Rj & Kristine reacted to dustyrah in AOS help and question
If you had no income at all last year, just show 2010-2012 tax returns. Because we are not required to file tax returns for 2013 until April 15th 2014. In some cases, people get an extension to file even later. And tax transcripts are not available immediately upon filing and take 8 to 10 weeks to obtain.
Also, you may want to look at any assets you can demonstrate to make up for the last year's income. Worst case scenario, just get your parents to do the co-sponsorship.

Ok. No income. Student. And, parents claimed you as dependent. Currently, you're earning an income. Most certainly, you will send in current pay stubs with your I-864 along with a letter of employment from your employer. Hopefully, your present income meets the guidelines for minumum income. Roughly, over $18K/yr. I think that there are others here who might be able to better address the tax filing while a student issue better than I can. You might want to consult with an immigration attorney (I usually don't make that recommendation) - just make sure that they understand that you are simply asking for a consultion regarding your affidavit of support. Most attorney's want to handle your complete case. Don't waste your time or money on that!!! Keep calling around and, eventually, you'll find one who will agree to that kind of consultation...for about $75 - $125.

Did you file 2013 tax returns? You have to submit either 1 year tax return or 3 years tax returns(you can include 2011 and 2013 to show good income history). If you have not already filed 2013 tax return, make sure you include all income and not just income from job.All of the income together should be over the poverty level and not just income through a job so try that angle.
Also, you can include current pay stubs to show you are earning well above the poverty level.

If you earned any income last year, you must file taxes. Even if you didn't - you could be entitled to a refund!!! You do need to show proof of income. Any income. Letters from an employer and a bank are required docs unless you work for yourself. Even so, you must file taxes and provide evidence of your income and ability to support.
Unless you're independently wealthy...and there are forms for that...you must provide proof of income and meet the minimum level. Otherwise, you will need a co-sponsor...and they will have to provide proof of income.
If you have no income, it is unlikely that, even with a co-sponsor, that your affidavit of support will be approved. You need to do a little more research on the subject.
A little more info as to how you can prove that you can provide support might be helpful to answer your question more concisely.

1. I put Single for mine because it does say spouse in a nonresident alien and NVC processed my case with no problem.
2. I just asked my insurance here at work about that. Each insurance carrier will have different rules, but they told me that once he is physically here in the states all I have to do is send a copy of his Visa to show he just got here so they can cover him. And this shouldn't have a negative impact because NVC shouldn't expect you to be paying extra for a person who doesn't even live with you yet.
3. Get return transcripts for 2013, 2012, and 2011. There should be no conflict.

Your claim status in company (W4) doesn't matter and doesn't effect/conflict in NVC. When you file AOS, the NVC rely on your tax return transcript or 1040/W2, nothing on W4

Be sure to spend much time reviewing and studying the wiki and information in the first post by Saylin, if you're not already familiar with what comes next

You can mail a correct form to them.
I had written the wrong last name for my spouse on the application. Took me 4 months to notice..I mailed them...and they corrected it

Rj & Kristine reacted to pushbrk in Hello! New member here.
Since you filed the I-130 "petition" (it is not a CR1 application) it is time to learn the rest of the process, where your spouse will actually "apply" for a visa, AFTER your "petition" is approved. The DS260 is the "visa application" used for the CR1 visa. Start learning the NVC process, so you'll be prepared for it.

Don't sweat it. I think many of us have made mistakes along the way on one form or other. If it is important enough, you will hear from them. I can not believe, despite my best efforts, the number of mistakes I made and never heard a thing about it.
