Thank you Georgia16, I assume I only have to pay one $595 fee for the form and 3-$85 fees for the Biometrics?
GBOS what is a LPR? Forgive me for not knowing what this is.
Also, my stepdaughter is 24 years old and my stepson is 19 years old, can they still file for ROC on their mother's I-751 even if they are adults under the law?

Hi All,
I tried to search this question but what came up in the search did not make it clear to me. My question is, do I fill out one I-751 Form for my wife and stepchildren, or do I need to fill out an I-751 form for each one of them like I did for their AOS? Also, my stepdaughter received her green card about two weeks before my wife and stepson did, so here expiration date is two weeks before the others. Does this affect anything?

I completely misread the OP's post. My bad. 180 days does not add up to a year, duh.. Please disregard.
It has been more than a year for my wife and step daughter, the 180 days is something I read about getting advanced parole that they may not be able to get it, so if they can't get it I don't want to waste my time filling out a form that will be useless.

Thank you for all the help you have given in the past, but my question is that now that I am ready to file my AOS for my wife and two step children should I file for a I-131? My wife and step daughter will have been here over 180 days out of status, so is it a waste of time for me to file that form?

First I want to say thank you for this forum, second I want to apologize to the administrators and forum Nazis' if this question annoy's you. I have searched thru VisaJouney, used it's search engine, used google's search engine on this topic but I am still a bit confused on this matter.
I am getting ready to file for AOS on my wife, step daughter, and step son. The I-485 form as a spot that where my wife would identify her children, next to that spot is a check box that says are they applying with you? Do I only need to fill out one I-485 form for all of them or do they each need to fill out separate forms? (the children are 20 years old and 17 years old). If only one form is needed do I only need to pay the $985 filing fee plus 3 x $85 for the biometrics, or is it $985 and $85 dollars for each of them?

I used binder clips, they suggest it on the USCIS instructions. I also included a cover page that broke each section down and that is the way I clipped each section together, then I held them all together with a larger binder clip.

I only included one of intent letter from me but I did not include one for the beneficiary. this may be they need one from her since I did not include both.
You need to submit a letter from her also, that is what the problem is. Just send in her letter of intent with her original signature and you should be good.

My fiance received her email packets from the Embassy in Bogota and it says that they recieved her approved K-1 and gave her information on how to make and appointment. My question is that in the information they sent her it states that she has up to a year to make and appointment. But my concern is on my I-797 NOA2 it states that it expires on 05/29/2015. Does she have a year to make and appointment or does her appointment and visa have to be done before 05/29/2015?

I called on a Friday evening and was very successful in getting through, but it took 75 minutes before I spoke to a rep.
Yeah it's a good idea to have some refreshments and a sammich or two with you because you are going to wait for a long while before a human picks up the line on the other end.

I received a text for the NOA1 but nothing electronic for the NOA2. I found out on the USCIS website and two days later the official notice came in the mail.

I finally got a hold of them yesterday after two days it only took a few hundred calls to get through. The lady asked me when I received my NOA2 and I told her January 30th and she scoffed and said it will take 5-7 weeks before they see it. I have a bluetooth ear piece for my phone so it is easier to make the several hundred calls to them, just hit the recall button on the earpiece. Good luck, let me know if you get through and what they say.

First I am sorry this is happening to you but you are being manipulated. Whether is was rape or not, where was the baby when you visited, why did she not tell you sooner. These are not red flags this are SCREAMING RED FLAGS! I was in a situation with a live in girlfriend once and had to get a lawyer and evict her. The problems that fallowed put me through hell, please listen to your lawyer and do not talk to her without taping or videoing your conversations because when it comes to the police, they will most likely take the side of the person who calls first. I would file a PPO on the so called brother then I would serve you wife with an eviction notice. If California is like Michigan it may take 30 days to get her out. If it does take 30 days you need to leave the house and stay away from her, she will cause you much trouble. I wish you the best of luck my friend but you need to take care of this ASAP!

No, not illegal, just out of status. Once you marry within the 90 days, you've met the requirement. The time period between the marriage and approval of AOS you are out of status, not illegal. A copy of the AOS filing can be used as proof
Ah, Thank you that is what I needed to know. I believe somewhere I read that you should not wait to long to get married when your fiance arrived as the government needs time to make the adjustment of status to the visa. If I can find where I read that I will post it.

I believe he is worried about the lapse in time from when he sends his paperwork in for AOS and for the government record it and send him the information back that she is ok to stay in the USA until further notice. If it takes the government two weeks to record the marriage and the aos and he got married on the 90th day, it would mean his wife in in the country two weeks illegally.
So the question is how long after you are married does it take to get the AOS?

All the petitioner needs to include on the I-129F petition form is the names of the beneficiary's children. Benficiary may bring children under a K2 Visa. The children automatically qualify fro the K2 visa as derivitive status of their mom's K1/K3 status (you need only petition for your fiance/wife and list the children)
Thank you, I do understand that, but my question is do I have to send a passport photo of her children? They tell me I have to send her photo but say nothing about her children. I know I am probably reading to much into the documentation but the government is pretty unforgiving for missing something.

I have a question about sending the passport photos in for the form I-129F. It states that I should send my own passport photo and a photo of my fiance, this I understand. But here is my question, my fiance's daughter will be coming with her on her visa (if approved), do I need to send a passport photo of my fiance's daughter?

Hi All,
I am starting to fill out the I-129F petition and where is says to list her children is where I am stuck. My fiance has two children one who is 18 years old and another who is 15 years old. The 18 year old will be traveling with her mother to come the USA when the visa is approved. However the 15 year old will not because the father does not want him to go. When the 15 year comes of age we want to bring him to the USA.
Here is my questions,
1.) on the I-129F petition do I list both here children and pay for all of them even if it may be more than a year before he can make the journey?
2.) if he is given a K-2 visa and it goes past the expiration date will there be problems when applying for a visa in the future?

I am meeting with both of them tonight, I will let you know what they say (I believe that there was some problems with there applications). Also I want to Thank everyone for their responses it has helped me understand that my assumptions were correct and elevated much of my concerns.

Hi All,
I am new here and have been reading some post and I read http://www.visajourney.com/forums/topic/484680-how-well-did-you-adjust/ is has depressed me because I see that many have not adjusted well and are very sad living in the USA. It frightens me because my fiance is from Colombia and would be moving to the Metro Detroit area, and it is the opposite of everything she is accustomed to. I do not want to see her sad it would devastate me, I was wondering if there is anyone who found positives by coming here to America?

A year or less from I-129F petition to visa approval is average. Check out people's timelines here for K-1 visas. Not sure why it took your friend 3 years.
You can use the guides here on VJ and ask questions when stuck on something, if you choose not to pay a lawyer to fill out forms for you with the info you need to provide for them anyway.
I read on the site here that it is about a year for a K-1 visa but because I do not know the language yet or k-1, I-29F, K-2, etc., so I was not sure if I was reading it correctly. I will wait any amount of time to be with her and if need be move there, but the U.S. is more financially promising. I have searched on the site here but as I stated I do not understand all the jargon and do not understand how to read the timelines. I suppose that I just want some validation for thinking that if everything is filed correctly and all conditions are met that we should be together in about a year?

How Best To File Two Separate I-751 Forms?

I am getting ready to file for ROC for my wife and stepchildren next month and I was told because my daughter was 24 years of age now that she would have to file her own I-751 form.
Thanks again for all your help with this and I know that some of these questions are stupid but one thing is wrong the government will stop the process.
