I am in the same situation, same issue with my girlfriend now wife.You do not need to wait the 5 years. You will need a 601. I also recommend getting a attorney. Lizz Cannon is excellent.

You need to replace it. They will not you leave the U.S. with a damaged passport. Trust me on this. I got to Miami and they would not let me fly and my passport was only slightly damaged. It is not worth the risk. Use a service to expedite or go there in person if allowed. Check with the office. Only people that had tickets leaving in 48 hours were allowed to do it in person and it was a zoo. Had to wait in line for 5 hours and I was there at 7 and they open at 8 and was already 100 plus people in line. REPLACE IT NOW.
