My case was physical abuse. We were married for only one month when the abuse started. My affidavit was 2 pages, and to the point. I explained how we dw ll in love our court ship how much I loved him, meeting his family and my unexpected pregnancy and the abuse. I explained my hopes for my family future and I reminisce on good times. I explained it was not always volatile and what I wish would happen. Pics of my marriage ceremony and dinner and pics of my abuse. Police report and final restran order. One affidavit from my best friend and withness at my wedding. Our joint lease and my good moral clearance from the state. I'm happy and feeling bless. Nothing was special about my case. No rfe or anything. Haven't been to Jamaica in 5 years. Wasn't even thinking about going home this year but now it seems possible.

Lank is ur husband lpr or USC? If USC u can file i765 with i485 assuming it will be pending until i360 is approved.

I thought medical is for dependents 14 and older.

If someone didn't blatantly say that its fraud then u are judging them every heart knows its bitterness. Why didn't he petition for her? They were married he brought her here! No he wants to play big and embarrass her or try to control her immigration is fully aware of people like that. Especially if she came on a k visa like in her case. Something was cooking up in that house but Mr sad guy not saying the full story.

So why for VAWA case, USCIS does not need to interview the US Citizens for their side of stories but based solely on the "victim of abuse" side only?

To be fair, USCIS should interview all parties involved, right? Approve VAWA case if genuine and punish the guilty US spouse.

The pastor did not know verysadguy for his side of story when he wrote the affidavit for his ex. So I guess the pastor's affidavit is only one-sided too.

You can get your senator / congressman ...etc to write affidavits for you too if you like.. but how close to the truth do these outsider know?

I think verysadguy is not an abusive person, otherwise the judge would not award his baby daughter full custody to him, which is unusual for father.Courts tends to favor mothers if there is a young child involved.

How many times have you seen in this forum, when the immigrant spouses fake domestic violence against their US Citizen spouses, so that they could file VAWA case? I have seen plenty since I join here.

Obviously, this system has its flaws.

The court grant custody on many different basis and a very important one is stability. Very sad guy is established and has astanle home and go he knows what he told the judge. Vawa is not one sided because they require evidence of the abuse. If the is mountainous evidence why call some that is more than likely going to lie. When they passed the act they knew what they were passing. Abuser never admit yo an abuse and if they do the try to rationalize it. They had evidence that she was abuse, bona fide marriage, commune residence and what ever else evidence she produce. Immigration is no fool so let's not fool our selves. Abuse is abuse some people threshold is higher than others hence one instance of abuse may terminate a relationship while in others it takes death to end. I WS informed by a cop that they have respond to several residence where the abuser killed his victim and he tried to rationalize his action. U can't speak for him "is not an abuser" u don't know his ex side of the story. Some spouse like yo use the "alien" spouse immigration status as sabatage

It is those people who file fradulent VAWA case that give genuine VAWA cases hard time.

Their was a basis for approval! The io didn't rake up her file and say "u know what she's a scammer let me approve her". She had all the criteria for the approval and she was clearly abuse "her husband calling her an alien" on public forum. Now that's RUDE! Io can smell scam from a distance let alone right under his nose. Sad guy pls go turn that frown around and the fact that u hunt down to find out when she was approved find out how u can have an amicable relationship for the baby.
