Sheesh Scott, this is ridiculous!!! If anyone has a right to complain about the USCIS it's you and Holly. Man, I'm so sorry for all this...I just hope they get it straightened out soon. Hopefully as soon as your EAD comes through they'll transfer your case to CSC. So did you make an Infopass appt?

You can't make an Infopass appointment for this - every attempt ends up with this result:

I'm going to talk to them again tomorrow morning, and if I still get nowhere, I'm going to make an appointment and tell them it's for a different reason, so that at least it will give me one.

Do call them right away and they will resend it. You have to be patient. I call there last week twice and was on the line for at least 1 hour each.

I wouldn't call them to have them resend it - chances are fair that whatever failed with them sending it to you the first time can fail again, and you could be facing an abandoned application.

Make an Infopass appointment ASAP, go in and get them to give you a copy of the RFE document.

What does being transferred to CSC mean?? When they aprove you dp you have your AOS interview? Or are some people not having interviews?? Im confused!

It means you will be approved without having an AOS interview.

Did the RFE notice say anything about your EAD? Depending on the type of evidence requested, if the RFE referenced your EAD, the 90 day clock was either tolled or re-started altogether. In that case, you cannot simply count 90 days from your NOA1 date to determine your entitlement to a statutory 240 day EAD.

Nope. The RFE was for seven items (six of which were sent in the original I-485/864):

- Tax transcript for 2005 tax year for USC

- Copy of W2 from 2005 for USC

- Employment letter from current employer for USC

- Bank letter for USC

- Bank statements for USC

- Proof of citizenship of USC sponsor

The seventh item was a divorce certificate for my USC wife, despite the fact that she has never been married (which was quite clear if they had actually bothered to read the application). All of the items had to do with materials about her, not about the EAD.

It was quite clear that the RFE was for the AOS and AOS only. The receipt number referenced was for the AOS, and no mention of any of the materials for the EAD was made.

Let me try to explain the way the process works. First, to give you some background, under 8 CFR 274a.13(d) USCIS has 90 days from the date of their receipt of the application to issue you an employment authorization (there are a few categories of immigrants to whom the 90 day rule does not apply). USCIS' failure to comply with the 90 day requirement results in the automatic grant of an employment authorization for a period not to exceed 240 days.

Now, in the event that your employment authorization application is missing required INITIAL evidence, under 8 CFR 102.2 ( B )(10) the 90-day countdown does not start until USCIS receives that evidence.

Now, if your application is missing anything OTHER than the required initial evidence or if USCIS requests ADDITIONAL evidence, then the countdown clock is simply suspended until USCIS receives such evidence.

To illustrate, if your employment authorization petition has been with USCIS for 20 days, then USCIS requests additional evidence of your eligibility, USCIS will have 70 days to finish processing the application after USCIS receives the evidence. Now, under the same scenario, if the required INITIAL evidence was missing, USCIS would have the full 90 days after you submit such initial evidence to finish processing your application.

Very nice that 8 CFR 274a.13 states what they must do, but as I have been told three times now by the misinformation line, they have decided that as of September 1st of this year, they "no longer do that." They simply send off a notice to the processing office to open an investigation as to why it is taking longer than 90 days.

don't be mad or sad, I think I have an explanation for what is happening with your files.

Since I talked to an USCIS officer just the other day because of the same issue(EAD application hasn't been approved within 90 days), she gave me the following reason which makes sense:

She said once an RFE is issued most EAD will be put on 'hold'...Once the RFE is received they will continue working on it- same with AOS.

Let's see your NOA 1 was dated for 8/16/2006

your RFE was dated for 10/04/2006, so your files have been in the system (at that point ) for 7 weeks, roughly 50 days...

They received your RFE on 10/20/2006, so they basically got another 40 days to work on your EAD....and for the AOS the 'normal' processing time is between 120-180 days, so they got 70-130days left to give you a decision.

The USCIS officer did some math on the phone...and she told me the exact same thing what I told you know...

SO, I believe, if you do not hear from them within (roughly) 40 days, you can go ahead and inquire whatever you need, but I believe up to this point everything is normal.

I can't speak for CSC transfers though- but I believe, you will hear something very soon- just remember, that even in the RFE notice it says that you will not be eligible for a work permit for 90 days AFTER they have recived the RFE.

Actually, my RFE makes no mention of a work permit at all.

When I talked to the officer on the phone today, the first thing he said when pulling up the EAD file was, "oh, wow, this is way beyond 75 days, it should have gone through by now." I don't know where he got 75 days from, perhaps that is their internal standard?

Here is what CFR 8 274a.13(d) says, I have deleted some irrelevant portions that refer to Cuban and Haitian refugees:

I don't know, but to me, that says it's done within 90 days of filing, or else they give you a temporary EAD - regardless of the status of any other application.

But then, those are only the federal regulations. We know how well the USCIS "interprets" and selectively ignores those already.

Nobody knows. Some people have an approval a week after USCIS receives the RFE response. It's been over a month since they got my RFE response and I still haven't heard a thing. Luck of the draw, really.

It is likely that you will have to make an Infopass appointment in order to find out what's going on. Sometimes they can even issue you the RFE letter right away.

I agree. You don't want to mess around with them re-sending RFE papers that you may or may not get. If you don't reply to the RFE in time, they consider the application abandoned. Make an Infopass appointment ASAP and find out in person what the RFE is.

So today is the 91st day since the NOA1 for my AP, EAD, and AOS.

AOS has had no touches or anything since they acknowledged receipt of the RFE materials a month ago.

EAD has never had any touches at all.

AP doesn't even show up in the system, and they say they can't find it in their computer, despite the fact that I have a NOA1 for it in my hand. Glad I spent that $170 there. They are "looking into it." They told me the same thing a month ago.

I spent 75 minutes on hold with USCIS today to get to talk to someone and ask what to do now that the EAD hasn't been issued within 90 days. Their web site says:

Previously this meant you could get a temporary EAD until they got their act in gear and got you your real EAD or green card or whatever. No more.

Now what do they do? They take your name, address and phone number (they don't have it already from any of the 70 or so forms I've filed?!?!) and say they'll forward it to the processing center for them to "look into it." If I haven't heard back from them in 90 days, I'm to call them back.

As for the AOS? Who knows???? It seems to be lost in the depths of a desk belonging to some vacationing USCIS agent. Virtually all of the CSC transferees who were transferred before me and almost a month after I was have already got their green cards. I haven't been touched in a month. The misinformation line said to call back in 90 days if I haven't heard anything.

I'm REALLY tired of this.

I received an RFE back in September, sent the required documents to Lee's Summit,MO- they arrived there on Nov9.-receipt date via email.

So, my NOA1 for EAD was dated for August 4.- can anyone tell me how long it'll take until I get my work permit?

I am a former K1er and am wondering if they'll forward my case to CSC?

Also, what are the next steps?

Today they 'touched' my AOS file, but not the EAD file- that one hasn't been touched ever since 8/24/2006...

can someone please give me some kind of advice?

My EAD has never been touched, at all.

Nobody has any idea how long any of this takes. For some people it goes very quickly, other people wait for years. Why? Nobody knows, or at least they're not telling.

It's good karma that your AOS got touched, however!

Well, very little activity in this thread today or over the weekend, I take that to mean that CSC has gone back to sleep.

Well, another Friday marks yet another week passed without any approval, EAD, or even a touch.

I'm losing hope.

Me too. Here's what they sent when they got my RFE materials:

That was three weeks ago. CSC already sat on it for 5 weeks before that. Today marks two months since it was received by CSC. Some people have waited for 3 weeks TOTAL after it got to CSC before approval and issuance.

I feel for you. As others have mentioned here, if you tell us where you are, it will be easier to find you help.

One thing I can suggest to you right now is to DOCUMENT EVERYTHING. Every time he gets mad, write down what happened, what he said, where it happened, when it happened. Every time. It's important. Especially if you end up leaving with your child to the UK, this type of information will be critical in order to allow you to keep your child according to the Hague Convention.

If he threatens you, or if you feel in danger for you or your child, you need to call the police. Coordinate with a battered womens' shelter. Make an escape plan. This behavior is going to get worse and worse, you need to protect yourself and your child and get out of there.

Looks like another Friday goes by without any news for me. No EAD, no AP, no AOS. By the way, my NOA1 date should be 8/16, not 8/18 - 8/16 was the NOA1 date, 8/18 was the day it showed up in my mailbox.

On that topic * name checks* do they not do a name check when we apply for the K1 visa? And if so why are so many of us held up there during AOS??? What do they think we could have possibly have done in the space of 90 days?? And yeah I know some people don't apply right after marriage but those of us who do why? Just wondering that's all since I actually have no idea why my AOS hasn't been touched since September and we are just supposing that may be why. Is this a different type of check? And if so why would they waiting until we are actually in the country to do the more extensive check rather than before they allow us to get here? These are just ramblings and the thoughts of a crazy person with to much time to think and wonder on their hands. HELP ME CSC!!! Before I turn into a complete nutcase. Give me a greencard or an EAD so I can get out and work instead of sitting here staring at the walls all day with just the company of a 2 year old. It's sad for a person my age to walk around singing songs from Thomas the Tank Engine videos.

You're making one huge mistake here. You're trying to apply LOGIC to the processes of the USCIS.

If we try to use logic, we'd have to try to figure out why I got an RFE on my AOS to prove that my wife is a US Citizen (among other things), even though she could never have sponsored me in the first place if she wasn't. It goes on and on.

OK, so I'm at 85 days since the filing of my AOS package, including my AP and my EAD I-765, with absolutely no action from USCIS on either the AP or EAD apart from the original NOA1. At 90 days, you're eligible for an interim EAD. I found this on the USCIS site:

Fine. So I go to the office web site which tells me I must file for an INFOPASS appointment. I go through the menu, and select the following:

And what does the web site tell me?

I'm sorry, but what kind of BS is this? They take too long to issue the EAD, so they tell you that you can get an interim EAD, and that you have to set up an appointment to do it, but when you try to do that, it tells you that there aren't any appointments available??? Try again LATER???? What, like a month or two???

Has anyone else tried this? I'm dealing with the Cleveland district office, incidentally.

My EAD has been approved today....

I am envious. I'm now at just about three months since the NOA on my AP and EAD - neither of which has had any touches or anything else. Also coming up on two weeks since they received the AOS RFE materials without any touches or activity.

What is going on at CSC?!?!?!?!?!?
