    Termination of Conditional Resident Status letter

    I have an Interesting letter I just received for my son. They have terminated his Conditional status and will start deportation.

     

    Here is the background

    I am the USC. I adopted him (my stepson) before his conditional card expired. He was 12 at the time. During that adoption we changed his first and last name, got it finalized, got a born abroad birth certificate, etc. He already has had a US passport now with the right name and I am pretty sure even it was done before his conditional GC expired which is why no need to adjust status. We also removed the conditions at the SS office as well.

     

    Although not really anything to do with his case, about a year later (about 1 year ago from today) his natural Mother (my wife) has also become a USC after removing conditions, waiting the time, and completing the oath. She also now has had a US passport for about a year now, a Certificate, and updated SS record as she was required to complete the entire process.

     

    I plan on calling the helpless line next week but I was interested in everyone's thoughts.

    They changed things last month and you can NOT walk in anymore. You must have an appointment. I had to deal with this 2 weeks ago for my Nephew who had let his passport expire. You do not have to go to your local one if there are not any close appointments and you can schedule and travel to any of them which is what I ended up doing by driving 200 miles each way. On the plus side, it is still same day service.

    sorry for the separate posts. I can't modify the previous to add this information and I don't know why.

    I wanted to add that I am a Fully Licensed Teacher. All my trainings to get the full license (PERMIT - PROVISIONAL Lic.- FULL Lic.), I paid them out of my pocket please. So if you see any benefits or advantage of being an H1B in such a place, kindly let me know.

    You should report them to DOL so this will all stop.

    An educator claiming ignorance??? If you have a license, why did you stay there so long at that pay rate / benefits?

    Easy...Because they would do the sponsorship...You know EXACTLY the benefit you sold out for...A Visa to stay in US...But now you want a refund of fees now that time is up and they can't help you anymore as you approach your maximum time on an H1B.

    To be clear.... I have no pity for you or them as you have made your deal with a devil and now you are upset years later.

    Sure you might get your money back after a few years of fighting BUT then they might get a sponsorship ban as well meaning they can't sponsor you or anyone else.

    I just finished this process for our 2 boys. Where they married? If they were I am sure you have all the termination documents which you will need. You start the process here in the US and it follows state law so it varies a little state to state. It took about 8-9 months to complete in our state and requires a home inspection/report, Posting in newspapers, and notification sent to PI. We used a lawyer as that we were prepared for a fight (or a payoff request) with the Ex given there is a copy of the petition with all our information sent to him, but no issues.

    I paid about a total of 2K. 1.5 for lawyer and another 500.00 for all the court costs and department of social services report. The newspaper and investigation are all court ordered so you don't start any of that before you do the first court part. You do need the last known address of the EX. An added bonus was right after we got the final order of adoption in May, I was able to apply for their US passports and we just received them this month which is one month before their current GC expires so no ROC required based on our timing as they went right from conditional GC to US citizens as soon as the Order was signed. My wife still has to wait to apply for citizenship later this year.
