We just came back from abroad over the weekend and got surprised with my wife and daughter's approval letters

from VSC dated on 12/26/17. No RFEs.  Updating the list below to reflect the approval.

So we had bio meeting on Feb. 2, and I noticed that people who filed in October haven't been approved yet. I know one of the forms we received said that the green card is still valid for an extra year. 

 

However,  we are planning a trip to take our baby to meet my husbands parents but we probably won't have his green card in time. Morocco loves to treat people really bad who have green cards and sometimes won't let people leave because they don't believe the validity of their green cards. 

 

Is there something else that we could use while traveling that would show his green card is valid for another year. I am nervous that because the green card has the expiration date on it they won't care and not allow him to come back. 

 

Help please! 

Typically having the extension letter from USCIS should be sufficient to demonstrate that his green-card has been extended for one year from the expiration date on the card and should be accepted abroad as such while traveling and while trying to return to the US. Make sure to take the original letter and not a photo copy if you travel.  I am not really familiar with Morroco and how things work there so what I would suggest is for you to post another message on the Morroco country specific portal (http://www.visajourney.com/portals/index.php?country=Morocco)  and that way you may be able to get a better response to your inquiry about someone who is traveling from Morroco back to the US with an expired green-card and with an extension letter.  Maybe they can give you some advice and make you feel at ease if someone has experienced the same possible situation that you are talking about and that everything ended up well at the end.  I would also suggest to make an infopass appointment and try to speak with an immigration officer at your local office and see if they may be able to place a stamp on his passport to show the extension of his card. I don't know if they will do that, but it is worth a try.  I really wish you good luck!

I have had friends who arrived over the weekend and did not experience any problems when passing immigration. That being said, they came from South America and from countries were the new temporary immigration ban is not affecting them. I think it is a personal decision to travel or not, and if you do make sure to bring all documents needed to get back in like the extension letter and your green card. US citizens and residents are not being affected by the temporary ban. "The Department of Homeland Security said it would no longer bar green-card holders from those countries from entering the United States."

I don't think is the date you write on the cover letter or the I-751 form because mine was dated a few dates before, but I think it is stamp at the post office/the date it is mailed. Hope this helps!

Only thing it was on my head I wanted to be on time and I sent it out 3 days before, I thought it would be okay, it was no too early.  Can I use the same money order? 

Ah okay, yes you can resend the same package, but maybe just get a new check like gaia12 suggested.  I understand you wanted to make sure you send it quickly to get there on time, but It seems that what it matters to USCIS is the mailing date and it should not be before the 90th day. I am so sorry. It seems like you sent the package too early and that is why it got returned. Are there any instructions from USCIS?

I mailed my package to Vermont on Thursday the 12th, they received it on Friday the 13th, and my check just got cashed today Thursday the 19th (6 days later).  I still have not receive a NOA1 so just give it a few days, it will come to you too. Just be patient :-) Good luck!

I am an American Citizen (I was born here, parents were born here, grandparents were born here, everyone was born here) I am currently engaged and pregnant by a Nicaraguan man. He is in deportation proceedings but his judge granted him voluntary departure under safe gaurd last week. I will then go to Nicaragua to marry him then start my petition.

He was living here unlawfully for more than 1 year & less than 2 years! I understand that he will be subject to a 10 year bar when he goes to the Visa Interview (I was hoping he wouldn't). Once I file the I-130 petition I want to then file the I-129 for a K-3 visa. I know he won't be back in time to see the birth of our daughter but I just wanted advise on whether or not he will be eligible for a K-3 visa after voluntary departure and after being in the US for more than 1 year. Can I send the waiver request WITH the K-3 (I-129) request. Or is the K-3 visa out? Will he need the unlawful presence waiver for a k-3 visa??? Please help me. I have many other questions also...

If the RFE letter does not arrive before you leave, just have a family member or a friend check your mail box and read it to you or scan it and send it to you via email. Maybe you can work on the RFE while you are visiting or wait until your return from your trip. You will have plenty time to respond. I don't see a reason why you should cancel your trip if you are only going to be away for two weeks. You should be okay. Good luck!

Considering a K3 visa costs twice as much as a CR1 and has half the benefits, how is someone lucky to get one? There are very few cases in which I see a K3 (and K4) being a desirable visa for anyone.

Looking at your timeline, it still took 10 months for your spouse and their child to arrive in the USA and then they still had to adjust their status to get a green card. That took another 3 months and could have taken more. Plus there were two interviews and an RFE.

My entire journey from sending the petition to hard copy green card in my hand was exactly 9 months. It only took 8 to get to the USA.

No RFE and only the single interview.

I think there is nothing wrong for the OP to file the I129f after he filed the I130 in hopes of getting the I129f approved first and be able to get a k3 visa, I did that and my wife and daughter were approved on Sept 2014 eventhough many people here on VJ said the k3 was obsolete back then too. I was one of the lucky ones... I believe it is a personal choice to pursuit the k3. OP, be thankful if you get it, but keep in mind that it may not happen. Good luck OP!

Yes, just like in Spain, the US recognizes you as being married therefore the petition should be filed as married.

Thank you for your response! If you don't mind me asking, how was your wife able to pick up her visa without the 'tracking' number that the Embassy is supposed to send you? We have tried calling the DHL several times, but they say that we must await the Embassy's response. I've checked that website you mentioned as well, in fact I have it bookmarked, so I can check it every day, just in case!

I am sorry but I can recall well if it was with the number or not. I only remember calling DHL at the Jockey location and were able to tell me that they had a pacakge for her. It is good you have the link, but I would recommend still email the embassy again. It is strange they are not very responsive :-(

Got it. Thanks guys. I called back this morning and acted completely oblivious to the whole process (not totally an act, btw) and I actually got the rep to tell me it will be in AP until the I-130 gets a #, then it will join the I-130 and close out, reiterating what you all said =( Very disheartening especially considering this won't get approved before my deployment, so hopefully I can request an expedite, only the rep said I can't do THAT until the I-130 gets a number! UGH!

My wife attended her visa interview on the 21st of May for her immigrant visa. That very morning we were approved and given a piece of paper stating such. As we are here in Peru, we were required to create a DHL account for our visa to be delivered to. We did this before the interview. We are now on the fourth of June and so far our case status has not changed, nor have we received an email stating that my wife's visa is available for pick-up from the DHL. They are supposed to give us a tracking number which we need in order to pick up the visa. We've tried calling the embassy, but they tell us to submit our inquiry via email, which I've done. However, it's been nearly a week now and they haven't responded to my email either. Our status was last updated on June second, but our status remains 'Ready for the interview'. Can anyone shed any light as to what the hold-up might be or any way we can speed it up?

It usually takes about a week or so to process your paper work and get the visa sent to DHL. It is not uncommon that it can take longer than that so maybe you can try to reach the DHL office. I did not received an update either from the embassy and did not see it until after my wife pick it up from DHL.

I would recommend to call the DHL office you assigned and ask if they have a package ready for your wife. Maybe they already have it. As I found out when I call is that even though the package is pick up at the embassy it does not go straight to the dhl office you selected, it goes first to the distribution center (I believe in Callao) and then gets routed to the location. DHL are the ones who update the tracking of the document on the usa-visa website for tracking. Have you check there? https://ais.usvisa-info.com/es-pe/iv/users/sign_in/iv

Would anyone PLEASE help me understand the real deal with the K-3 process, or lack there-of. Post a link to a forum I missed, supplemental website, anything, because I have combed this website's links, forums, timelines, etc for a better understanding and I feel like I am being turned in circles!

I keep reading that the K-3 is obsolete and no longer being processed? if this is true, why are they even accepting/approving petitions for them to begin with? How is everyone coming to this conclusion?

My situation: I filed both the I-130 and I-129f (K3) for my husband in March and April respectively. Both were approved on the same day, May 19th after I requested the I-130 to be expedited due to a short notice deployment tasker. (I only requested the I-130 be expedited, and they both were approved the same day, maybe they were just processed together?) Anyway, USCIS sent both cases to NVC on the same day, May 27. Now, As of this moment, the NVC still does not have my I-130 case, but according to a supervisor I was transferred to, they received the I-129f case on 27 March, she gave me the case#, the IID#, and said the NVC was reviewing it to be sent to the consulate. She told me I would get instructions from the consulate on what to do next.

BUT...according to what everyone is saying here, the K3 case will be closed and the I-130f will be processed as normal (which I know and expect will happen anyway, but I filed the K3 for a reason). So because I have a case#, does this mean they will process it, or does that mean nothing?

And if they DO process it, what is the average processing time for the K3 visa to be issued? Because I can't seem to find that ANYWHERE either. Any help would be great. It's bad enough to be stuck out in the middle of the ocean far away from any and everyone I know and love for years at a time. The least the government can do is let me be with my husband.

My wife came on K3 and daughter on K4 September 2014 so I can talk by experience. Yes, most commonly the i-129f would get administrative closed, if both the I-130 and I-129f are received at the same time by NVC. My I-129f was received and processed first and case assigned and was sent to the embassy within a week after got case number. If you have a case number for it, you may be in luck. I will say call again to confirm and track down the case number as it may reach the embassy before the I130 gets a case assigned as it usually takes a month at NVC. You can see my timeline as my wife entered the US on a K3 last September 2014. I was not the only person. There were three other I followed who got K3s approved. As many will say is not common, but it happens. If you want to proceed with the K3 and want to get your spouse sooner you can, but know that if you do your spouse has to do AOS in the States and spend another $1070 to get the green card and get interviewed again.

In any case, verify again with NVC and also you can track the process of your case on the ceac website.

If you case shows as in transit it means it has not reached the embassy, if it says ready it has reach it.
