I will relay this to her and hope she will know what to do.    I do not believed she over stayed her visa.   And I think her best bet is have someone in the USA take care of her child.  Or have the father of the child sponsor her.

Actually I am not sure the type of visa she (mother) got while in the US.  But she was pregnant while in US and also she gave birth in US , so the daughter has citizenship.  
 

and then in a later date she left the US back to Taiwan with her daughter.  But now she want to come back to the US with her child so that the child can goto elementary school.  That’s the situation.    As like other said I think she can’t really get status for staying in US other then travel visa or student visa?   Or unless the father is the child sponsor her for K1 visa or ? Other option is wait for child reach 21 to sponsor her ? Her child is about 4 years old now.

Ok so basically she needs to come back to the USA and stay here and wait til her child becomes 21 and then the child would sponsor her to immigrate?

Hi,  hopefully someone has some insights if this or had gone thru same situation.

first off the mom is from Taiwan and came to USA with tourist visa but while staying in the USA she met someone and then they had a child.  The problem is the guy does not want to have anything to do with them.  The child is a citizen.  She had to go back to Taiwan since her visa was expiring.   
 

is there anything she can do to come back to the US and apply for visa? So that she can send her child to school in the US?

any info would be helpful.

does this mean we got the temp resident card that is good for 2 Years ? we still did not get the Advance parole card yet.

so...if infact we got the 2 year temp resident card we can just use that to travel ?

Happy New Year all. Hope all is well.

I just got word from my wife that her grandmom just past away,, and is there anyway we can leave emergency and will be able to return ?

we sent in the AOS and EAD and Advance parole and got the notice few weeks ago...

on top of that we missed the Biometrics appointment because we were on a boston trip. so we just resent the letter for reschedule... I also received an RFE on my I-864 form because I sent in an expired one ... so I will need to resubmit that as soon as I can get all my tax forms again... I was stupid I missed copying one year of the 3 year tax return... do you think I should wait for the other year tax return or just submit 2 years worth and my W2 ?

Monday Morning I will need to call USCIS and see if there is anyway we can leave the US and return back without running into issues at the US customs..

Hi.. how long do we need to wait to receive advance parole ? does the biometrics need to be done first ? and advance parole will be received after ? or regardless of the biometrics we will get the advance parole for travel ?

you will receive the NOA1 pretty quick.... this usually takes 2-3 weeks. but waiting for the NOA2 will be a killler... we waited from oct/14 until may/15. when we got our NOA2.
