  1. The day they physically receive your packet/response/email doesn't mean a hill of beans. The counter starts when they SCAN the packet/response/email into the system.

    So frustrating. My attorney sent an email on May 7. My checklist response physically reached NVC on May 8.

    My file says something was scanned on May 9 and another something was scanned on May 14. Don't know which is which, but my "days" have to start from the 9th, not the 7th.

    My attorney and I essentially sent the same email/checklist response. I'm not sure if I've screwed myself and they start counting from the LAST day something was scanned. Either of our responses will deal with the blasted unnecessary/unavailable police certificate.

    Hi Sukie,

    I know.. :) My date means their receival date (also known as: pick what you want date or scan date). They approved my birth certificate, so now we are only waiting to add the missing page to the AoS document - SIGH!

    Sorry to hear that you're not making any progress either. There are also a lot of people with lawyers who received an unnecessary checklist lately. Poor quality if you ask me..

  2. Hey Bulwara Road, and all Australians in the pipeline...we've had a terrible time with NVC and police reports. The reviewer of our file has coded that my partner needed a police report from EACH state in which she has lived. Of course, Australia now has a federal police check, and you only need ONE report. We would have had Case Complete as of April 29 if the reviewer had not misinterpreted the rules for Australia. Neither I nor my attorney has been able to get them to rectify this situation yet.

    If you are in Australia, and you have lived in multiple states, in your IV cover letter you might want to mention that you are including the FEDERAL Fingerprint report that you have received through applying via your state of residence. And then, mention that Australia requires you to request your FEDERAL report through your CURRENT state of residence.

    If you are a residence of QLD or NSW, you should mention that your FEDERAL Fingerprint report, which MUST be obtained through your CURRENT state of residence, and ONLY through your current state of residence, will be sent directly to the Consulate.

    Our file was perfect - and NVC screwed up. This is delaying us by at least six weeks, unfortunately, as we have missed the June interview cut-off, and, if they take the 30 business days to address the issue, as they keep telling me, we will miss the July cutoff for interviews too.

  3. I only sent the certified copy issued by the Civil Registry in Costa Rica with the EFFFINGGG stamp they said the original is missing. They accepted the translation of that dang document. Now when I call, they tell me they only have the translation, no birth cert... ( where do they think the translation came from?) I was also told that the birth cert I just sent does NOT need to be translated. If they come back saying it needs to be translated I will lose my mind

    Let's hope not! :) The power of positive thinking :P

  4. Haha, same happened to us! For us they accepted my birth certificate after a supervisor review and generated an updated checklist. Was not expecting an approval on that birth certificate, so kind of sad that I spend over 150 dollars to get them a different version with apostilles.. sigh!

  5. Are you the Dutch citizen? If you're having a problem with the birth certificate, perhaps you submitted the wrong version. Did you submit the long form? Or the short white form that you get from the Gemeente? (And did you get it Apostilled?)

    I'm indeed a Dutch citizen and gave them the white form from the city council (they told me this was the right version, sigh). After it got rejected, I read more into this and found out that you can get documents apostilled.. Never heard of it and if they are giving me troubles - I will get a new version apostilled. Weird that my lawyer never told me this...

    What version did you submit to the NVC?

  6. We are working with a lawyer too and she will call them today. If they want something else then I honestly don`t know what to submit because I can`t give them more than a certified copy.....

    Was your problem the birth certificate too?

    Yes, birth certificate too but also a missing page in the AoS document. Our lawyer called yesterday and she couldn't work it out, so she called in a help line.

  7. We definitely don't care about the work permit.. and we don't care about the cost of adjusting. K3 is the same as a K1 except you are already married. It was designed to speed up the process ( even though the process has changed over the years) Why would they say NO for a K-3? and not for the I-130? We have a waiver to file so we would prefer to bypass this NVC BS. If we go for an interview for K-3 or I-130 we will get the same result , we still need to submit the waiver before he can come home. So for us, the K-3 makes sense. If we didn't need the waiver, I'd go for the I-130 because the interview is the end of the road.

  8. Talk to NoelAnne.. Her K-3 is being processed as we speak so don't jump the gun on spreading the " administratively closed" fable ! The backlog is so bad at the NVC, Some K-3s are squeaking by.. So that is what I am hoping for. I know the K-3 process well. I waited too long for my NOA2 .. If I can avoid all this NVC nonsense.... That is what I am gong to do. I don't care about the additional $1000 dollars. If I have to do the I-130 then so be it. I will be calling for my K-3 case number and following it to the embassy.

    Does the TSC send out a notice that your case is sent to the NVC? Yesterday I received 3 responses to all the service requests I sent over the last few weeks. One response stated that it was responding to 3 inquires all at once ( LOL) anyway, the response form TSC said my case is not with them anymore, that is was sent to the NVC and gave me all the contact information in the response. SO, is there an officially shipped notice? Will I get a text? Just wondering

    Hey there! We also have a K3 which is already at the consulate. In fact the consulate is already waiting for my response for more than three weeks as we are still in the process of receiving a case number for the I-130. Our lawyers advised us strongly not to pursue the K3 visa as it's a another risk (for the AOS the government has more rights and data at hands to tell you "no" and the appeal process is very shady) and more money, while the whole process is soo close. Plus you have to wait at least three months on your work permit.

    We decided to wait, but we have no idea if it's the right decision :)

  9. Not sure. I know for Canada, a fingerprint check is only needed if you've been convicted, but I don't know if it's the same for Australia.

    Can anyone tell me if my husband has to do the fingerprint police check or just the name one? I've looked at the country specific documents but haven't seen anywhere it said which one.

    I studied abroad in Australia and had the same question.. So I contacted the local US consulate here asked for their advice. They contacted the Embassy in Sydney and a name check only is good enough, but I'm NOT an Australian citizen. This website might give you some additional info: http://canberra.usembassy.gov/obtain_police_cert.html. My advice: check with your local US embassy, because these things change and they don't know it all either.

  10. I can't believe this!!! I was calling to find out if my case had been received, but I got a NVC case# and IIN. The agent had my email address and phone# already, and I gave over my Wife's email address. When I asked for the IIN he gave it but mentioned don't try to pay or do anything until they send us an email. I didn't know about the beneficiary ID#, but was given that as well.
    I am still in shock. I don't know if they got a bunch of cases assigned today or what?! I had called on Friday and was told they didn't have my case on record yet and to wait 8 weeks!! Today, they told me my case was created on the 27th!! I was approved on Feb 13 from CSC. Not clear to me when my case was received in that case.
    I am hopping this means that they have made some major progress on the 20-30 business delays that they have been quoting.

    Are you sure that you've received the I-130 case number?? We received our I-129F also very fast, but the I-130 is still in progress...

  11. Updated! And I took NBC from your timeline. I'm not psychic tongue.png I have no idea where people's cases get transferred to if they don't mention it in their timeline or signature.

    Where was your case approved from? And please fill in your timeline, it helps everyone.
