The biometrics is for the i485 not the i765. Therefore u will receive it at some point. I did my bio before I received my ead they even took my photo but my card say finger print not available and it has the photo I send with my application not the one they took at the center. Don't get scared u will get it at some point at least before ur aos interview.

Howtosurvive and Irara I also got EAD first and not got biometrics. USCIS is approving EAD first seems. if we learn howtosurvive timeline than we can wait accordingly and figure out our process is normal or not.

I got my bio before my ead. Even though my ead doesn't have my finger print. The bio is for ur aos. I don't think its abnormal thought but u never know so ask ur lawyer to question vsc abt it.

On the status check thing on USCIS website says that i should get biometric schedule notice within 30 days of submitting my application(I-495, 360) and i have not recieved anything so far. it has been about 35days now..

Is this normal ?

Did u submit ead application? If not maybe that's y they instantly approved ur pf and isn't in a hurry to send ur biometric date since u will need ur pr for public benefit. But if u have a i485 on file why not submit a ead app so u can legally work?

We got married on august 2006 he divorce me on summer 2011.. I do not have the copy of the title but I do have letter from ensurence company with that house Addrees and my name ... As sandranj said its always better to have more paper works than less so u can get those letter from family and friends and take it just in case. Make a copy of ur drivers license and bring the mails u have with the address. Your marriage was roughly fives years that should proves bonafide marriage and if u have a restrain order or police report showing where the incident happen which is at the resident for it to be domestic u can take that to show cohabitation. But hun u sound like u have enough evidence to provide good faith marriage and that's key to USCIS so go with god and pray hard he didn't bring u this far to disappoint u. He saw all you have been through and he gives his strongest ppl the hardest battle. You have over come an abusive relationship it shows strength so have faith and bring all u feel like u want to bring and get ur GC. U deserve it!

Do u have a copy of the house title or bill or mail with ur residential address? If u do that should prove cohabitation. How long y'all been married for? How old us ur son? Time makes a difference. If y'all had a long history it proves bonafide marriage. I'm happy for u good luck. Do stress too much go down on ur knees and lay it in god's hand he will guide u through.

do you get biometric appointment for I-765 Ead??

You will get a bio most often before your ead but its not for the ead its for your aos app. Your ead will saw fingerprint not available and will have the photo u mailed not the one you take at the biometric center. At lease that's how mine is and the lawyer explained it to me because I was curious and I had to do a walk in because I was pregnant so he was trying to reschedule my appt but I didn't want to caz I thought it would delay my ead hence the question got asked.

I hope it never get to that. Don't wanna deal with CPS.

btw, if u were ever arrested on false charges, and even if u have Court's disposition (with original of the seal) - make sure the state has entered such disposition in their record, and FBI doesn't have a (erronious) criminal record for you. Such silly state's error is not easy to correct, and may preclude any immigration application

I was never arrested. Only ever been to court on a civil charge for eviction which was eventually dropped. I was never charged in any of the domestic cases because he beat me up real bad 90% of the times. He even threatened some cops when they came to the house. He's ludicrous.

I'm staying in my little corner until the lease expires so I can move out and get my own place. I'm job hunting even though my daughter is only two weeks old. I had to resign my job Caz he threaten to call ice on me while I was at work so my lawyer advised me to resign. I'm staying positive and optimistic to get through this perilous journey. I got my ead so I can legally work now.

Not all of us. Im waiting long time. In fra days it will be 2 years since i filed for VAWA. Last RFE they recived on 10/31/2012 and since then NOTHING acsept Prima Facie extentions and EAD extentions. Its driving me creazy. Even thinking of giving up everything!!!

There's no need to give up u r closer to the end compared to beginner like me. You will soon get your approval in the mail or seek congressional help as suggested by a member. Hello Sandra would you please tell me if you have hear anyone whose processing period had have to begin again after a RFE??? My case was updated today and they said once they receive response to the RFE a processing period will begin... I am so sad I have been waiting 12 months already... I thought I was 7 away from a decision...

I know u asked for sandranj opinion but I guessing that once they rfe from u they put ur file on pause until they receive something in regards to the rfe then they return to ur file in the order of the adjuncators rfe. Scenario: ur adjuncator rfe five ppl and u were his third once he receive the rfes and he return to those files he will get to urs third and if the person in first and or second still had not reply by the time he goes bk to the rfe files ur would be in first place hence the reason some ppl get approved quicker than others.

My lawyer so lazy, he never tells me anything. I always had to call him many times to figure out a little things like if he received my NOA. I'm worried if i pass the due date of Biometric because he doesn't let me know .

In abt 2 weeks. I got my noa Feb 22 and my bio march 8. Quick to me and my lawyer did the fee waiver.

Thanks everyone. Do u have to have commingling of finances when u share residence? I thought the fact u live together your commingling your finances. Like we only pay rent it includes utilities. I also have a joint tax return for 2012 just in case I get rfe for bonafide marriage. Its a no contact order. I called the cops so many times and if I called from the apt he leaves and if I leave the appt and call he never open the door when the cops come. One cop said I was trifling because his name is also on the lease not factoring the FRO. Its one sided. I'm very petite he's very muscular how can I abuse him. He never ever said I abuse him one judge read my file and said I was no match for him. We have several case in court. I know you have a child with him, but Uscis say you have to prove commingling finances and commune residence as well.Did you have a joint bank account? did you file joint tax return? .You should try to get an affidavit with the security guard that saw him battering you. File for divorce based in domestic violence. Did you file for child support? Find a good lawyer to represent you in family Court. He is violent and he should never be alone with your child.

We file joint return this year. I have a great lawyer very experience and assuring. We have a lease in both of us name we have bills at the same address. He on my phone contract. No he still living in the apt with me even though I have a restrained order he said he has no where to go and yes on the lease. I'm waiting to move in June when the lease end as to not mess up my credit any worst. Hi everyone I'm new to the site but have been reading the thread for the past week. I must say congratulation to everyone who have been approved and I wish endurance on all who are still waiting faith open many door so don't give up or give in a green card is the least if you have overcome abuse. The emotional aspects of the abuse is worst than the physical abuse caz time heal wounds not memories.

I have a case at VSC even though my journey just started I'm going to try and remain diligent and patient. Here's my story; Myhusband and I met in june 2011 we marry june 1,2012 exactly a year later. We move in in the middle of june to a brand new apartment with me being the lease holder since I had a better job and a good credit. The first week went well the his sister came up from the south to visit and that same they I went in his phone and realize he was cheating on me with a coworker. I confronted him and we got into a fight. He's 206lb that time I was 114lb. His sister walked in and heard him fighting me and part us. A couple days later I found out I was pregnant total left field since I just finish nursing school bought a brand new car and had a nice job, was not interested in a baby Caz I was just 23 turning 24. Anywsys he convinced me to keep the pregnancy since it was both of us first child so I did. By mid July the cops were called to my apt over 3 times Caz he was very violent and disrespectful to me. One morning I was getting ready to go for my prenatal check up and he woke up and started fighting me Caz I never told him in advance. He punch me up and slammed me on the floor and the cops arrested him. And I end up bailing him Caz I still loved him (still paying the bail Caz he refuse to pay it). On one occasion he beat me up burst my lips and lock both of us in the bathroom running the pipe while beating on me so no one could here I was almost 3months pregnant. I got a retraining order which he still continue to violate even though he was arrested. When I was eight months pregnant he came home drunk (24 years old) and started going through my phone there was a couple voice mail that I didn't listen and he wanted to listen them but because it requires a password he started to fight me Caz I refused to give him the password he beat me up so bad on Feb 8 of this year I still cry thinking abt it. He said he's going beat me up real bad Caz I always get him arrested I never cover for him. He spot in my face once and in my 9th month he started beating on me and I grab a knife insisting I was going to kill him if he put his on on me again. Thank good for Jesus I had my daughter two weeks ago and she's healthy and thriving. When I was in labor he call me the (b) word. So sad!

My case was filed on January 4 2013, got no on Feb 17 biometric on March 8 did a walk in Caz the appt was too close to my due date. Received Ead last Friday. I got a very experience lawyer with a lot of approved cases. All I do is give him my evidence and pay 1000 part payment. He knows that I'm the only one paying all the bills and I have no family just a aunt here. My mom died when I was a baby and my dad is a douche. I'm happy at the pace NY case is going and I'm prepared to wait been in American for almost 5 years just happy I can work legally even though I always had a job.
