  1. They're mostly concerned with meeting income requirements. Not sure what stage of the process you're in at the moment. Have you filed already? Is your case going to NVC, at NVC? Are you filing CR1 now? NVC will ask for the affidavit of support.


    Create a timeline...helps to better see where you're at in the process...also helps with statistics...

    If you're the beneficiary...go ahead and pay for the increased fess...nothing will change. As a USC, I don't want to pay more fees. As long as we don't have a miscreant government making unilateral decisions that affect the lives of USCs filing for immigrant spouses...we should have fine!

  3. As the petitioner...at the USCIS stage...it is your background that is being looked into...what you did/do. Why not just comply. As well as follow the instructions. You'd be well served to familiarize yourself with the entire process...if you think that submitting the I-130 is demanding you will have a rude awakening. Your journey has just begun...you're in for a one year ride...perhaps longer...

    Pay attention to detail to avoid delays...be proactive...the only way to do that is to know what the next step is before it happens...just sayin'!

    In the meantime...utilize all of the resources here...

  4. You can send the 1040X with W2s. When you file for an amended return, you can see when they received/began processing on the IRS website. NVC has seen these things many times.

    My wife went to her interview at the Embassy with all of my tax info - just in case - cuz like you, I filed Single to make sure that she had my 2013 completed taxes. The CO only wanted to see that - not the amended 1040x - and all they looked at was income. So, to be on the safe side, definitely file for the amended return...if someone from the NVC wants to look up your husband's tax records with the IRS, they will see that an amended return has been filed. If you're just now sending in the paperwork to NVC, it will be a little while before they actually see everything...they're pretty backed up. Not to worry.

  5. THIS IS NOT TRUE! Although my situation is a bit different and I am on disability so we NEED a co-sponsor...you can HAVE one. After you get married, you file the 864 which is meant for co sponsors. My mom helped out my then fiancé and now husband with this and submitted all the forms.

    Apparently, it does differ from consulate to consulate and, maybe even the various visa types - K1 to K3, both which use the I-134 Affidavit of Support. I did mention in a previous quote that I stand corrected.

    But, a lot of what is being said here seems to conflict with various instructions and manuals pertaining to required documentation. With regard to co-sponsors...as I said above, it seems to differ from consulate to consulate and case to case.

  6. I believe NVC actually posted something on their website that they are backed up and that it could take up to 60 days to "receive" - meaning, assign a case number. USCIS pushed through a lot of applications and now the avalanche of applications is at NVC. Also, since the computer crashed a few weeks back, they are not up to full speed yet.

    IR/CR visas can take anywhere from a couple of months up to 5 months before it is sent off the the Embassy. Then you have another couple of months, roughly. You'll be quite busy with getting things put together once your packet is sent to the Embassy. The process is different for IR/CR1 than it is for K1 or K3...others going through IR/CR1 can give you a more accurate idea of what you'll need to do there.

    Good Luck. The waiting is awful...but, like the rest of us, you'll hammer through it and, soon enough, this too shall pass!

  7. You aren't required to submit W-2's. You just have to have evidence that you make at least 125% of the poverty line - W-2's are one way of doing that, however not the ONLY way. Read the instructions yourself. Tax returns are great if you have the W-2's if not get your IRS tax transcripts - you can request these for free online. It all really depends on the consulate - you may want to check a country-specific forum. I know that for UK, a copy of my tax transcripts or a letter from my employer are sufficient.

    Then I stand corrected...my thought was that since it is, basically, USCIS/State Department, that there would be consistency with consular processing with regard to I-134 Affidavit of Support.

  8. Okay, here's what we have managed to collect throughout the day

    • letter from his employer (he forgot to mention he had that)
    • pay stubs for a year
    • W-2 and wage summery
    • 1040A Form
    • I-134 form completed

    I have mentioned to him that he should log on to the IRS website to get copies of previous years tax transcripts. Waiting on him to do that. So it seems the only thing that is missing is an actual letter from the bank.

    Has anyone from Canada been asked to show account info? Could he access his account online and print off a yearly summery?

    I appreciate everyone's help with this. This whole paperwork process has caused more arguments between us than anything else! I guess if we can survive this process, we can get through anything together :)

    No need for bank statement...that is optional. A letter from the bank, however, is preferred...

  9. Yup...agree with all. Encourage her to get a job...if she doesn't have one already. Then, file for divorce. If she doesn't want to leave the country...you can't force her. If you believe that she used you to gain a Green Card...you could report that to USCIS...but, it's doubtful that they will do much unless there are glaring circumstances to cause them to investigate further. They have their hands full as it is.

    Just try to minimize the damage and move on.

    Wow i hope i can do that one too. But i'm not sure if they have quota and i think they have a new procedure that needs to apply online.

    I think you need to arrange to spend 2 days at SLEC...and then a 3rd day at NBI...don't push it...you'll only be disappointed. You know how things work in the PI...hurry up and WAIT!

    We successfully arrived here in California last monday...

    Now i am planning to obtain SSN...

    I am a k-1 visa holder and have two kids as under k-2 visa... Im just wondering if i do need to apply SSN for them? Well theyre minor so they cant apply for work yet...

    I read a thread but it was not so clear in my understanding...

    Do we have to get married first before we can apply for ssn?

    Do i need to apply for AOS before i can get SSN?

    And what are the requirements? Thank you for the time reading my query... Pls everyone let me know... Thanks

    Basically, to claim kids on your taxes, they have to have SSNs. I'm sure that there are plenty of resources here to explain about obtaining a SSN.

    I believe that you have to get married first...then adjust status or however it works for K1. Check the resource here on VJ...under Guides...that's a good start. And, there are plenty of K1's here who can tell about their own experience.

  12. Although I agree with everything you said, I feel I should point out that TSC is technically beyond 6 months. They post their current processing date as 12/31/2013 so that is well beyond 6 months. Many of the recent January and early February filers approvals were more than 180 days and I am rapidly approaching that myself. Granted, they seem to be picking up speed with several 150 - 160 day approvals so that is indeed good news for many.

    P.S. I haven't heard "Cool your jets" in ages...got a laugh out of that...thanks :)

  13. I just used a letter from employer, some pay stubs and printed off a few months of bank statements for my Canadian K1 interview and I was fine. No tax information was asked for demanded. Depends on the consulate.

    Let's not give "false" hope that by not providing 1040 will get you by. Apparently, you did provide it...that it wasn't asked for doesn't mean that it does not need to provided. The instructions are explicit...1040 with W2 AND pay stubs. So, let's not set these people up for failure. To say that it depends on the consulate is absolute rubbish! I'd like to hear what others immigrating from Canada have to say about this. I'm sure that your particular situation with the CO that interviewed the beneficiary had enough info not to ask. Failing to provide the info is a guaranteed 221(g)!

    I'm well over the 125% poverty line. She has 3 sponsors as well. She's just getting nervous because we lack the letter. Anything you can say to make her feel more at ease?

    You need to send the letter of Employment --- POST HASTE! Copy or Original...Original will be preferred. And a COMPLETE 2013 Tax Return with W2s...does that help????

    Yes, he can send you a scanned copy of W2.

    Current pay stubs would be good also.

    As for the 2013 tax filing...I'm not 100% sure that just 2 pages of 1040A is good enough,

    unless there were no other supplemental forms that were submitted.

    I believe the instruction is asking for a "full" copy of the 2013 tax filing.

    Someone can clarify this part...

    Whatever his tax accountant prepared...whether 2 pages or 20...he needs to provide the complete 1040 WITH W2's. They can be emailed to you...originals are not possible because they're sent to the IRS...

  16. Thanks, my case is at the TSC so it will be at least 5.5 to 6 months. "You have not received your NOA2 yet...so, if you can come up with additional income, you just might have a chance." is comforting.

    Oddly enough it had not crossed my mind to get part-time work somewhere else. I would only need a day or two a week. They are trying to help; as a company they are only allowed so many full-time jobs. They were helping me look, but they had none available when we were looking. I had not been pushing full-time the last several years because of school, but I have been talking to a few managers trying to keep me on their mind when they get openings. I don't know of any places that pay more than what I earn at Walmart; since I have been there 9 years. I am going to talk to them again when I work tomorrow. I am also going to look for part-time work for a day or two a week. Don't get me wrong; I don't think Walmart is perfect but as a company they have been good to me. Many thanks for your post.

    Yes, I understand. Appears that you're in Calhoun, GA. Really don't know the "lay of the land" there. Are you a member of LinkedIn? You might try that. While it takes a while to build a base of "friends" there...once you do, you will be offered opportunities! Really. I've been offered a few opportunities. While I'm content where I'm at now...if the right thing came along...I'd investigate it. Anyway...there may be some options for you. Keep your eyes ears and head open and you'll come across something. After 9 years at WM...you have something to offer to someone else - mostly...loyalty! That counts for a bit! I realize that your education is in children's education...if there's a private school, or some other schools that cater to tots, take a look at those opportunities - if you haven't done so already. Or, you just might have to look outside of Calhoun! Keep your options open!!!

  17. How long did USCIS give you for a response? Make sure that your visit to your intended is well within the time frame. Although, while a 2nd visit should re-enforce your claim of a bonafide relationship...it might look suspicious, too! Just sayin'! In the meantime, you might try sending more detailed info...explain that you're going to get married by a Justice of the Peace/at a courthouse...and, be honest...if your intended doesn't get along all that well with his relatives...it is what it is. As others have said, USCIS is looking at the potential for a fraudulent relationship for purposes of obtaining a Green Card. And, resubmit letters of intent to marry with original signatures. As for announcing plans to wed...have a wedding announcement made...or, make it yourself!!!

    It does sound like they're scrutinizing your fiance's intentions. Somehow...whichever family members he does like...the two of you might want to have dinner/lunch or something with them while you're visiting. Perhaps letters from them congratulating your intended and you might be helpful.

  18. You didn't include the W2's? Did you not read the instructions??? You're likely to get an RFE. Be sure to send your fiance the W2's for when she goes to the interview. They WILL ask and demand it...and give her a 221(g) form to provide additional required paperwork!

    A letter from the bank stating that you have an account, how much is on deposit and that you're a member in good standing is fine. I did not send in bank statements and it worked out fine. But, we're K3/Married.

    You should know if you are 125% over the poverty level...simple math. Putting your mother in there is not likely to help. Co-sponsors for K1's are generally not accepted. Either you have the income or you don't. "Technically" doesn't cut it if you don't qualify. Just sayin'!

    Pay very close attention to the instructions!!!! As another member here says: This Will Not Be EASY!!!

  19. You're in a tight spot. You need to come up with more income. You have not received your NOA2 yet...so, if you can come up with additional income, you just might have a chance. As another said, not sure if having the aunt co-sponsor will work. And, a co-sponsor on a K1 is, apparently, not widely accepted. I suppose there are reasons for that.

    Perhaps you can get a part time job somewhere else. As long as you have the paystubs to show that you're earning enough money...that should do. Walmart is notorious for part time work and being somewhat inconsistent!! Personally, if you've been there for 9 years...I'd be applying elsewhere for "full time" work in a similar or advanced capacity! Definitely time to bail on them if they're not willing or unable to help you out. Surely, there must be something else out there that pays more than WalMart!
