We sent our AOS package the 2nd but since Thursday through Sunday they were closed, it was received the 6th -.- patiently waiting for NOA1

Also wanted to add that, while you should have no problems filing for AOS more than a year after you entered as K1, be careful when traveling outside the USA without a GC, even after you have been issued an EAD/AP combo card. You have been out of status for a year and immigration might give you headaches when you reenter. Just a heads up

Hey guys ! It's been a while and a roller coaster!
It's been a year and four months since my then fiancé entered the U.S. with a K-1 Visa... we got married within the 90 day period but never got around to sending off the AOS packet . Because I kept thinking I had to send off all the petitions together and we were always being side tracked by something else and couldn't save up the $1,070 for it .
Anyway, yesterday I finally sent it off . Woke up , took our 2 year old to daycare and pretty much ran to the post office . I was in a rush just because I felt for some reason that something may stop me and delay everything even more lol.
I shipped it over night and they received it today but I guess it hasn't been opened because I haven't receive a text or email confirmation ... Super anxious haha
I was wondering if anyone had waiting that long before ? Because I know that his I-94 expired and he was without status. Could that affect us in any way ? Or is it just good that we sent it off already ?

Im confused. .....how did you marry in June but say K1 expired in November? The period is 90 days from entry to marry. If he entered and married in June, the deadline would be in September. ....correct?
His I-94 said Nov 30 .. Meaning that after Nov 30 he would have no status. It was explained to me like . He entered April so we had 90 days from then to get married..

If you were married in 2014 your options are married joint, married separate or single head of household if you have a qualifying dependent and your hubby was considered a NRA.
Yes we got married June 2014. What is a NRA ? We have a daughter that I planned on filing with . If I file married separate , would that bring about any questioning later on ? Or should I do single and just adjust later

I just got off the phone with USCIS and they told me that my taxes aren't even needed to AOS.... So now I feel like the person that told me that, doesn't know what she was even talking about. I will be filing AOS soon.

No, when I went it was too late for his SSN . The notary is a friend of my mom who has filed my mothers taxes always . Since I had never filed my taxes, I went to that person. But she told me I HAD to file with my husband because of immigration reasons and she requested the tax ID
Now I'm wondering if I actually have to wait for that to file my taxes because I'm really trying to move along with his AOS

His visa (K-1) expired in Nov . We hadn't filed for AOS because of financial issues. We finally got the money but when I went to file my taxes , the notary told me I can't file mine until he got his tax ID..... Because I need to file my taxes with him..... We requested this taxID more than a month ago and it hasn't arrived..... So now time is continuing to run and he continues to have no status...
Is this true ? Our can I just file my taxes and find his someone to do a affidavit?

He is not going to be deported nor is he going to be denied permanent residency. You fulfilled the only requirement of the K-1 visa, which was to marry within 90 days. Because of that, he is eligible to apply to adjust status...even if it will be years down the line.

If you lived near the border, especially southern border like Texas, then he would be at risk for being detained by ICE at a checkpoint. There is a much smaller risk in the rest of the country but not 0. As long as he isn't doing anything that he could get arrested for then he should be ok. I've seen people on here wait a couple of years to AOS, but not recommended. Also, if you wait too long then you have to pay for a whole new medical, which I think is filing AOS after a year from when his medical was originally done.
We are on the east coast so let's hope those chances lower by a lot .
Oh no I dont plan on waiting years . The sooner the better so he can have his work permit and find a good job.

Immigration and Customs Enforcement. Detained = Arrested. Doesn't mean he's going to be immediately deported, in cases like this people are given a chance to file AOS, but there was at least one case here where somebody did get picked up by ICE.

No. I sent the package, and had my biometrics appointment one month later. So far, everything is normal.

No is not true.
It took me 8 months after marriage to be able to apply for AOS, also because of issues that happened out of nowhere.
They prefer that people apply as soon as possible, so they won't be immigrants ' out of status', but people are not deported, unless they break the law, I believe.
What sucks after the I-94 is expired is that you can't apply for a SSN, and if you did not before then, you have to wait until you have the EAD to apply for one.
Oh ok, did you have any problems applying for AOS ?? We are at 7 months post marriage at the moment. We might try getting a loan to get it over with
He will not be denied AOS - no reason to. But if he is somehow caught by ICE, may be detained.

Hi guys , I feel like I've fallen off the wagon with this visa and all the steps I had to follow once he was here
We got married in the 90 day period. But because neither of us worked , saving up was harder then expected. We wanted to petition for everything together so he could work and travel as soon as possible which is $1070.
First he ended up in the hospital and having surgery. Then he was recovering and got sick and had to go back for another week. Our savings vanished pretty quickly.
Now we moved into our own place (finally) and of course that are our savings once again.
So I'm concerned cus I know his I-94 expired in November and I was reading stuff online that says he'll get deported or denied residency for taking so long to submit his AOS
Can someone tell me if this is true ?! I would hate for it all to end like that after all our hard work

I know I've been gone forever . It's actia been 6 months and I have dived into being a wifey and mom . All is well except for hubby had a surgery but he's much better .
Anyway ,
I am finally filing for AOS (I know super late but neither ine was working so saving money up was hard) ... I have everything ready but I can't seem to find the visa number .... Where is it ?
I have the alien number and the I-94 number but I'm not sure what the visa number is and of course I don't want to put the wrong one
A quick answer would be awesome dice we are hoping to send the papers this week before Friday

Hello to all ,
I've been a bit lost but all is well. My fiancé entered U.S less then a month after the interview. He was only asked 1 question and was out of the airport rather quickly thank God.
We got married June 13th... And now want to know what to do or where to go next ??
I know he needs to apply to adjust his status but how exactly ? Is it another application like the K-1 form ...

K1 visa is a single entry visa. He cannot go back to his country until after he adjusts status and gets an Advanced Parole for travel. Maybe your family is not wanting him to marry you and stay in USA.
Haha no that is not the case . My family is confused because they know that with visas you always buy a round trip . Also when I bought the ticket , it said he would have to show proof of return

One way is fine. They might ask him at the airport which visa he has. He needs to tell them it's a K-1 and he should be fine.
Also show them the visa stamp , as a Jetblue employee asked for my fiancee DS-160 for some odd reason. She showed her the visa stamp and she was let in.

You can let them know as soon as possible but from experience I wouldn't change your mailing address .
I moved before my NOA2 and called to change my address. My service center took 3 months after I had gotten an RFE to change my address. It delayed everything so much but luckily my congressmen got them to do their job and my address was changed

I know how you feel , mine was received July 6 but I haven't received a text or email either and the check hasn't been cashed.
my thoughts to you is to just wait it out . This whole process is about waiting. Remember that they were closed July 3-July 5. They are probably a little behind. You'll receive you're NOA1 when you least expect it, give it a few more days.
And I've learned not to compare my case to others because EVERY case is different and that will just drive you crazy
