banco popular and get everything else?

    Also for the medical, if he decides to get the vaccines, does the medical office provide an extra copy for my fiance for the AOS process? will the consulate provide this, or how will this work. I'm not sure if I am making any sense. lol

    How does the paper for the medical look like? does this comes in packet 4? I didnt receive a separate page for the medical, will this be okay for him to take the 3 pages for his medical? and can he go any day he wants, or is it by appointment?

    I don't think it's weird at all, my fiancé in the US got the packet 4 in the mail as well, about the same time I got mine. Like Ilovemyman said, the interview letter is what your fiancé in the DR needs to go to the medical. Even when your fiancé can be there at 6.30am, he still can get there until 10am.. I went to the medical around 9.45am and was done by 11.20am, I actually left around 2pm but for another reason.

    In that packet, there should be an instructions paper and it will tell what your fiancé has to do, what documents he needs to gather and how much he has to pay, when and where. There are new changes in the US Embassy/Consulate in the DR protocol, so check those instructions. In doubt, call or email the embassy.

    I strongly recommend that your fiancé gets all the vaccines he needs in the DR/Consultorios de Visa. The day of the medical, he is going to get a CD with his x rays, and then, days later he will get the vaccination documentation worksheet, aka DS-3025 (he has to go back to the Consultorios de VIsa in person to pick the form). As a K1 he doesn't need to get a medical for the AOS, only send that form with the rest of the documents, but if he doesn't get the vaccines, then he will have to go to a civil surgeon to get the vaccine and sign the form and that can include additional costs.

  2. Thanks for the info. Glad domex is done! I had to go get the passport after 3 days of waiting and they didn't deliver it

    you know, I was done with the interview at the consulate around 12.20pm, but the line outside to pay for domex was long, the service was really slow, no where to sit, it was really hot and humid that day, no where to go, we spent about 3 and half hours there, and this was during the first week of the new US Embassy/Consulate building! Since I lived a few blocks away from domex's offices, I chose to pick up my packet myself....at least I got my passport less than 10 days later.

    Terrible service.

  3. You can take it to los consultorios de visa, but you can not have it with you. As soon as you get inside you will be given a key to a locker where you can put it safely. The phone must be off, the guards will ask ya this. Even being a couple of meters away from the phone, you cannot have it with you all the time, and be ready to spend a morning there...

    Also, if you are the petitioner, you don't have to go.

  4. For the I-765 would be 2 photos, the form, and I was recommended to send a copy of the I-94 and the passport bio and k1 visa page.

    For the I-864 I recommend you to read the instructions of that form, it needs the IRS information, and demonstrate that the income is above the poverty level 125%. ..and there are other recommendations. Just follow the instructions here http://www.uscis.gov/i-864

    Check this link from the US Embassy in DR, http://santodomingo.usembassy.gov/k1-k2_instructions.html it has the same instructions that the beneficiary will get in the mail.

    The police report, certificado de Buena conducta expires in 30 days, so make sure it is not due before or around the day of the interview.

    The DS-160 online, you need a digital copy of the 2x2 photos that you need to upload to complete that form. And yes, the 156K form has to be signed in front of the CO.

    You said you have an email copy? what email? I got my packet IV via email and its the same as the one you will get by Dominican postal service, I used that one for the medical exam at the consultorios de visa and for the bank. The Consultorios de visa recommend to do the medical 15 days before the day of the interview. Does the beneficiary has the actual interview letter?? it says the day and hour of the interview.

    The petioner has to fill out form I-134, and need to have on hand the W2, IRS, bank statements, etc (read the I-134 instructions), check the Visajourney's guides tab. Also more evidence since the application date to closer to the interview. Just in case.

    If you do not have the packet IV, either by email or Dominican postal service, call the US Embassy first thing Monday morning, and explain that you have a interview date but no packet IV.

  6. Wow,, I totally appreciate your information. Very educational. So happy I found someone who has attorneys in the family. Now I completely understand the situation. As long as we pay the attorney and get paper proof that it has been paid, he will be allowed to leave the country if the visa is approved of course?. Thanks again for the helpful info.?

  7. What power does an attorney has to stop the visa process? I do not know, but the attorney can stop him from traveling.

    Even if the loan problem does not become an issue and the visa gets approved, I know that some lawyers can get an "impedimento de salida" ...it is like a restriction to travel outside the DR, as a "medida de coercion" (don't know how to say that in English) very easy..a friend of mine was actually moving to Spain and the day she was leaving, she was stopped at the airport by the security, she couldn't travel that day. She found out that the restriction was related to a fender bender several months before, and it was even paid off. But the lawyers of the owner of the other car got the restriction during the process, and she didn't even know she had one...it took her two weeks to resolve the issue, and a new plane ticket.

    The problem is, that not always the restriction is lifted after the legal issue is done. There was a news report in the DR last year about the huge amount of still active "impedimentos" and that so many of the persons affected with it don't even know they have one until they try to leave the county either for vacation or work...and you know what? the "impedimento de salida" cost only $330 pesos, yes I think a judge has to approve it, but I know its a rather fast process....And it does not have to be a big criminal case, my friend got one because a traffic bender, and people can get it for not paying child support.

    What I am trying to say, your fiancé should find out if he has one, and if it he does, be sure it is legally lifted before traveling when his legal issue is resolved....I know all this because there are so many lawyers in my family.

  8. I read that the DS-157 is a supplemental form for males between 16-54(?) years old. I think he has to fill it out with the DS-156k.

    I got my packet via email and the DS-156k was attached...2-3 days later I got the packet via dom postal service and it didn't have the DS-156k, and the instructions said to fill out that form.

    Does your fiancé's instructions also say to fill out DS-156k as well?

    So, I'm flying tomorrow to LAX and basically have everything for my AOS/EAD/AP, bar my marriage certificate (obviously) and my I-94.

    What is the craic with the I-94 forms now? I don't recall having been given back an I-94 ever in the past -- although this could be me just not paying attention because I've never had to hang on to one before.

    Is it basically just the little tall, thin form you fill out on the plane before you arrive at immigration?

    Hello, the I-94 is electronic now, the CBP is not using the paper form since 2011 or 2012? anyway when you arrive, the CBP will scan your passport and the I-94 will be registered in their computer. Then you can access this information in this website https://i94.cbp.dhs.gov/I94/request.html . Just fill out a small form requesting your name and passport number, and you will be able to print it out.

    You will need a copy for the SSN, and the AOS/EAD/AP.

    Do I, the petitioner need to go to the medical appointment, or just my fiancee, the beneficiary?

    What J&N said....it may take up to 120 days to get an interview date, some are lucky and get it asap. I think the embassy had my case the first days of may and I got the confirmation of my interview on may 21, 30 days later. That gave my fiancé plenty of time to come with me for the interview. It is encouraged, but I do recommend you to be there as well.

  11. Only you fill the G325a, the US Citizen fills the affidavit of support.

    Yes, 2 photos for each application.

    Only one copy of marriage certificate for the I485.

    A copy of the I94 for each application, along with copies of the passport bio page and K1 visa.

    All the forms/applications are sent as one and then redirected to different places, so that's the reason for so many copies and photos.

    Follow the example forms for the AOS here in visajourney, it does helps. (look up in this page, the tab that says "example forms")..also read again the instructions of I485 form, you need other documents like birth certificate (translated in English) and NOA2.

    I am also doing the AOS, I just need to marry LOL

  12. Nope,. the interviews are schedule dby the US Embassy/Consulate.. when your case gets approved, and sent to the DR, they will send you a letter with the interview letter with the day and time, and instructions to follow (fees, birth certificate, etc).

    Take a day off to go the medical check up at the Consultorios de Visa with the interview letter, you don't have to make an appointment, but you have to go like 15 days before the day of the interview, then wait 3-5 days to pick up your results.

  13. Well you are applying for IR-1/CR-1 visa, so I don't know if it needs a fee or not. I thought you were applying for the K1 visa, but it was pointed out later that you were not. But it is a good thing that the US Embassy/Consulate replied to you with that info regardless. I am sure about the K1, $160+$15 Banco Popular, plus $80 at the consulate the day of the interview, now is $105. Maybe the process for your type of visa is different than those for K1, then your instructions should be different then. If you paid for the green card already, then you will get in the mail a couple of weeks after you arrive. That's great!
