I am in Texas and my form was sent to the Nebraska center .. I already got my hard copy in the mail . And have checked my status online and it says Initial processing or something like that .. Does anyone know how long it stays in that process before it moves onto the next stage ?? Any help would be great thank u
And sorry am new to the site so still have no clue what I am doing here lol
Unfortunately, most likely the answer is "forever." Some quote the whole process from filing to visa will be about 2 years now.

What do you guys think? We have a brand new Congressman here in NE Oklahoma. Thought it might be worth a try. Anyone have any constructive comments? Thanks.
Dear Congressman Mullin:
My father was an Oklahoma State Senator in the 90's so I know how difficult it is to get started during your first term. So much to learn huh? Quickly, let me say that I am one of those that voted for you and I have watched as your business has grown as I drive by your home on my way to work... you must be very proud – I know that the majority of us in NE Oklahoma are.
And now to my point: There is a huge wrong being committed upon a large group of American citizens that you may not be aware of and I wanted to share what I know with you so when given the opportunity you will be aware of what is happening to us.
Immigration reform is a big deal right now and it is wonderful that the United States of America has the will and the means to open doors to help non Americans to better their life situations or to help them after a disaster. As you know, common thought in Oklahoma is that “The Dream Act” was enacted solely for votes but I want you to know my motivation is not to stop helping others.
What you may not know, as they, the US CITIZENS and Immigration Service, hide it very well, is that these people are being helped at the expense of the US Citizen that file the same petition, for the same status as those that America is trying to help.
Right now, Congressman Mullin, a couple that have known each other for just a few months and file for a K1 Fiance Visa can get through the USCIS step in just a few months while others that have been married for 8 years or more must wait 10 or more months because we share the same petition for DACA, VAWA and those waiting with their spouses to get to the place so they can file the 601 waiver. And this is just the first step of the visa process, the backlog will continue through the second step (National Visa Center) and then get slightly better at the third step, the Embassy that will interview the beneficiary.
What this says to myself and others Sir is that those that chose to stay here illegally and those that haven't built a relationship commitment to the point of marriage are being served before those of us that chose to follow the rules and/or have shown a higher level of commitment. Even Legal Permanent Residents looking for the 601 waiver are being served quicker while they get to wait together.
There is a group of citizens that have written several letters to USCIS and others that explains the situation better than I can so I will include them with this letter. In these letters are the graphs and charts and numbers from the websites for USCIS and the American Immigration Lawyers Association that strongly indicate that the numbers are being manipulated. For instance, on the USCIS website it shows that they are currently working on petitions on or before February 13, 2013 while every day we see approvals for months as late as July (that haven't been expedited and/or are not from the Phillipines).
I would really like you to read the attached letters to see what has happened is that even though we have paid the required fee for the requested service, all recourse or opportunity to inquire about the status of our petition has been taken away. They also claim on their website that they adjudicate petitions in the order that they are received and I can assure you that is not even close to the case. When I made my application the expected wait time was 5-6 months. If any other business would behave in the same manner there would be some recourse for us. USCIS has rigged the numbers so that we cannot even speak to the ombudsman.
Congreman Mullin, we need your help. Won't you please look in to what is happening to the citizens of the United States?
If you would like to discuss this further, feel free to contact me at XXX-XXX-XXXX.
Sincerely,
My Name

The typhoon in the Phillipines was horrible, the earthquake in Haiti was equally horrible and I am glad that the US opens a door to help those in the world that need help.
What I don't understand why it continuously comes at the expense of the law abiding, US Citizen?
-
Hey everyone - are all your status on USCIS site still stuck in "initial review"? My priority date is August 16th and I have not heard anything moving yet. At what month should we contact our senators and congressmen on the matter to have them inquire on the status of our cases.
Thanks!
Mine is exactly the same. PD August 15. Gathering dust at a very expensive storage facility in Overland Park, KS.

I know it seems stupid to you and many others why would you come and not return but stop for a minute and think like the interviewing CO. What will you be presenting to them to convince them you have every reason to return?
They see a man saying at interview "I miss my wife". And he has no job part time school not much to convince you will return.
And frankly you have ever reason to stay in the US why else are you filing a petition to immigrate. See you have already shown your intent to immigrate. And unfortunately many before you came to "visit" and never went back so you and I and many others have to pay for the sins of the ones before us.
All you can do is try.
That's the part I don't understand. By filing the petition we have show our intent to immigrate LEGALLY. Why would we waste the time and money already spent to live illegally for the rest of our lives?

Who is in charge of the August spreadsheet? As long as there is one for August of those hoping like crazy to be transferred soon, can we add my name to the list please? Lisa and Shamo, PD Aug 15

Count me in Kaylara.. My husband too.

Probable she is so excited so can't come here to say anything happy for her though
For real??? AWESOME

All I have to say is, they better get their asses in gear and start catching up with the transfers that are about to be 60 days old... Come on now.
Yeah, once that 60 days passes and then they tell you to wait 180 days (or something else equally unfair and infuriating) it's not going to be pretty around here. There are a couple of you ladies on here that I wouldn't want to be the tier 2 officer that gets your phone call.... Come on! I filed after you and I can't get any forward movement until you guys move on to the next step....
My file is still gathering dust at Overland Park

YAY ! I just received a response from the Senators office JUST NOW. I sent her a message last night when I was feeling so sad and depressed.
Jennifer,
I did get an update on your pending I-130. It was transferred to the Texas Service Center. The TSC provided the following update to our office:
This I130 has been assigned to an officer. A decision or some type of action will be made within the next 30 business days.
Thank you,
Rachel

Have a great time with your hubby, Yulieth!
You too enjoy your visit Mrs. Blueberry. So jealous!
-
Congrats....
This is for an F-2A. These get approved faster up front but have to wait for a visa.
Thank you my friend. But congrats to the approval.
-
what service center ?
If it is CSC they are hours behind the east coast
Not sure ( off hand) about the time in Nebraska.
Texas is only an hour behind us
Nebraska the same... one hour behind the east coast.
-
we are so happy, we received an email from uscis that our NOA2 was approved on 12/16......our pd is 8/13/2013 and case was transferred to NSC on 9/20/2013
OK you have my attention now. Please tell us more... expedite, DCF?, anything special? You have the same PD as I do so now I'm really excited!

"Well, should I take them up on their offer and talk with them in person?"
A B S O L U T E L Y !

I wish you much luck with your letter Kaylara. Fingers crossed for you.
I'm about ready to give up on the whole process.

Thanks for your replies. Just checking... Who knows, they could start up the K3 again. I feel it is more likely than the government adding more staff to get caught up.
-
Really? 85 people read my question but NO ONE can answer? Really?
-
I have a couple of questions about the required evidence on a K3 filing of the I-129F petition.
http://www.uscis.gov/sites/default/files/files/form/i-129finstr.pdf
About the middle of page 8, under the heading: 9:If Filing for Your Spouse (K-3), What Documents Do You Need to Prove That You and Your Spouse Are Legally Married and That Your Spouse is Eligible for K-3 Classification?
If your beneficiary is your spouse, you must submit the documents required in Item 1., 2., and 6 of the Requirements and Documents section of these instructions, but may omit the documents required in Item 5.
We are just a plain jane couple, no IMBRA or arranged marriage so how can I provide evidence for
Item 1: What Are the Requirements for Compliance With the International Marriage Broker Regulation Act (IMBRA)?
Item 2: What Filing Limitations Does IMBRA Place on K-1 Non-immigrant Petitioners?
Item 6: What If a Document Is Not Available?
We have visited each other twice in the last 6 months, we are married, I have pictures, affidavits and all the various passport stamps, receipts, boarding passes, all the things I believe will prove our commitment? I just don't want to make a mistake and I am looking for someone to say that I am misunderstanding these requirements.
Can someone offer their opinion?
Thanks.

OK guys, I'm a lurker ... but a faithful lurker.
Today there wasn't a lot going on at work so all 15 of us (even the owners) emailed and faxed most of the day! Thanks for all your hard work!
-
After reading this decision, everything is possible, lol. I am speechless here

Unbelievable. It definitely appears it does not pay to follow the immigration laws of this country. Its all of this fraud, and the acceptance of this fraud that makes us have to spend our lives apart from our loved ones today. Its getting incredibly hard for the good guys to stay good.

Its really awful. All this time wasted on requesting things that aren't required and saying you aren't legally married without checking first is a waste of the time they should be spending on our approvals. They seem happy to use any stupid reason at all to delay things. But why?
