Here is a recent they were just like you and the K3 was ent to embassy and they had interview and it was cancelled when embassy saw the I-130 so they had the I-130 expedited (the embassy requested it).
Well go read for yourself. They got the CR1/IR1 last week
http://www.visajourney.com/forums/topic/480445-my-k3-experience/#entry6818869
There's also another on VJ last week they did get the K3. It's hard to say what to do since the embassy seems to decide if NVC doesn't.
Excellent, thank you for posting the link!! I'm not getting my hopes up if the embassy will expedite our request... but you never know
-
No idea, I have no personal experience with it. And most people these days don't bother with the K3 since it gets administratively closed (not to mention it's more expensive in the long run and the beneficiary can't work), so there's not a lot of information on it anymore.
True! Thanks anyway!!

If your country doesn't do a country-wide search (or even a city-wide search in your case), then yes, you'll need another PCC from the area you lived in before.
From one of the guides: http://www.visajourney.com/wiki/index.php/How_to_bring_your_foreign_spouse_to_live_in_the_US#Attachment_2_.E2.80.93_I-864_.28Affidavit_Of_Support.29_Cover_Letter

Yes. If you don't send the original AOS and IV packages, you'll get a checklist.

Call back up later tonight and ask for the IIN. Did you give over both email addresses?
If you've ever been convicted of a crime, you need the fingerprint search. If you haven't, just the simple name search is sufficient. Please read NVC's site: http://travel.state.gov/content/visas/english/fees/reciprocity-by-country/CA.html#docs (scroll down to 'Police Records').
You're right. You'd have to adjust status with the K3 (which if I'm not mistaken, is about $1000). While you wait for the AOS to process (which can take many months), the beneficiary cannot work.
Thanks Saylin. Do you know if it's indeed up to the embassy/consulate to choose for you?

We had the same thing happen. I got my hopes up because nvc personnel told me it's up to the embassy to decide if they will proceed with k3 or not. Our embassy in Belgrade refused to, said when both are approved the i129 gets closed. And sure enough a week later nvc closed it out. It took nvc 22 wrk days to get us case # for i130.
Never hurts to ask ur embassy tho. I literally begged our embassy but they didn't care.
Best of luck!!!
Thank you for quick reply!
I'm not sure if I wish that the consulate will proceed with the K3 visa as that might lead to adjustment of status and those are expensive.. Or am I wrong?

Guys and Girls,
We applied for a K3 and I-130 together and both got simultaneously accepted on February 1. Both were shipped of to the NVC. Our K3 already received a case number and has been forwarded now to the Consulate, while the I-130 still hasn't' been received by the NVC. Normally the K3 will be closed when the I-130 is also accepted at the same time, but the due to the long lines at the NVC things are getting messy now. Anyone any experience with this and how to proceed?
Thanks
-
Yeah i experience that today but i try it over and over then now i get my case number:)
but they did not gave me my invoice identification number:(
Just keep on trying i dialed for 11 times.
Thanks! Just tried it again and now waiting in line.
From what I have read.. If your case number just has been assigned (like today) then you might have to call back later to ask again. Congrats on getting one step closer!
-
Are there more people having issues to reach NVC today?? I keep on getting a busy signal.
-
No. You need to call NVC to find out when your case is received.
yes I already received notification from TSC that it was shipped, but my question is: do I get another notification from TSC that NVC received my case ?
Just came of the phone with the NVC and they received our I-129F and assigned a case number + invoice. The I-130 might take a bit longer.. As the I-130 overrules the I-129F its wise NOT to pursue the K3 visa as this might end up costing you a lot of extra money (adjustment of status).
Cheers

ben2fat, I was at TSC. It took 13 business days for me to receive the notification from USCIS that my case had been shipped to NVC. It will probably be around March 1st for you.
Sukie
Hi Sukie,
Ben2fat has already received the notification from the USCIS (if I read it correctly). I think he is wondering how long it would take NVC to "really" receive the cases and to get a case number.
Cheers

I received notifications that my 130 and 129f were approved on Feb 3rd, received hard copies like a week later from TSC.
On Feb 5th, received notification I29f sent to NVC
On Feb 14th received notification 130 sent to NVC
I called NVC about 129f they told me it will get cancelled because if defeats the purpose of processing the 129f if the 130 was approved at the same time.
Question: how long does it take for NVC to receive my file from TSC if notification was on Feb 14 ? and will I get a notification from USCIS once NVC receive the 130 ?
Exactly the same for us
No idea at this stage...
-
I haven't heard that and I'm pretty sure they can't. What I have heard is that lawyers have even slowed down the process for some people because not all lawyers are going to call everyday like we do to get updates on the NVC process. If I were you, I'd at least call until you have your case number, that way you can check when each step becomes available and you can make sure your lawyer is on top of your case.
Come join the NVC thread, and make sure to read and understand posts 1 & 2:

Thanks for the advice, will do that
-
Well if it helps, I never got a separate notification that my case was sent to the NVC, so the two weeks it took for my case to be received by the NVC may have been because it wasn't sent until sometime in the latter part of those two weeks.
The good thing is that once you get to the NVC, things start moving faster. Make sure you are reading up on the NVC process and start preparing your AOS and IV documents in case you haven't.
It did help ;-) I feel very special now
Yes, we have our lawyer ready to go. She has everything she needs, so should be good. Wondering if lawyers are able to bypass any of the standard procedures.. Do you know that?
-
Please let us know when and to where was your file transferred? Thanks
January 3 to TSC. You can also find it in the excel sheet ;-)
-
It means your case has been sent to the NVC. It has been taking on average about two weeks for the NVC to "receive it", and about three to four weeks after that for a case number to be assigned.
Sigh, I was hoping for a more positive answer Nobby.
It took them almost two weeks to mail my approved application to the NVC - Unbelievable!
Thanks!

Just received the message "On February 14, 2014, we shipped this approved or re-affirmed case to the Department of State for visa processing. For more information, please contact them directly." for the I-130 which was approved on the 2nd of February (already received same message for the I-129F on February 5).
Does this mean that NVC should provide me with a case number soon?
-
They have hundreds, maybe thousands of cases and they all have to be manually entered into the computer by a human. When the info gets entered into the computer, that's when a case # is assigned. I know the waiting is extremely difficult but just try to be patient. We are all in the same boat. We all miss our spouses and want nothing more than to be with them. Hang in there.
Manually???
Welcome back to the eighties? Nah, its super annoying as we have to find out through forums where and how the process goes, nothing is made crystal clear. Hang in there too!
-
Can someone explain to me why it's so hard for NVC to provide every case with a case number immediately after receiving it from USCIS?
-
Congrats everyone!!
-
Congratulations July filers !!!
Can someone add Sukie's NOA2 date to the spreadsheet ?
1/30/2014 ?
Thank you!
-
Hi Everyone! We just got approved by TSC. We were transferred there on January 3. (NOA1: 7/24)
PS I dearly hope that everyone here gets his/her approval soon too!
-
Where did you get that?
Spreadsheet
-
Yes, there was a surge of July approvals especially at the CSC. I was hoping to have been one of them but it got awfully quiet here the last few days. I'm afraid of the CSC turning into another black hole for petitions.
They were doing tooooo well..
It seemed like everyone got accepted at CSC instantly - compared to the other service centers.
-
Strange!! It's a little quiet on the approvals the last few days...
-
I'm glad it's not a difficult RFE for you, sounds like they're being a bit picky to me but at least you can get the documents right back in the mail to them! Good luck, I hope you have a speedy approval ahead.
USCIS likes to send a lot of text/email notifications. Sit tight and don't let these texts worry you, this deluge of notices has been common among transfers but the content of them isn't accurate. Since you received the first notification yesterday, hopefully you'll have the hard copy by the end of this week, and that will tell you where your petition has actually been transferred to (California, Nebraska, or Texas).
Agreed. Nothing to worry about. ;-)

Our case finally arrived at the NVC office after NOA2 on Feb 1. Saylin could you please update this in the sheet? PS we were transferred to the Texas office (now it says NBC).
