    HAHAHA I was coming back to edit my post but will not let me now... I was incorrect about the 50% thing (I was looking at claiming a dependent earlier which I can not claim, Sorry)
    Straight out of the text book...
    Nonresident Alien Spouse
    If your spouse is a nonresident alien, he or she must have either a SSN or an ITIN if:
    1. You file a joint return,
    2. You file a separate return and claim an exemption for your spouse,or
    3. Your spouse is filing a separate return
    Married Filing Jointly
    1. You were married at the end of 2013, even if you did not live with your spouse at the end of 2013
    2. Your spouse died in 2013 and you did not remarry in 2013
    3. You were married at the end of 2013 and your spouse died in 2014 before filing a 2013 return
    A married couple filing jointly report their combined income and deduct their combined allowable expenses on one return. They can file a joint return even if only one had income or if they did not live together all year. However, both person must sign the return.
    Nonresident aliens and dual status aliens
    Generally, a married couple cannot file a joint return if either spouse is a nonresident alien at any time during the year. However, if you were a nonresident alien or a dual-status alien and were married to a US citizen or resident alien at the end of 2013, you can elect to be treated as a resident alien and file a joint return. See Pub. 519 for details
    Married filling separately
    Be sure to enter your spouse's SSN or ITIN on Form 1040. If your spouse does not have and is not required to have a SSN or ITIN, enter "NRA"

    Ya, I think the weather delayed them. Mine also took about 1.5 - 2 weeks to mail. They finally sent it off this week. Hopefully yours will also be sent soon.
    My wife also plans on calling the embassy when the package arrives, to see if she can get an earlier appointment. Most people have said that only the fiance visa applicants can call and get an earlier appointment, BUT the lady she talked to yesterday said that she could (and she emphasized it was a CR-1). So I guess we'll just wait and see...

    I understand the need of peace of mind. We too are in need of it. We just checked our status and it seems we are now in "Administrative Processing."

    There is no money, per se, if you are thinking about the visa application fee. You do this at local CitiBank in El Salvador or you can do what we did: pay with a credit card. The link sends you (the applicant) to a secure paypal site. If you do use the pay by credit card option, make sure to put the same email you used to generate the Visa Application. Furthermore, you can decide to create one email address for both of you, and use it for the entire process. This way, both of you can access the email account.

    The specifics documents that are asked for depend on the circumstances of the case k1 or k3, in general, these are for K1. Pay close attention to "what to send your fiancee..." Here is the link: http://www.visajourney.com/content/k1guide
    Apparently, every case is different. There are VJ members that have gotten approved really quickly and some that wait for months. The best thing to do is scour the VJ site for helpful hints regarding documentation, and being prepared prior to your interview. By the way, once you have paid and filled out the visa application, you can set your appointment time. In order to do the medical exam, your fiancee will need to have the letter from the embassy granting permission to do the medical exam. It cost us $380! And my fiancee is an ER nurse with all her immunizations required by the medical profession. We were shocked! Be prepared to spend money.

    Amnesty (The same as) - You adding a stranger to your house deed and tell them they can live there with you
    USCIS placing priority on "illegals" (The same as) - Telling a stranger to eat your food first before your own children

    I think you should not file. Instead send a letter that says "When the government fixes immigration so you can be reunited with your family in a timely manor. You will pay taxes."

    I got mine today as well. my CC was on JAN06. From what I've heard and read, my embassy doesn't reschedule to an earlier date. That being said if you make a request for an earlier date and somehow someone cancels their appointment they could ask you to come in. very slim chance but a chance nonetheless.
    Hope we get our IL date next week.

    You have to prove that there is a family relationship between you and your relative. If you are filing for:
    1. A spouse, submit the following documentation:
    A. A copy of your marriage certificate."
    Definition of copy:
    "Copies. Unless specifically required that an original document be filed with an application or petition, a legible photocopy may be submitted. Original documents submitted when not required may remain a part of the record, and will not automatically be returned to you."

    Personal experience... A lot of you seem like are starting to get ready for submitting AOS or IV packages. Please read through all the posts. I recommend even going back 3 months of NVC threads and reading. 3 hours of reading might save you 20 days of replying to a checklist. It personally saved me from getting one. Just read and see what people got checklists for and do not make the same mistakes. If you happen to get a checklist, please share it so others will not.

    Strange... You should have received it since you got your NOA1 in email unless there is just a glitch in the system (which possible could be) You can..
    1. Check your email spam folder
    2. Call and talk to a tier 2 rep and request the email notification (I always say tier 2 but a tier 1 might can do it)
    But it might be a waste of time to request it because your hard copy should arrive soon though.. If it says approved online when you check the status then I would not worry to much

    Little tip paying and sending documents for you really pathic people like me that that believe one or two day wait is another day I can not have back.. This is my personal experience so may be different for others.
    1. Check payment portal 3 or 4 times a day
    2. Pay ASAP but make sure you enter your correct bank account and routing number (there has been nightmare stories of people not doing this)
    3. Have the receipt and cover sheet emailed to you (for your records and able to print easier)
    4. Check your bank account frequently (mine showed a ACH hold of funds which gave me the green light to submit my packages)
    5. Soon as you see the funds removed from your account send the package overnight with tracking (The very next day the payment will show paid)
    6. Check the tracking. (The day they sign for it... The system will show you sent mail for your case 2 days later and that is when the clock starts waiting for review)
    Tip: People mailing overnight packages on Friday (They will not receive packages on Sat or Sun because they are closed!) Tell your mail carrier you want it delivered on Monday. (I put that as part of my instructions and guess mail carrier did not read the instructions and delivered both days Saturday and Monday)
    The worst horror story I read was about this person that paid but did not have enough money in the bank. The person sent the package immediately after getting the cover sheet. The payment and package was rejected. Then the person went to pay again but the website would not let them. Then they had to contact NVC which contacted tech support. Short story: HUGE DELAY.... My advice is to make sure funds are in your account, use the correct bank account numbers, and ensure the payment is actually being taken out of your account before you submit the package.

    You all are so funny when it comes to illegals and reading online or watching news about it.. I'm in the south and illegals are becoming a way of life because of the lack of enforcement with laws.. Do not believe everything you read because "studies" or "news" are not accurate..
    1. Young illegals brought here or born here.. The whole family is still here and the whole family is illegal
    2. Marry just for visa.. Yes it's true in many cases
    3. Illegals pay taxes.. This is far from true on most accounts because none will pay taxes because it is the same as telling the government your illegal.. BUT with some jobs that require SSN then shared IDs are used so a minimum amount of taxes are payed in this case.. They usually file exempt while paying SS tax, Medicare, ect but not federal or state..
    4. The illegal immigrant laws are not enforced and when they are enforced by each state in deporting illegal immigrants or trying to include things like biometrics for employment the federal government claims it is "unconstitutional" so there is very minimal consequences
    So to be here illegal is not perfect but it is not very difficult.. And there should not be a double standard and laws should be enforced to the fullest.. If a person breaks into my house (young, hungry, old, poor, or rich) I expect them to go to jail.. No double standard!!

    It's no bother.. I enjoy helping or sharing my experience.. I actually have not recieved anything in the mail from NVC.. They have only emailed me.. I called everyday to get my case # then when I finally got the case #... they updated our email address for me and my wife over the phone (which they already had for me but not for my wife... we used same email for both of us).. After I got my case number I try logging into both payment and online forms website.. I got error message (saying terminating my case) on payment portal but on the online forms I could do the DS-261.. After submitting the DS-261 everything goes sooooo fast.. Be prepared right now with all AOS package and IV package, check online a lot, and stay with it... Hard work might can save some of the waiting time..

    Well anyways.. If your worried about proving domicile in the country then you probably can't..
    My suggestion is to determine truely where you want to live.. I can sense both of you thought of staying in UK but also going to US..
    1. Make a decision where to live
    2. If you choose the US then the citizen needs to prepare legally. (Lease agreement, job offer, bank accounts, financial responsibilities, ect) This is usually easier if you are in the US.
    3. Not only try to gather documents to show "reestablishing domicile" but also proving "proof of domicile" to guaranty no problems.
    Some people have no problems with very little and some have problems unless they actually live here.. Remember they want proof (written contracts) not promises like Obama gives or stories how you was shot with Cupid's arrow and can't spend few months away from each other to prepare..
