    As others have indicated, the MiL has to apply for the B-visa (B2) for the visit.  Your wife is not a US citizen yet, so the IR-visa (IR5) cannot be used to sponsor her mother for immigration at this time.

  2. This may apply to big cities only (HCM/Hanoi/etc), but my MIL was able to get the police certificate at the promised 2-weeks turnaround based upon their new "streamlining" process.  No agency or grease needed....

  4. Just want to add another DP for CSC filers.  My wife had her combo interview at Santa Ana, CA and it shockingly went by pretty fast with the officer asking only a few basic questions.  My wife mentioned he barely looked at her files or asked her for additional paperwork or evidence.  I was in the waiting room with her so not sure if that was the reason why the officer went "easy" on her. 

     

    At the end of the interview, she was handed form N-652 with the two checkboxes stating that she passed the English/civic test and the application has been recommended for approval.  I don't think the officer brought up the I-751 case and my wife forgot to inquire about it since she was so nervous. We're waiting for the case to update--hopefully everything went well.

    Congrats!  It is good to see updates from members regarding N400 updates.  My wife has been studying and really anxious for the interview to be scheduled so she can get over it.

    Each person/situation is unique but I would say she is fine.  If CBP does question her, just be truthful with her travel plans. 

     

    My mother-in-law has been visiting and vacationing with us 4 times in the past 3 years.  The longest stay was 5.5 months.  I only get 3 weeks PTO so we tried to make the best of it while she is here.  There might be time where she is staying at my house for like a month or two before we go take a long trip.  The CBP did question her one time, but she was truthful and sent her on her way.  She is retired teacher so she can spend a lot of times traveling.  The key is to spend the most time in the home country.

  7. I agree with you but at the same time the CO should be making decisions on a case-by-case basis. I felt like the CO during her first interview was being prejudicial and did not give her an opportunity to make her case during the interview.  I think what we all want is for the CO to make decision base on the evidence presented.   We'll wait till the Fall to see if she still want to go through the process again.  Thanks all for the feedback.

Sure.  We understand all that--trust me when I say her life in Vietnam is a lot better than our life in the US :) .  That's why we were kind of stunned when we heard that she got denied not only once but twice.  The odds sure is against her but we'll wait to see if the travel bug hits her again to throw $160 in this B1/B2 lottery.

    So she explained to me the CRI-89 Receipt Number from the biometrics is actually what we should track as the I751 receipt number is really an internal number for officers so they understand the wording of everything. she explained to me however thats why all the received at local office for the I751 number has been showing up. She explained to me that at the internal level the "local office" that the case has been received at is actually Vermont in my case and California service centre for others being that its for form Removal of Conditions. She explained that the files have been in storage for a whole year but until the immigration officer needs the files they will request it Or a bulk and when a worker sends it to them it will come up as Received by Local office so its no longer in a vault but actually in the office to be processed. When they start to work on it that update might come again and do remember they are in bulks so updates might not show up same time. She told me when the form gets transferred you will get a "Transferred to new office and that office has jurisdiction for your case" followed by the notice in the mail. She told me for internal matters the local office for each form is where u filed it based on your address. However the Local Field Office for a person is based on zip code. so local office goes by form and where they are filed and Local Field office is by your zip code. there was so much more I learnt from her however I don't want to bore you too much so I explained as much as I could. I went there for the extension stamp and was given a 60 day validity stamp as she said the system showing that I had a DOB and Name update a few days ago and yesterday my case was approved. also I was told most updates tend to show up  2 to 3 days after its entered into the system. So Im now waiting on my approval letter in the mail which she assume I will have by Monday. she wanted to print the approval for me which I didn't know was possible however it wouldn't allow her as the approved hasn't updated on the case status site yet but she could see I was approved.

    This seems like a logical explanation.  I'm going to assume that each case will be tagged with an RFID sticker and when there is an internal transfer, they just scan it and update the system automatically--the physical file may not move or get the whichever location yet.  This is similar to the Remedy asset tracking system we have at work...

  10. Just trying to understand the whole "ties to the home country" definition since if you put all that i've provided on a scale, obviously her ties to Vietnam are a lot stronger than the U.S since only her younger sister is here...

  11. Thank you everyone that have responded.  We just got back from a Hawaiian trip and my sister-in-law wants to be able to do the same. 

     

    With her 2 denials, any advice on whether she should even bother applying?  If she applies for a B1 in the Fall 2018 then it will be over 1.5 years since the last denial.  Family and work circumstances remain same--the only change being they bought more properties in Vietnam.  Any thoughts?  Thanks in advance!

  12. I was not involved so did not know the finer details, but it is through an travel agency that offers tour packages as well as help with filing for B1 visa.  Yes, fully aware now that nothing is bulletproof hence the reason why I started this thread.

Am I the only one actually enjoying this "glitch or no glitch" debate saga that we're on?  Up till a week ago, we were not expecting anything from USCIS until at the earlier the fall.  So we all need to take a step back and also take a deep breathe.  Don't go on this emotional roller coaster that many on this forum go through.  It is not good for your health.  Enjoy the process for what it is.
