    Hi everyone,
    A few weeks back I told you all about how my husband had written to his Senator's, copying the New York Times. Well, after both of us being interviewed Julia Preston, the NYT Immigration Journalist has written a fantastic article highlighting our - and yours - plight. It is to appear in Sunday's NYT, 9th February. It is also online. Pass this to all your friends and family and hopefully all our NOA2's won't be too long.

    I am so sorry you have to go through this, but I'm glad you have us to vent to and get support from. I can only imagine the struggles you've been going through, but is there no way to visit your wife or take time off work to be there for her when the baby is born? Do you have paternal leave you can take meanwhile this whole process is still going on? Maybe try talking to your employer about your issues right now, because they can't help you if they don't know your situation. It's better to ask than not try.
    I have never lived with my husband either, only been with him in 2-3 week intervals every few months for almost 5 years now .. and the longest I've ever been with him is 1 month. I know how hard it is being apart, we all do, and we always have to get used to being alone again after we/they leave and be "happy" just with talking to them on the phone/skype/whatever. But I had a thought the other day that I'd rather be sad missing my husband than be sad that I don't have anyone or be in an unhappy relationship, and that made me snap out of my self-pity party. I'm not gonna lie. I have bad days where I am just not fun to be around because of my mood, and it's mostly brought on by being so lonely, but I have more good days than bad because I make sure to talk to my husband everyday, and we laugh over silly things and talk about our future plans.
    I admitted to my husband recently that there were moments where I felt I was depressed and instead of wallowing and falling deeper into it, I decided to take action and said I was going to start going to the gym more often and maybe take up running to focus my energy on something I can control rather than something I cannot. So my advice is to maybe try and find a hobby that you enjoy instead of trying to only gain happiness from your spouse. Go out with friends and family. Get out of the house, because if your just go from work to home and only talk to your spouse and not really do much else (I was guilty of this), then you're going to get stuck in a redundant routine that will start to wear on you.
    I hope that this helps you and anyone else struggling. I didn't just get to this way of thinking rapidly .. it's taken me years to figure out a way to deal that worked for me.

    Welcome to the September thread. Right now we are waiting for USCIS to finish transferring July filers, then August.. and then September!
    Hopefully some time in February.. Hopefully.

    Savage, I think you should attach explanation--I believe it even asks for that, if there is something unusual. However, they may send you additional checklists--so be prepared for that. But, I am not an expert--this is just my opinion. I met the requirements with my standard income and also included additional revenues, but, attached explanation and also statements and copies of checks to prove it, along with the associated bank statements of deposit. As long as you are thorough and show the whole picture, along with clear explanations, I think these people at NVC are reasonable. Good luck!

    Hi everyone,
    Christmas is over, the New Year has come and gone and we are all still waiting!
    My husband wrote a really good letter to our Senator's and also copied in the New York Times. It would appear that the Senator did contact the USCIS and were advised that our Case is still under review. However, the NYT have contacted my husband and they are interviewing him this coming week on this situation that many of us find ourselves in. Perhaps some positive publicity coming up for us????
    My husband took a job back in the US, commencing 1st September. Our children, ages 13 and 14 (both US Citizen's) and I haven't seen my husband since August while we are waiting for our NOA2. I have previously had a Green Card but it expired in 2011 while we were living here in Australia and it cannot be reviewed, rather we have to reapply again! We are all getting excited here though as he heads down to Australia, arriving next Sunday for a two week holiday. We are all going to make the most of our time but it will be hard to say goodbye!

    You're not wasting your time. Call every day if you want. I call every day. Just know that some people are nice, and others can be very rude. Just ignore the rudeness, and keep on going. I can usually tell from the minute they say "thank you for calling NVC this is ..." whether they have a bad attitude or not. If they sound rude, I start off by saying "I know it's not been 8 weeks yet, and you may take that long, but I am calling just because I can, and my USCIS receipt number is ...." The rude people have stopped giving me the 'canned response' in return when I start my sentence basically telling them that I already know that. The nice people seem happy I called, and when I call and they tell me I still don't have a case number yet, they usually say "Well, is there something I CAN help you with since you've got me on the phone?" And they usually say "Just keep calling." Just like calling customer service with your cable/internet/phone/etc service, there are plenty of rude people, but that shouldn't stop you from calling for service. Just be patient.

    I had a bad night's sleep, too. It just sucks to wait another half a year when you have an approval. I will definitely keep making noise. This is ridiculous. My hubby thinks I'm being a bit over the top. He asked me if I've contacted the president yet. I guess he still has some stuff to learn about his wife. Because, he's on the "to write to" list....even if he won't read it. I'm contacting EVERYONE.
    Remind me..what's DACA? I'm so tired. Think it's really bed time. I hope you got a good night's rest, Blueberry!

    Someone called NVC today and was told not to leave anything blank, even if instruction say so. I myself use N/A and never got a checklist for using it.

    Perhaps since this N/A in all fields seems to be pretty common among everyone, it may be helpful to put that in the FAQs for the Dec NVC thread for ALL forms (since my checklist was not for the I-864EZ, but rather the I-864A). It may help prevent unnecessary checklists in the future.

    I think I also talked to the same person a couple days ago. Most of the phone reps I've spoken to in the last 6 weeks have been very friendly but the one I got a couple days ago was very rude and combative. I would describe her exactly the way you did. She ended up transferring me to a Supervisor but did it by cutting me off mid-sentence and saying very sarcastically, "just wait on hold". I know everyone has bad days and I'm sure the people answering those phones get bombarded all day long, but such is the nature of a customer service job, and since my taxes and petition fees are paying her salary I don't think it is unreasonable to expect friendly, courteous, and helpful assistance. The supervisor was friendly and helpful though. That was the first time I've been transferred to a supervisor and it did seem as if she had more information available to her. I'm almost sure that at one point she either went and spoke to the person reviewing my case or went and actually looked at my case file.
    Does anyone know if they scan all the documents for each case into electronic format or does everything remain simply a paper file?

    Just because that K-1 relationship was obviously a fraud, doesn't mean every K-1 relationship is not "fully committed". My husband and I were committed before and after our marriage. The difference is we now have a piece of paper telling people that, that cost $65 and took 5 minutes to receive.

    In the FAQ, it says
    " You'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US."
    ​So that's my understanding of proof of US domicile requirement pertaining to the I-864.
    Since my spouse (petitioner) is living in the US, we are not required to show proof of US domicile with the I-864 package? Am I right?

    My husband got me UGGs and shipped them to me last Wednesday. They just arrived in... Australia.
    It's almost funny, but not really.

    Hope everyone is having a great weekend and that next week will bring more clarity and/or some good news for all of us...

    Your wife can move to the USA at anytime as she is a USC. You have 6 months from the medical date, if your visa is approved, in which to move to the USA. Most of us do not complete this process together. My husband lived in the USA the entire process and I was in Canada. We were able to visit but there are some who don't even have that.

    When you call USCIS, do they say the file was shipped to NVC yet?
    You may want to consider contacting your congressman and/or senator to see if they can contact USCIS and NVC on your behalf.

    We always go to the CURRENT month, no matter when you started the process. So, while it was September, everyone was in the September thread. Once October arrived, everyone moved to October. Now that November is coming, everyone will move to this thread, November.
    So, to sum up, stay here Then, once December hits, we, including you, will all move to the December thread.

    It's currently taking up to 30 business days to review packages (according to the operators when you call them). If the packages have arrived at NVC, I'd suggest calling now and everyday (or as often as you wish).

    I forgot Visa B1/B2 Rules:
    tourism vacation (holiday) visit with friends or relatives (MEEEEEEEEE) medical treatment participation in social events hosted by fraternal, social, or service organizations participation by amateurs in musical, sports, or similar events or contests, if not being paid for participating enrollment in a short recreational course of study, not for credit toward a degree (for example, a two-day cooking class while on vacation).

    That is an offensive comment towards the people who are here for visa journey support. I appreciate the people who have been here to help and support myself and others on this page. If you want to start another thread, you can do so and invite others who agree with you.

    On a positive note....my AOS fee was invoiced, so I was able to send in my AOS paperwork today. Can't believe it! My hubby also got his police certs...at LAST! One more step down. We just have a form and one more packet (IV packet) left...before it's all sent off to the consulate for the interview.
    Whereas, I disagree 100% with that remark.

    I know this post I am about to write doesn't belong here but it's good information and we don't have a lot to talk since we are all waiting.
    Questions and doubt are still around about your spouse coming to visit the US while I-130 is pending. For my experience, it's possible, I didn't see anything written that prohibits it. My Wife came to visit me at the beginning of this month ( Oct 2-7) I know only 6 days , but those days were incredible. To see my wife after 4 months it's just awesome. ( I feel your pain and sadness when I read about 12-18 month separation, it must be tough) Anyway. POE was Miami, and this is how it went:
    CBP: Purpose of visit
    Her: To see my husband
    CBP: How long are you staying
    Her: 6 days (She provided return flight itinerary)
    And that was it!!!!!!!!!!!!! She was granted a 6 month stay under a B2 Visa
    Guys, Girls... It's possible to see your significant other, the lawyer I contacted says she can come as long she doesn't go over the time CPB grants her upon entry.
    I was freaking out, I thought she was going to ge the visa deny, or being sent back from Miami, but as long as you are true, have good evidence of doing this legally, and not intending to stay illegally
    I grabbed this from a document and gave it to her to show at the embassy and BCP
    9 FAM 41.31 N17 AUTHORITY TO CLASSIFY
    CERTAIN VISAS “B-1/B-2" AND AMOUNT OF
    FEES TO BE COLLECTED

    (CT: VISA-1034,-

    You may properly issue B-l/B-Z visitor visas to aliens with immigrant visa
    (IV) applications pending with the United States Citizenship and
    Immigration Services (USCIS). You must be satisfied that the alien’s
    intent in seeking entry into the United States is to engage in activities
    consistent with B-l/B-Z classification for a temporary period and that the
    alien has a residence abroad which he or she does not intend to abandon.
    While immigrant visa registration is reflective of an intent to immigrate, it
    may not be proper for you to refuse issuance of a visa under INA 214(b)
    solely on the basis of such registration, unless you have reason to believe
    the applicant’s true intent is to remain in the United States until such a
    time as an immigrant visa (IV) becomes available.
    We are planning a trip for this upcoming holidays, I let know you how this time goes. Sorry for intruding our post with this, but I thought you wouldve like to know and maybe try it as well, I believe we are really getting screwed with this waiting game, according to USCIS 11-16 months, I don't know anymore. But maybe you guys can shorten you distance and see each other for a couple of weeks, and live like a real marriage, like it should be.
