Hi! Thanks for the answers. So, I'm the beneficiary, I'll put my actual job then. I thought tricky because I'll be unemployed even before the interview... Do you think is it a problem? thanks a lot
I've never seen an issue with it before- that's your job as of now, while you're filling out the form. Knowing NVC they will take forever to review it (unlikely), and things change sine you submit it. If you feel it's necessary, you can tell them at interview that you are no longer employed at that company.. They probably won't even care about it to be honest. Haven't seen any issues reported about this.

Hi there! I have two questions about the DS260... When they ask "is your spouse immigrating to the US with you?" The answer is No because he's already there right?
The other doubt is more complex... They ask about my primary occupation I put, but then they ask for my present employer. The thing is, I'm still working but by the time they review it I'll be unemployed..what should I do?! Thanks in advance!
It's no- even if he's in the states or outside the states. A US citizen cannot 'immigrate' back to their home country, it's simply just moving back.. technically. For the job part- Just to clarify two things.. Are you the petitioner or the beneficiary...? Are you filling out the employment part about the the beneficiary, or are you filing the employment out for the petitioner- If it's for the beneficiary, then you put exactly what you're doing now. They know you're going to be unemployed afterwards if your visa is approved and are going to immigrate.

I dont understand... why is there a 5 month mark if when they dont respect it they dont tell you why? I mean I have the same right as anyone else form any other country filling for a IR-1 So if my husband call he would have to ask to be put in touch with a tiers 2 agent?
It's the average. It's true you do, but so did everyone from early 2013 who had to wait 10+ months due to them putting DACA filers above US citizens' spousal visas. There's still some from October 2013 onwards who are probably still waiting.

They will tell you to wait, like they told others plenty of other times to wait. You can try to see if they can put a service request in, see if they will allow it if the reps actually can. I know it takes a tier 2 to be able to put any service request in. That's the thing with USCIS, the tier 1 reps see as much as you do on the screen.

I called today... and the call center agent would not talk to me, I am the beneficiary. I'll have to get my husband to call from USA... such a pain!
sounds about right.. and I'm pretty sure they will tell you you're within processing times too.. Tier 1 and Tier 2 agents at USCIS are rubbish.

Yes it is exact word for word. So i just called and she said that she does see to exact ones and that she does not know why that happened. That they have not seen the email I sent Sept 8 because it is not in their system scanned. To give it until next week so it can be scanned in system. I also asked when would they be looking at the checklist and she said 30 days.
As long as you sent them and it's not a different checklist- you should be fine. Be prepared for the wait though.

We have reviewed the documents you submitted to us. This letter has a list of documents that are missing or that need additional information. Please review the instructions and then submit the required information. If you do not provide this information, it will delay your immigrant visa interview.
I'm surprised that is actually still on the website. Possibly, but if the reps are saying 60 days on the phone.. It's 60 days.. Knowing NVC, they probably haven't updated what is on their website :/.
Well that's something new! Is it exactly the same checklist word for word? Sometimes they send you it twice on accident...

Good afternoon to all VJ Community, question I received a checklist which I had mentioned on Sept 5 and was verbally informed by 5 reps what I needed to send. I send in new paperwork. On Sept 9 I received the email for that checklist. It indicated all the issues the agents had mentioned except it had on top of each page one sponsors name and not the other one. However I asked NVC and they said sometimes it goes out printed wrong but keep reading it will tell you what to change and do it for all sponsors the agents said.
Today I received another checklist email exactly the same requesting same docs.
Has anyone had that happen and if so should I disregard and pretend they duplicated. I am calling them now.

So I have submit my ds261 today and that is what I can read on the ceac page
"To process your case, you must first pay any required fees. Then, each applicant accompanying the principal applicant to the United States will need to complete the online IV Application (form DS-260). The IV Application may be partially completed and finished later, or may be completed at one time. However, once submitted, please contact the NVC if you need to update the form.
After submitting the DS-260, mail all supporting documentation (as listed on the Documents The Applicant Must Submitweb page) for each applicant to the NVC.
Once received, it will take the NVC 2 to 4 weeks to review your case. If any additional information is required after the review, the NVC will notify the applicant (or the applicant’s agent). "
I am especially happy about the 2 to 4 weeks part or was like that before and I still need to look for 60 days ?

Are you actually adjusting status in the states, going through all just USCIS? Or are you actually at NVC?

Scotland is beautiful... Me and my wife are laughing because our flight is on the day that Scotland votes a yes or no for their indepedence.. She loves it in Scotland, but doesn't like people mistaken her as Scottish.

A quick question, if anyone can help.
I will be submitting an expedite request but NVC has yet to receive my file (checked yesterday). Do I wait to send in the request until they have the file, or do I do it now in hopes they can dig through the pile and find it? Thanks in advance.
Most likely need to wait. They will still need to wait for a case number to be assigned before they can approve it, and send it to the embassy. (From What I read from others!).

You all are so helpful! I'm just reading and soaking everything in that way I can try and avoid any RFEs at NVC. VJ helped me get throught USCIS RFE free but I was held for "additional security checks". I'm looking forward to sending off my last round of documents and have my hubby join me and our son. I'm praying the baby won't be one before his father comes to live with us.
Welcome to the NVC thread! Few pointers- read the Wiki of course, make sure you have all relevant documents for your embassy. (Some embassies ask for more things than others!). You can find exactly what documents your embassy is looking for on the wiki, there is a link as well

AOS package is the one that gets checklist a lot! Few common reasons!:
-People put the wrong amount for total income. Total income should be line 22, or total income (NOT ADJUSTED!) Only use adjusted if its a 1040EZ for the tax return.
-People put the wrong amount of people someone sponsors for. If it's just you and your husband, and your son, it would be 3!
-People who file the 1864EZ that left place of residence blank, instead of N/A received a checklist for that too..
-Make sure you have your tax transcripts for the last three years, or the 1040's with the w-2 and relevant 1099 (if you have any). Don't leave any out because they will checklist you for it. If you haven't filed a tax return one year because you weren't required to, write a note in the cover letter, and a sticky note saying why, and that should suffice.
My best advice is to read the 1864 instructions! Print them out, and go bit by bit. Have them side by side with a practice run for your I864, look it over a bit few times before you send it off to catch any mistakes. (This help tremendously!!!)

mine did the same thing when my AOS fee was in process of becomeing availible. Freaked me out!!!!! I made a fourty five minute call from the Philippines only to be told there was no problem.

The good news is, as you grow older you'll leave most of your phobias behind. In my case,
fear of darkness... gone,
fear of needles... gone,
fear of flying... gone (flying 50,000-70,000 miles a year took care of that),
fear of the dentist... gone (9 gum surgeries in the span of two years took care of that)
fear of my wife's short fuse... pending.
My Panel physician asked me to go to the public clinic to get the shots free of charge and bring a confirmation.
Tell my wife that you get over phobias when you get older..
I'm sure she will disagree! LOL.

Yes, he has been already offered the job, he is going to be paid by hour , full time plus over time, if everything works out he should start it on ~22 Sept.
Right, if you know it's going to be the same amount of hours and pay each week, it should be by the x52 (Don't hit me if I'm wrong Saylin!
). What you can do- is see if the employer will give him a letter stating what his salary is, and how many hours a week he starts etc. They should accept that at interview!
You could- in theory have a co-sponsor in mind just in case your embassy is picky. I've seen that happened before, but it's unlikely

How do we need to count my husband (petitioner) annual income to put in I-864 form , he is not working right now, but he is going to start a new job soon. So for example he is going to make 1000$ a week , do we count the annual income as 1000 x weeks that have left in 2014 (15 I believe )or we count it x 52 weeks ?
He has met the poverty guideline in 2013 and 2012, but not in 2011.
we can't add what he made already this year to what he is about to make , am I right?
Do we need a co-sponsor in that case?

Follow the advice Nich-Nick gives, as she is full of wisdom
. I would personally file DCF, IF you have the option to. As Nich-Nick says, you have to be a resident of the UK for at least 6 months to be eligible for DCF.
Looks like USCIS is going at a 5+ month rate, plus NVC is even taking longer now. Through DCF you are able to skip the delays and the backlog as it will go through the Immigrant Visa processing at London instead.

Our AOS fee has turned to N/A! Last scan date was July 22nd for an AOS checklist (the lawyer either forgot to include my 2013 tax documents or NVC lost them).
I'm in the middle of the boonies in Scotland right now, with poor to zero internet and phone coverage, so I probably won't be able to call NVC until tomorrow night at the earliest. I'm relieved though I'm not sure we're in time for an October interview.
Best of luck to everyone still waiting on their case complete. It looks like NVC is back to working 1 scan day every business day! Everyone on this thread has been super helpful. Thank you all and a special shoutout to Saylin for her work on the NVC Wiki! If you're new on the thread, please take the time to read the whole thing. I only wish I had found this amazing site and thread before I hired an attorney!

I was able to reschedule my interview from October 27 to September 22!!
Although it was not as smooth to reschedule with the embassy in Tokyo, I still got what I wanted... I am so happy right now!!
Many more of you will be able get good news on your cases as well!!

Yes, EXACTLY questions like that! Haven't seen that one in awhile. But I've still seen, and continue to see, questions that are clearly answered not only in my wiki but as well as in the official form instructions and on USCIS and NVC's websites.
What is a wiki? o.O
I think separate threads is a good idea on paper, but it will have teething problems. Someone will need to be around to move the irrelevant posts to the new thread and vice versa. And people will be second guessing what exactly they can write when asking a question if it is an emotionally charged one
but I say see how it goes, you never know without trying
It doesn't help when people post more than once, within a 5 minute space.. (Like where a whole page is dedicated to the same person posting). Also, I don't mind people complaining. No one really understands in our family or friends life, but I do see the same ones over and over again about how they haven't seen their spouses in over a year etc, and this is just on the same day.. but you can't change people XD

Anyone can make a thread
So, if someone wants to spearhead a new thread for just venting about wait times or talking about how draining the process is, etc etc, then by all means, someone start one! (Call it something like The NVC Moral Support/Ranting Thread) Then this thread can get back to its original intention of questions and progress only (and probably reduce the number of pages by a lot, especially if people start reading what's available).
It's funny to me, cause when I was going through the process, the NVC threads would typically average around 40 pages by the end of the month. Even less sometimes. But as the wait times go up, (obviously) more people talk about it and complain. Which is fine, but I think it should be in a separate thread, as I've discussed before and brought up again above.
Saylin, my case says it's process of termination... OMG WHAT DO I DO?

I'll start off for you
.
We received a checklist for a w2! (AOS Package). The W2 form didn't exist since my wife worked in the UK! (We have P60's, which she included). She also had a note saying the UK did not do w2's, only P60's.
We were able to speak to a supervisor, who said they would remove the checklist- It took 31 business days to remove their error.
