    Hello all. I just wanted to give a little updated since it will be 1 year since my husband came to the states. I petitioned my husband then fiancé on March 2013 and our petition got approve July 2013 (4 months). The whole month of August we prepared for his medical, CFO and interview. We schedule his interview August 20, 2013 but unfortunately it got cancelled because of the rain so USEM told all the people that had interviews that day to come back August 26, 2013 and again it got cancelled because of the rally for the pork barrel, we didn't know what to do since USEM was being difficult about giving information out so my husband decided to do a walk-in interview the following day August 27, 2013 and luckily he was able to get interviewed. I was very nervous about what was going to happen since I was not able to be there for his interview...I could not sleep until he texted me to say he was APPROVED. After about a week or so his visa arrived and he picked up at 2Go MOA and then went to the CFO to get his sticker.. we booked his ticket as soon as he got his visa on hand and September 23, 2013 he arrived in New York (JFK). That Thursday after his arrival we went to the city hall where we live to get our marriage license and the following week we picked up our marriage license and called the courthouse to schedule a date for our marriage. October 8, 2013 we got married and 1 month later we filed for his AOS we mailed it on November 2, 2013... 1 month later he was schedule to do his biometrics (December 11) so we waited to see when his EAD/AP would arrive and luckily after a month January 6, 2014 his EAD/AP arrived in the mail. Once he got his EAD he started looking for a job and was able to land a couple of interviews but no luck since he had no local experience yet. January 22 a tragedy happened, my husband's grandmother died and my hubby wanted to go home to the Philippines for the funeral but unfortunately my parents and his aunt got scared that if he goes to the Philippines just with the AP and without the GC he may not be able to come back so he was very sad he wasn't there for his grandmother's funeral. March 2014 our very nice neighbor helped him get a job at a local Popeyes near where we live. We received a letter from USCIS on February 2014 saying that our interview was going to be waived and that we had to wait 6 months to get his green card but luckily his GC arrived on April 2014. After working at Popeyes for 5 month he landed a job at the hospital near our house (walking distance...YAY) ...btw my hubby is a nursing graduate from PI but unfortunately he did not pass his nursing license in the PI. We actually had a struggle and battle of him not becoming a RN in the Philippines since my family were judging him that he won't be able to give me the good life I deserve because he isn't a RN but with hard work and determination he proved my family wrong that even though he isn't a RN he is lucky enough to find a job in the hospital and hopefully next year he will get his nursing license to become a RN.

    For all those that are going through challenges DON'T GIVE...LISTEN TO YOUR HEART & FOLLOW IT. Also take one step at a time and everything you want will eventually come to you. Don't worry all the waiting from the time of petition to when your love one comes to the states is all WORTH it :)

  2. Over the time I have been a member of this community I have learned that each group of filers for VISAs have a specific set of problems to deal with. The most common link for all is wait times. I feel tremendous sadness when I read posts for couples already married (especially those with children) that tell of such long aggrevating waiting periods. I can't imagine the frustations associated with this terrible process when you are already in a legitimate married status. And those with children so compounded. Our prays are with you! I think that those recommending that your wife find things to do that can help pass the days are giving you the best advice. I can tell you that just trying to keep her calm with words of love and solice is probably not going to work at this point. My fiance was constantly busy in his home country with family, business adventures, and hobbies during our wait time. As much as we want to be together the last phase of the Visa process was so quick it took us by surprise. In affect we came off the hurry up and wait list to move your @#$@$ very quickly list. He has to finish up his business contracts, sell off those things he no longer needs, as well as many other things. I hope you encourage your wife to find some constructive outlets for her time. Perhaps she could plan a party for going away, or make plans for a celebration at her arrival. She could research her new home City in the USA and find out what opportunities are available for her here. Perhaps an online course or support community to help her talk about the things she will be doing once she arrives. There are many things that someone can do. Pay attention to what she wants. Send her flowers or whatever may be appropriate for her culture to remind her that you are thinking of her. Make a list of her needs and wants once she has arrived and start collecting the items to show her on face time or skype. Just be patient because before you know it the process will be over and she will be here.

    I am trying to get an immigrant visa for my wife who is from Korea. We are at the final step of waiting for the NVC to look through our civil documents before she can get the interview, but it has been taking them far too long! We have been waiting for the past couple months only to get an email from them stating that it's going to take 60 days rather than the usual 30 days. I am here in California about to start graduate school and my wife is still in Korea doing nothing but waiting for the NVC to give the clear for her interview date for the past month. She's getting really, really impatient to the point where she could go insane and I don't know what to do or say to her. I've tried to calm her and tell her that we're almost finished (for the past month) only for it to fall on deaf ears. We're both very miserable, and the NVC call center just tells us that they're backed up and that there's nothing they can do about it. Has or is anyone in this situation? Who else can I get help from? What questions should I ask when I talk to NVC? Can she come to California and somehow finish it here? ( -_-)'

    If anyone can help this distress post, it would be of great help.

    I am originaly from Wisconsin growing up in the vast expanse of farmland only about an hour away from Waterloo. I lived there 38 years. After meeting someone online and having a long distance relationship visiting back and forth for over a year, I decided to move away from my home to live with him in City of about 600,000 on the East coast. I have never been a farm boy and new that life could be better for me in a larger city. Shortly after arriving in my new home I regretted my decision immediately. I didn't like the crazy traffic and complicated lifestyle associated with living in a big city. I felt alone and totally ill at ease with my new surroundings. To make things worse I discovered my partner had been dishonest with me about many things. But being from a wholesome family with good ole midwestern values I believed that I could make things work. Ha! After banging my head against the wall trying to make things work for 5 years I finally left the crazy person and found a place by myself. I discovered a whole new world I didn't know existed. I never expected to enjoy the city that I had found so distastful in the beginning. I stayed in Baltimore and found that indeed I loved City life. Since leaving my partner 8 years ago I have traveled to many places and find City life the best. Nothing is ever wonderful in the beginning but over time I discovered that I really enjoyed the options available to me in a larger metropolis.

    That being said, I would never have believed that in the beginning. Living in Wisconsin was a wonderful life too! I had family around me and loved the beauty of rolling hills and changing landscapes. Traveling from place to place without traffic clogging the roads and being able to be in a city in less time then most commutes on the East Coast was great. People are much friendlier and there is far less stress than you can imagine. Not to mention being able to sleep a whole night through without one siren going off. There is always farmers selling their fresh produce in the summer. You will find people that will talk with you and be geniunely interested in you. And you will not be far from Milwaukee. Lots to see and do there even in the winter. I love my home state. Just not easy for me to go back. I hope this helps you.

    thank you all guys... As someone said, i still have time to think things better until december. Maybe during this time i can decide what to do, or find a way to keep myself busy there. As i said, i would work as illegal in the farms, i dont mind doing that, even if my fiance doesnt like the idea.

    I feel better now, i dont feel like choking myself as a while before.

  4. Lol. Seemed like it. We also sent. (as recommended by a good friend that works for a very old respected law firm in our city) a complete duplicate copy of everything with a special note attached as duplicate copy. I wasn't taking a chance that someone would find it overwhelming to copy everything if that was necessary. Our packet was about 1 1/2 to 2 inches thick. basically laying things out so that the information was easy to read and chronological. Of course supplying evidence of meeting in the last 2 years first and then working backwards. It seemed to have worked.

    8 years of evidence ? did you send your I-129F in a BOX instead of an envelope ? lol

  5. It's amazing how many people do things differently. I think printing your 4 X 6 photos on plain paper leaving enough room to add a description with Names, Date, Time, Place is probably adequate. Personally I was a basket case doing this packet making sure everything was perfect. So much advice from lots of people. Our documents were organized exactly as suggested in both VJ website and USCIS requirements. We put everything together with ACCO clips. Our photos were labeled on the back placed in plastic laminate pouches (that could be 2 hole punched) for including in the packet. Addtionally we placed labels with the same information on the front of the pouches. Each trip was clearly separated with documents and photos in the same section. We created cover letter with an index and those sticky tabs on the bottom of separation pages (trying to simulate the index of an exhibit used by attorneys) to identify the placement of documents and evidence so everything could be found quickly.We had no RFEs and the CO at the embassy said that they were 1,000% sure of our relationship. No problems at all. I guess it helps to have 8 years of evidence for a relationship.

    How do we attach proof with pics to the I-129F packet ?

    I ask because the pictures are like 4"x6" and I have about 20 or should we add more or less ?

    do we attach the pics to a 8x11 paper ? and also write on the paper where the pic was taken from ? or which one is preferred ?

  6. This is the very best advice. Never trust that someone answering a phone could or would take the appropriate actions to eliminate you from a jury pool list. From my experience you will most likely never be removed and will continue to get these notices as long as you live in the USA. The clerks office is overwhelmed everyday by numerous pending cases. If you ever have to appear in court just look at the pile of papers public defenders have when they appear before the judge.

    I work in the court system. (Prosecutors) Trust me. Unless you want to take a chance at a bench warrant being issued for contempt of court you should appear IN PERSON at the proper place at the proper time with the letter in hand as well as your LPR card and other identification. I would NEVER trust calling the court and hoping that the person I talked to really took proper action to see that I was in fact excused. I would go IN PERSON. The court clerk will want to see your green card and probably at least one other ID (drivers license?) I would also bring my passport along just in case. You can never be too careful. Specially when you have an ROC pending. Be safe. And don't forget to get your jury duty fee for appearing as ordered.

  7. If you can find someone that can officate at a ceremony with no set date in mind then I would ask them to write a letter. We were fortunate enough to have a great person that understood our circumstances that was willing to sign an affidavit that he would be officiating. Since we are being married in someone's home the host was also willing to sign an affidavit. We were very lucky to have great friends and found a great minister. Thankfully now we are through the Visa Process and the wedding is set and plans completed. I wish you the best of luck.

    I have been wary and worried since reading this (in a legitimate source) since I also know people who have made plans and lost money, time, and hope when they didn't receive their visa according to plan.

    Logically, setting plans for ANY kind of marriage (great point, LionessDeon) without having any guarantee of a timeline makes no sense. However, there are so many caveats in this process it is helpful to hear what you are doing/have done successfully!

    I agree with Harpa. Attorneys involved in immigration should have total understanding of all immigration procedures. Researching your options before making any move is the most important thing anyone can do for themselves. Hiring an attorney doesn't guarantee you will be given all the answers. I find it difficult to understand that your attorney would not have known about AP and advised against leaving until you received it. Perhaps it is easier to understand when one does the process on your own without an attorney. Never the less, everyone should familiarize themselves with all the documents instead of accepting the word of someone not personally involved in the process.

    I do simpathize with you as we are a gay couple, but as Harpa said we now must be endure all the same treatment that straight couples have always endured. I truly believe there are just unpleasant people that no matter who they are interviewing will make the experience miserable. My hope for you is that someone in the government will see the honest mistake you made and push your case through. My fiance's only interview, thus far, has been with the Embassy CO. He was so pleasant and helpful to him I can hardly imagine a better experience. After hearing your story, it does make me wonder how our AOS interview will go. No one deserves to be treated like a criminal. Especially if you are already married and living aboard for several years. My simpathies are always with the married couples with children waiting it seems for an eternity for someone to approve their visas.

    You think it is discrimination but I think that you want to see it. All couples must prove that their relationships are real, and Tunisia is a high-fraud country. Many straight couples have been grilled and tested, and sent for multiple interviews. It can happen. That is the thing with equality; now it can happen to you too.

    Leaving without an AP automatically cancels the application. It states it very clearly on the NOA1s for the I-485. You should fire your attorney for not telling you this. Good luck.

  9. I believe that they also require relatively current financial information. Like a letter from your employer as well as current paystubs. Unless your petition is processed very quickly a great deal of the information you sent will be out dated. You may even have filed your 2014 tax return before your case is approved and reaches the embassy for the interview. I would fill out a new one much closer to the interview date and send the completed form with supporting documents fed ex to your fiance.

  10. Please read your instructions for the embassy or consulate in your country for the K1 Visa. In some countries you don't pay until the day of the interview and at the Embassy. The immigrant Visa CEAC tracker may only say Ready through the day of the interview and even beyond. Ours said Ready forever. Then after the interview it went to Administrative Processing then Issued. Most often these websites are not updated with any kind of regularity. If you are concerned at all email your embassy with the instructions from the State Department.

  12. So much luck to the both of you! Our interview is today also. He just arrived at the embassy. Peruvians are so predictable! Always, Always everything at the very last minute. His interview is scheduled a 8:45 am. It is 8:26 am in Peru and he arrived only 5 minutes ago! I am ready to jump through my skin. So I know how you feel exactly.

    My honey's interview is in a little over 2 hours in Cairo. Feeling so many emotions right now.

    It seems that no matter how well you plan your journey someone else can mess it up for you. I have been trying to understand how so many agencies can make such a mess over something so simple. My job involves talking to many different type of people doing many different types of things all the time. It never ceases to amaze me when I have to interact wi th a government agency and the only response I get is, "Well it just doesn't work that way". The best is when they just repeat themselves because that is what is written on the screen in front of them. I could tell you stories. I hope someone can give you answers. My fiance and I are headed into the interview stage at the embassy. I can't imagine how they will mess up the next few stages of the process but just not looking forward to seeing idiots walk around in circles. Oh wait I am insulting the idiots. Sorry!

  14. For those still waiting look at our timeline. God Bless you and just keep the faith. We waited 7 months and 20 days for a response for our NOA2. We are now in the interview stage at the US Embassy in Peru. Our interview is scheduled for August 11. Today was the medical all went well. The Clinic promised us the results by August 8th so we are good to go. I know this is torture to experience such a long period of waiting but in time you will be approved and then watch out it goes very fast.

    Ok, first of all, I would like to say, this is RIDICULOUS!. I filed for my fiancé back in March 2014, every months we felt like the NOA2 is coming soon, well. it has been 5 months and still counting, no NOA2. The worst part is, others filed after us and they have been approved. Another, the processing times states Dec 17, 2013, like SERIOUSLY.

    I contacted the Texas senates, both Cruz and Cronyn or wateva, they telling me what I had already know. Nevertheless, my question,

    how long do we have to wait to get this process done. this should have been a quick and faster process. I even did info pass, nothing forth coming. I am tired of late crying, solo acting in the house, everything. If I had known, I could have gone and did the spouse since that is 5 months process.

    Anyone feeling the same issue I am experiencing. Well since the senates cant do much neither can the infopass B.S.

    any tips, ideas, anyone.

  15. If you are using the income of other family members living in the same house as you live in then you must include them in your family's household size. They only issue is if your combined family income is great enough to meet the 125% of the proverty level of all the people living in the household. You have to include yourself, financee, father, and brother.

    Do you all live in the same household? That's the only way to combine incomes.

  16. Gurken Salat please check out this site for DC http://doh.dc.gov/service/birth-certificates You can do online requests through a service that is provided on the website.

    What they are asking for is an official certified copy. Sometimes "original" birth certificates are really not certified copies. I was born in the 1962 what my parents received was not a certified copy but a simple copy from the doctor's office of his record of live birth and a fancier card type with a seal from the hospital. Neither of these qualifies as an original certified copy from the state. You can order as many of these as you want. Just make sure you have enough for the numerous occasions you will be asked for them.

    Hey everyone!

    Our interview is scheduled for August 27th and we're putting the checklist (and extras) together. I was wondering, how strict are they about original documents? My husband's original birth certificate is on the East Coast in his parents' safe deposit box. They sent us a scanned copy of it via email, which we can just print out and bring. They are somewhat reluctant to send the original document by mail (we'd do FedEx for sure, so it's not a big deal, just costs $$)

    Would it be a big risk to show up with the printed copy and explain the situation? Or must it be the original? He has his passport here, and we're obviously going to bring EVERYTHING we have.

  17. The K1 Visa process will go much faster at this point. Although I have read some tragic posts of people waiting months for NVC to process and some still waiting for interviews. I was almost thrown aback by the notifications we received one right after another from USCIS and NVC. I can tell you the embassies do not seem to notify very well. This is how ours went. We received a text message from USCIS our case had been updated on 6/11/ 2014. We received an email at the same time with details we then checked the USCIS website. We were approved. On 6/17/2014 we received another text message from USCIS that our case had been updated again. Email stated that our case was sent to NVC. We received a hard copy of the NOA2 a week or so after the 17th. As far as calling the NVC you just need redial the number repeatedly until you get through. Eventually they will answer and put you on hold about 30 minutes or so. Wait for the person to answer they will be much more pleasant then the people at the USCIS. They will give you a time frame for processing at NVC. Call back after the date and you will get a case number. I believe I called on July 1, 2014 and they told me NVC received the petition on 6/26/2014. They assigned a case number the same day and shipped the case to the Embassy on 7/1/2014 the same day I called. We got a hard copy from the NVC concerning our assigned case on 7/7/2014. Checked the delivery of the case file on DHL as described in VJ. Our case was actually received at the embassy on 7/3/2014 but the embassy acknowledged receipt on 7/8/2014. When you get your case number from NVC you can check the status on CEAC for Delivery. When it says ready that means the embassy acknowledges receipt. You can email them right away as I did only to be told that we would receive notification via mail for our interview. Please Please don't believe them. 2 weeks later email them again letting them know that you ask for the information 2 weeks ago and have yet to receive a letter. Ask for an electronic version of the documents including a copy of the letter for the interview. After emailing them on 7/23/2014 they sent us an electronic version the very same day. We have yet to receive our hard copies in the mail and have a confirmed interview date from the embassy via email on 8/11/2014. Your fiancee will have to go back to gather all the required documents for the US consulate in her native country. Not all are the same. I hope this helps you make some good decisions.

    We got the NOA2 approved notification one week ago. But I do have a question regarding this approval. My fiancee is currently with me here in the United States. She is visiting for one more month with her tourist Visa. I know the next step is the interview in her country, but I am not sure weather she being here can cause any issue. I mean, I am not sure if the consulate will be sending her a mail notification or will call her to schedule the interview and all do the medical process within the month of July.August. I tried calling Immigration Services and they told me they are no handling the case anymore, so I call the National Visa Center but apparently it is always a busy line. She is from Colombia, by the way.

  18. Wow! All I can say is Wow! Well no I can say more, but WOW! You have our simpathies. I think you should take some time to really consider the long term affects this type of relationship will have on your soul. Be careful not to make matters more complicated. (a pregnancy for instance). May all the Gods of all the religions of all the Universe have mercy on you. Fiance's brother is going through a divorce with a woman just as you are describing except he has children. NOT PRETTY to watch. And again, WOW!

  19. We have had the same experience in terms of negativity. As the USC trying to bring my fiancé to the USA I was shocked! Most people reacted so badly that I felt as those they felt I was committing some heinous crime. I know my fiancé has gone through similar issues with his friends and family. I have known my fiancé almost 8 years. It was a challenge for us in many ways. But we simply made a commitment to each other and decided to move on with our lives together. We are in the interview stage at the US Embassy waiting for an appointment date. And at this point found the support of new friends and changed the minds of some of the others. Fortunately my family has met my fiancé and truly likes him. They feel much more confident in our relationship and are comfortable talking to him through messaging, Skype, and phone conversations. I feel that people are now less concerned for our decision to be together then they are about the government process. They worry for My fiancé as he is getting ready for the interview and hope the Embassy grants the Visa. Some people will always be negative and will always find reasons for you not to come. This decision is not for the faint of heart as the process is terribly slow and agonizing. But if you truly love your fiancée then who cares what others think? Be matter of fact and start forming alliances with supportive people.

  20. Yes I called. My Congressman's office had an immigration liaison that I spoke with on the phone. She asked for some information that sounded reasonable for for making the inquiry. It took about a week for a formal letter, but she emailed me right away after speaking to her on the phone. We received a formal letter on May 5th, 2014 indicated a request for assistance and then the response on May 19th, 2014 from the Congressman's office letting us know that USCIS would be taking some action in 30 to 45 days. We got a text message on June 11th, 2014 at 8:45pm telling us our case was updated and to check the USCIS website for the update. And there it stated we were approved. Later a hard copy of the NOA2 was received. On June 17th, 2014 at 9:00pm were given a second text telling us of another update. The website said that USCIS sent the case onto the National Visa Center. A case number was assigned on June 26th, 2014. On July 1st, 2014 our case was mailed to the Embassy in Lima. We received a hard copy from the NVC confirming our assigned case number and mailing of the packet to the Embassy. According to information available through DHL we knew our case was received on July 3, 2014. Embassy acknowledged receipt as of July 8, 2014. NVC case status reported READY on the 8th. Emailed the Embassy on got an almost immediate reply from a person the same day confirming receipt.

    Giving you all this information so you have a point of reference for time frames. I hope this was helpful!

  21. This conversation is very interesting. It is important for anyone going through the K1 Visa Process to understand the legal definition of Marriage in their own Country as well as the United States. I agree with the VJ member that stated, (paraphased of course) it is not a simple understanding of the legal definition, outlined by the governments, but the intention of the petitioner and beneficiary that is most important. I have repeatedly read posts from VJ members questioned at embassies, where fraud is prevalent, asking questions that for most of us seem a bit outrageous. The Embassy immigration officers are looking for anything that may indicate an abuse of the system, whether the applicant is lying or perpetuating fraud. I think that if any member wants to be 100% sure that the embassy will not deny the Visa based on the "marriage" question then you should simply wait.

    I have a question that I have been asking people for about a year now (including my lawyer) and never have really gotten all the information that I need.

    I have figured out that, if you apply for a Fiancee visa, you can't get married until you receive the visa; otherwise you are considered as committing fraud.

    Okay, so, then I've noticed that a lot of people have religious ceremonies in their home countries and then come here and do the legal. Is that okay?

    Finally, what about in countries where the religious ceremony is not recognized by the state? In some countries, the religious minister does not have power from the state to register a marriage. So, if the religious minister does the wedding, it still isn't a legal marriage. How does the USCIS view those situations?

  22. Wow! 10 months! And no RFE? Please do contact your Congressman or State Senator. Ours was approved approximately one month after contacting our congressman's office. We waited 7 months and 20 days for approval at the TSC. So much compassion for you. Just start talking to anyone in the government who will listen. When I talked to the Congressman's office I kept pointing out discrepencies in the information provided by the government website to make my case. The immigration advocate at the Congressman's office finally conceded and made the inquiry for me. But if you have waited 10 months you shouldn't get one single argument from them. Good Luck and Please keep us updated.

    I have been on initial review for 10 months now is anyone else in the same situation. I feel like the only one : ( Have got our state senator involved so hope that helps. Anyone that is in the same situation that has any idea why it could be taking so long.

    Amazing to know that you also were waiting for the United States Government to change their position on samesex marriages. We also began our relationship almost 8 years ago now and managed to remain together in a long distance relationship. As with any relationship it was filled with ups and downs all fueled by the emotional struggle of uncertainty because of being apart so often. We overcame our fears and when DOMA was struck down we felt the world was ours for the asking. However, unlike your journey in the Visa approval process we waited 7 months and 20 days for our NOA 2 (received 6/11/2014). Our timeline has accurate up to date postings for anyone interested. We are still waiting for the Embassy to schedule the interview but since our petition approval things have moved along with a speed that we are comfortable with.

    lildadie I am so happy for you and yours, but I understand the frustrations of those VJ members waiting and waiting and waiting at the TSC. All I can say to those waiting is to be happy that we have this oportunity at all considering the Government's continued discussions on immigration reform. Take advantage of your time by making plans for the future. Work at saving money and preparing your home for a new life together. Go out with friends and tell them your story. Visit an immigration counselling center. There is one in Maryland that provides absolutely free advice from Government Certified Immigration Counselors. Look for anything that can boost your spirits. Volunteer if you have the free time. Just doing things that make the days go by will keep you from the deep dark depression that so many VJers feel from being away from their beloved. Stay focused and Congradulate this couple! We have so much to look forward too! Please be happy your time will come. Then you too can see fireworks and the sound of Louis Armstrong singing "It's a Wonderful World".

    Thanks!! You know, people are so worried about an extra couple of months of waiting time they dont even take a minute to consider other peoples stories. We may of gotten our K1 super quickly but we have waited 7 years for it due to DOMA. I would love to hear some of the posters if they were told it was illegal for them to be with the one they love and they just had to wait until the USA government decided their fate!

    Thanks! As the Petitioner I am way ahead of that part. I have been assembling documents for over 4 weeks. Just waiting for the interview date to gather any final documents required, sign, notarize, bla, bla, bla. so everything is fresh for the interview. Beneficiary will be running to get things done at this point.
