Thank you so much for those links. We phoned the auckland consulate during their phone inquiry times from 2pm-4pm and spoke to an amazing lady named Ivy, she helped answer a bunch of questions we had.
Turns out they do have DCF but only use it for emergencies such as life or death!

Thank you, that was very helpful. I suppose it really does come down to timing. I have a lot of issues with geographical location for both me and my partner. She needs to return to the US to begin new courses and will be moving away from her home state. I'm unsure if this will affect things further but I will look into it.

We were happily married on November 25th in Zhengzhou, Henan, China!
Had a nice honeymoon in Hong Kong and Macau and had many dinners with her parents, friends and colleagues. We will celebrate my birthday next week together with friends and family, it's so great! We are so happy together, sometimes I still wonder if it is real or just a dream!
I took off a month from work for the wedding and honeymoon, in fact I am still in China now, I'll be home on the 21st of December. This time I brought a nice camera, laptop and a printer. I will have her sign everything we need for the spousal visa and bring the originals home with me. We have everything that we needed to be translated and notarized so that we can send off for the spousal visa as soon as I get home.
It is so great to be spending time with my baby, but she is feeding me too much great Chinese food, I think I gained a few pounds since I've been here.

Well my baby agreed to get married in China!
So we are planning a wedding now.
Just got to get a few papers together and a new visa. I could be ready to go in a week.

Originally I planned to do it all myself. My fiancee is always on my case for being wasteful (sorry I'm an American
) so she thought there was no need for a lawyer. I did some research from this site and many others and had it 99% together when I ran into the Chinese mailing address thing, the Chinese home address thing, the forms just made me not feel 100% that I was doing it right. I worked hard all of my life and now make great money and the legal fees were just a small thing in my opinion, what was most important was to not get a denial letter. So I hired a useless lawyer without researching the right lawyer for our situation...
(Chinese baby facepalm)
We have some issues that can cause problems for K-1 once we hit the consulate, leaving us no room for appeal and another 6-8 months wasted It's risky and I don't want to waste more time. Going for a spousal visa on the other hand gives us more options if things get hairy at the consulate.
Besides, we have not met in a year now and any excuse to go to China is good enough for me.
Marrying my baby in a couple weeks from now is icing on the cake.
Leaving my new wife behind in China is going to suck though.
This time I have an attorney that can explain things in her Chinese Henan Dialect and it is just so much smoother having an experienced lawyer in our corner this time. My baby speaks English well 99% (I changed her British accent closer to my South Louisiana accent), I have learned a little Chinese (working on it) but there are still little pieces here and there that need a little explaining sometimes. Having the attorney that can speak to us on Skype in both languages gives us a feeling that we are not alone in this, it is buying a piece of mind and that is worth it to me when I am looking at another year of waiting.
It's a tough decision, but money is not an issue and I'm trying to leave myself options at later stages in the process, and I miss my baby.
Good on you for firing your lawyer why have someone who cannot do the job properly especially in a process like this. Good luck with your CR-1 I hope it goes a lot smoother than this process cannot wait to follow your progress, your a true southern man mine is from West Virginia living in Tennessee I do not know what my life would be like without him in it

My fiancé and I did not read the forums or instructions properly either with our first petition back in 2012 we sent our I-29F in without supporting documents and got an RFE

Appeal is just wasted of money and time. And even so he could try, the OP should know why the petition got denied at first place otherwise he will stuck in limbo.
I agree appeals can take up to a year and cost more than the I-29F petition, once OP gets the denial then refile would be the better option

I am so sorry this bought a tear to my eye as I know the denial feeling all too well, do not give up my fiancé and i were denied Dec 2013 refiled April

Our 5 year journey has ended successfully !
We met in 2009 and I filed the first petition in 2010 which was approved after 51/2 month at CSC, however the K1 was refused after
16 looooong months in AP.
Petition was returned, I fought for reaffirmation like a trooper but USCIS let it expire in storage as usual.
Time was wasted with that battle.
Re filed in 2014 and CSC approved the petition in 58 days.
NVC transferred our case to the wrong embassy and it took about 2 months to get it to the correct consulate.
Interview was Oct 22.
Very courteous CO, polite and professional, unlike the rude CO we had the first time around.
My fiance was asked about 35 question for an hour with several repeat questions.
A fresh police report was then requested even though the current one had not expired.
He also requested a certified divorce certificate which I had definitely already send (frontloaded in petition and again for interview).
He said we will be in AP and awaiting the additional items but not to worry it would not be as long as the last time.
I was in contact almost non stop the entire night with my fiance on skype right before entering the embassy
and after the interview we talked again.
I finally drifted off to sleep and a couple hours later the phone rang.
I usually feel like a bed-head-grouch-in the morning before my first cup of java and let it go to the voice mail, especially
after being zombiefied and sleep deprived and fretting all night.
I felt an urge to answer and was so glad I did.
"Hello this is XXXX.....from the embassy and would it be ok to ask you a few questions...."
I shot straight up in bed and was wide awake and (how I don't know) switched to my professional voice. STOKES interview was all I was thinking.
He also said he could see the love between us from our photos but had questions.
I kept on babbling more than needed and he had to interrupt me a few times.
Hey...here was my chance and I wasn't going to let go convincing this guy that we are the real deal.
The next day I received an email that the K1 was approved, no new documents needed and for my fiance to drop the passport off for the visa.
Today I received an email for him to pick up the visa and the ceac online status said ISSUED.
Yayyyy ! I thank God first of all without whom I could not have prevailed for so long and who held me up when I was down,
my friends and support system and VJ was a huge help every step along the way.
I had told my fiance even if we aren't approved this guy is really very nice and professional and it goes to show you that
CO's don't have to act obnoxiously rude to dig and ask hard questions.
It can be done with tact and respect as it should.
This journey was the most difficult thing we had ever done and he got high BP out of it and I got digestive issues from all the stress.
AP was the hardest, the black hole of an abyss, unknown and frightening, topped off with the disappointment of the refusal and return.
He asked us why we hung in there so long and why didn't we just look elsewhere for an easier relationship after all these years.
My answer was because I am not a quitter. You just don't give up because it gets hard and you don't turn your back on your love
because things aren't going as smooth as you expected.
You stick it out ! My fiance was asked the same and said :" I could never leave her, I am fully committed because I love her so much."
My encouragement for you who are still on your journey and having a rough time, hang in there and keep on keeping on
one day at a time.
First filed K1 refusal and another CO's statement after I confronted her on one of my visits while in AP :
I asked what was the problem and she replied : " I just have a gut feeling and I don't think this would be a lasting marriage."
No factual evidence at all but she based her refusal on her gut feeling which may just have been a bowl of beans she ate that day who knows !
She wanted more evidence and we supplied 12 pounds of it to which she replied "I am not reading all of this I have no time for this".
I asked what evidence would she like to have and she replied : " I can't tell you that...convince me."
Seriously ?! It was all a nightmare. My fiance tried to tell her how much he loved me and she sternly told him to be quiet.
So how do you convince someone who doesn't allow you to talk and refuses to look at your evidence ?!
Current K1 : CO said you sure do have a lot of evidence but I understand why because of your previous experience.
I front loaded 600 pages of quality evidence spanning the relationship from the beginning to current,
various methods of communication to email exchanges with the previous CO, senators and congressman.
My gripes with the process and email to the CSC director and a 3 page relationship timeline
plus the previous filed petitions.
I then send a copy of it to my fiance to drag it all to the embassy.
At first they said it is too much we can't take it but he insisted that they take it and they did.
The assistant had to hand carry all of it from across town, my fiance can't
cross the border into the main embassy of the city.
It took me days to process that we were approved per email the next day, it all felt surreal. I couldn't even post it here yet.
I wanted to wait until the READY online status changed to READY OPEN, then from the still scary AP (issuing ap) to ISSUED.
I was still waiting to exhale.....still waiting for the next bomb shell to drop
on us.....well I exhaled now and we are so happy to begin our lives together under one roof.
Sweet success.
I thank God, who is my rock and strength, for victory in this very long battle.

Thank you my close VJ friends who were there for me year after year, on the phone and online,
even after some are now looking to ROC already and we started the journey at the same time, we will catch up !

That is great news isn't it a good feeling, my fiancé and I filed June 2012 ours went to Vermont RFE Dec 2012 he had to include letters from family members saying they had met me July 2013 a letter to say we needed a letter re written and dated sent it back got lost in the system Dec 2013 denial due to lack of material evidence of our relationship. We refiled April and finally got approved Oct 2nd, good luck with the rest of your journey

We got an RFE it was for my fiances birth certificate missing which by the way was sent we skyped each other the day he was sending off the petition and went through it together. This is a difficult and frustrating journey but you gotta have patience and know in your heart that this distance is not permanent, you will get your NOA2 soon. Good luck

Ha ha that bit there gave me a right giggle, im the beneficiary last year on a visit to my fiancé I drove his car from the local store back home (country road) kinda weird coming from a country where we drive on the right hand side. Anyway I have been informed it will be a long time before I'm let loose on the highway

Its hard to say my case was created with NVC October 16 and left October 21st to the Embassy packet 3 was mailed out to me October 23rd I received that in the mail yesterday

Can you go on the consulates website and see what they require for packet 3. Once I go onto our consulates website in the search box I type in k1 visa packet 3
Packet 3 arrived in the mail yesterday I have to send back the DS-160 and another form to get my interview date, I am about to head off and post them now. Have sent away for police clearance and my fiancé is in the process of gathering the affidavit of support forms together to mail along with his original divorce, cannot believe we wait all these months with USCIS and then this next process seems to move so fast. Our case was shipped out of NVC on the 21st as well, but it still shows in transit on CEAC site, the hypothesis is (from general consensus and different peoples analysis, no hard fact here) that they send the cases in batches to the consulates. So depending on how cases many they are sending dictates is how often they make shipment to a particular consulate. It could be in the mail room at NVC waiting for a large enough batch to ship out. No one really knows from what I have read.
Oh i forgot to say when i checked it said case ready really not sure if its at the Embassy already the lady at NVC also asked for my email address i speak very clear English but really do not think she understood what i said i had to correct her 3 times. I guess i just wait for packet 3 to arrive in the mail

I called NVC Oct 23rd the lady told me our case was no longer with them it had been mailed to the Embassy the 21st I used the number she gave me when checked I too typed it in Non immigrant but when I changed to immigrant it came up, so now its just the waiting game I cannot imagine they send it as priority LOL

Most people when submitting documents such as divorce decree to USCIS submits photo copies and not the originals. Its also stated on the I129f instruction that you may submit photo copies unless specifically asked to submit originals.
Some Consul will verify the copies you submitted to USCIS by asking to see the originals so its always good to be ready for that. Now, since you sent your originals with the petition hopefully it didn't get lost.
Just incase its always better to prepare for the worst.
I didn't send my original copy to my fiancé I took a copy and sent him that but I have a feeling he sent his original. Since its become so official I am feeling anxious about this process I do not do well with interviews so I am just making sure I have everything prepared to send back when I get packet 3

Our case was shipped from NVC to NZ US embassy October 21st I have decided to do some reading on here of what the embassy requires I have read that I have to send in mine and my fiances original copies of our divorces, the confusion is why do they need them when they were sent with our I-29F petition and the information will be sent to them with our approved petition
