  1. Correct. As with any attachment sheet, you should include your A#, the form number, page number and question number you are adding the statement/attachment for at the top of the page.

    The new I-864 form edition now even includes places at the end of the form for attachment/supplement/extra space and details, Part 11 on Page 12.

  2. There is no example or format. It is a statement by you as to why you were not required to legally file that year. You were student and your income was zero or below the required IRS income filing threshold, so therefore you did not file that year. Write it out however you like. It is your statement of explanation.

    Typing the letter, signed and dated is acceptable, correct?

    Or could it be a general request letter of some kind ?

    Of course the certified marriage certificate is obviously needed but bank statements and photos ?

    We always advice no need to send those with the initial petition. Perhaps that advice should be re evaluated?

    Including the marriage certificate with the AOS is extremely important and the fact that OP didn't do that is possibly why they need more proof.

  4. Yep, apparently the three packets are sent off to different places for processing so copies of evidence are required for each one. And yes the I-797 can be a copy, I think somewhere in the instructions it says all supporting evidence can be copies unless originals are specifically requested.

    Note that the marriage certificates are original copies from the county office, not home made copies.

    I thought I read here in the forum that a photocopy of the marriage certificate IS acceptable. I thought it didn't have to be the original marriage certificate.

  5. The original DS-3025 will be with the rest of his medical documents inside the sealed envelope he hands over at his POE. They will be sent to the USCIS.

    You can write on the cover letter, and even include an extra statement to make sure they see it, that all the required vaccinations were completed and marked off on the DS-3025 at the K-1 medical and they can find the DS-3025 among the other medical documents in his file.

    Kay, my husband had to have another medical. Does he list the medical on the cover letter as it's own separate Item? Meaning, the medical is not a part of any of the forms?

    In Chicago, where I live, according to the city clerk's website:

    "Requesting a STANDARD marriage certificate

    Order one of five ways:

    Go to a local Currency Exchange

    Call (847) 759-8905 for Currency Exchange hours and locations in Chicago and suburban Cook County, or visit www.mycurrencyexchange.com.

    There is a $5 surcharge for records obtained at Currency Exchanges."

    So I wanted to see if there is a difference where I purchase it, via going downtown to the city clerk's office or a local currency exchange.

  7. Yes. The I-130 instructions simply state to provide a copy of your marriage certificate. And under General Instructions on how to fill out the form it states :

    Copies. Unless specifically required that an original document be filed with an application or petition, a legible

    photocopy may be submitted. Original documents submitted when not required may remain a part of the record, and will

    not be automatically returned to you.

    Do I have to go to the courthouse to get a copy or can I purchase the marriage certificate copy at the currency exchange?

  8. If you were married in 2014, then yes, amend it later. It won't really matter to the IRS, but it will matter for immigration, especially later for filing to remove conditions or if you want to get US citizenship down the line.

    My husband and I were married January 2014 and I filed my taxes "head of household" .

    Will this cause a problem later on?

    (I filed this way because he doesn't have a social security #, nor an ITIN number)

  9. Already answered you in a PM, but will post here for others to see and add a little extra info..

    You need to file before the year because a new medical is not required if you file within a year of that medical's date. If you went ahead and got a new medical now, then the new medical will then be valid for a year and give you more time to file. However, if you need wait until after the K-1 medical is expired, then you should probably get the new medical done as close to filing as possible because if they do not approve your case before the medical expires, then they could ask for another one.

    Thank you Kay! I'm thinking we will be able to send in all paperwork for AOS sometime in mid September. Do you think he'll be okay with the medical from ciudad Juarez October 2014?

  10. My husband and I (married January 2014) are about to start process for AOS.

    I know it states that a new medical exam isn't necessary as long as you file your AOS within a year.

    He got his medical last year in Ciudad Juarez Mexico on October 22, 2013.

    I'm wondering if it's possible to go see a civil surgeon to get his vaccines transcribed BEFORE the year mark next month and then hold on to the results until we are ready to send all the paperwork? (I just recently got hired at a job & need to save the rest of the $$$ we need for filing)

    Or do we have to file and send everything before October 2014?

    Any help GREATLY appreciated.

The info from the USCIS site about civil surgeons and the vaccinations(linked to below) are geared towards those getting their medical exam and vaccinations from the civil surgeon at the same time, and not those adjusting from a K-1, who have their medical exam done by a panel physician. You can have your exam done by the panel physician and the vaccinations and an I-693 done separately by a civil surgeon here in the US. This is the reason there are special instructions for a K-1 adjustment applicant in the I-485 and I-693 instructions.

    If the CS fills out your I-693 and does your vaccinations transcription/assessment when it is not flu season, then you will not be required to get the flu shot at that time.

    Many people get all their vaccinations done at the same time as the K-1 and get them all marked off a DS-3025 and never even need to see a civil surgeon for an I-693. I wish Juarez offered that option.

    Thanks so much Kay! I was confused but you've cleared it up for me. I second that about Ciudad Juarez, it would be soooo much easier. The trick now is to find a CS that won't rip us off.

    We've already located one that charges $60 to transcribe, and I honestly feel that's the cheapest we're gonna find.

  12. The medical and the vaccinations are really separate things as vaccinations are not required to get the K-1 visa and enter the US, so no vaccinations were required at the time of the K-1 medical. That is why Juarez just skips them for K-1 applicants. They are required for AOS though.

    No new medical is needed if the K-1 medical was done within a year, but the vaccinations must all meet the AOS requirements So, if you see a civil surgeon to get an I-693, then that new date that the CS signs off on the I-693 and your vaccinations will be the date used. So, if you see the CS during flu season, then you are required to have the flu shot and have it listed by the CS on the I-693 as being completed and the date it was given. If you see a CS outside of flu season, then the flu shot is not required at that time.

    So because no vaccines were required for K1 for Ciudad Juarez, the following does not apply?

    -For purposes of the immigration medical examination, the flu season starts on October 1 and ends on March 31 each year. If your immigration medical examination is during this period, you are required to have the seasonal flu vaccine.-

  13. Wait and get the I-693 dated after flu season so the flu shot will not be a requirement.

    Hey Kay. I'm confused on the flu shot. I thought that the flu shot was required if the MEDICAL had been performed during flu season.

    Am I mistaken?

    But I'm reading other things stating that a flu shot isn't required as long as the I-485 is adjudicated AFTER flu season.

    We haven't gotten his flu shot so I'm not sure which route to go: get it, then go see the civil surgeon OR don't get the flu shot and still see the civil surgeon for the I-693

    Can you please clarify this for me?

    (my fiancé had his medical in Ciudad Juarez late October 2013 and his vaccinations done in his home city, and although it was flu season, he didn't receive the shot because they didn't have them available)

If you are concerned about any needed vaccines or immunizations I would suggest that you go to your local county health department and let them tell you what is or might be needed and get the shots there. The county health department is the least expensive place to get any needed vaccines or immunications. Then, take the report from the county health department with you for your visit to the Civil Surgeon. This is what my gal did and had not problems. Best of luck!

    What did your wife have to present when she went in for shots? What form of identification did she provide?
