The exact same scenario happened to another couple. Your husband is an LPR anyway, so delaying citizenship another few months isn't really a big deal. Missing our AOS interview could have been a real problem having just come from the K1 visa, but it all worked out! Good luck and congratulations on the baby!! :)

    I think one key piece of information that only came out in a later post was that due to COVID the hospital will not let the father come in unless he enters at the same time as the mother.  In this case I think delaying the interview is justified.  You only get one chance to see your child born.  It is a moment to be remembered and cherished.  Everything else takes second place.  I hope the birth goes well for you.  Enjoy the major life event.

    Unfortunately due to Covid restrictions at the hospital if he is not with me when I’m admitted he cannot come in at all. Also, he is the only person I have to drive me to the hospital. I can’t drive myself while in labor and having him be an hour and a half away in another city is also unwise. My doctor has advised that I need to have someone available to drive me at all times in the weeks surrounding the due date.

     

    I really wasn’t asking for anyone’s else’s opinion regarding the decision to reschedule because I know that is the best decision for us. I’m asking about the procedure to reschedule and how it works. Having him be there for the birth of our baby is far more important than risking delaying his citizenship application by several months. It’s clearly possible because they say in big bold letters on the interview notice that there is no penalty for rescheduling.

    This is absolutely not true. Both parents do not need to be a citizen. Obama’s dad was not a citizen and he was President. 
    I’m not concerned about baby’s citizenship. Baby will be born in the US and has one US Citizen parent and will be a natural born citizen. Even if the baby had been born abroad they would still be a natural born citizen due to one US Citizen parent.

    Anyway the real point - I seem to recall from my interview notice you were supposed to return it by mail with a request to reschedule if that was the case. Did your husband’s notice not say this?

     

    Mine was two weeks early! I’d be more interested in the actual probability of overlap ;)

    If it were normal circumstances at the hospital I’d be more inclined to agree but due to covid if he doesn’t come in with me when I’m admitted he won’t be let in later, and once he’s in he can’t leave otherwise he won’t be allowed back in. We don’t mind the wait to reschedule, I just want to make sure they receive the request.

     

    The interview notice gave a phone number to call, which went to the main USCIS line. We were able to get through to someone and she gave us a confirmation number for the request to reschedule and said we should hear back in 30 days. I’d seen the instructions to write in directly to the field office where the interview is scheduled as well though so I’m wondering if we should do that too to be on the safe side..

    Unfortunately the baby arriving late is what would cause us to miss the interview. Our due date is January 13th and the interview is the 19th. I’m expecting to go late as it’s our first baby. The hospital stay after delivery also has the potential to overlap with the interview as well. Due to Covid regulations in the hospital the father cannot come and go once we are admitted. If he were to leave to go to the interview he would not be allowed back in.

    Problem with rescheduling is that you're not sure if it was received. Additionally, it is a blessing to even get one during this COVID times. Some people filed last year and are yet to even get a biometrics. We had a lady from Australia who had to book last minute flight to the next city to do biometrics (she weighed concensus and decided going was the best decision, even though she had initially called to reschedule. She went, took care of matters yesterday and is now on a 14 day quarantine, if I remember the story correctly). 

     

    Those are my reasons as to why you shouldn't have rescheduled it. 

     

    I would still just go on the original date, especially if the date comes by and you're not in labor.

    Thank you! And thank you for weighing in! Unfortunately the interview is not in the same city where we live, it’s about an hour and a half away. Given that and the fact that a due date is really just an estimate, we decided that rescheduling is the best option. We’re fortunate enough that we aren’t in a rush with the process and don’t mind the delay that rescheduling would cause.

     

    I hadn’t thought about still showing up on the scheduled date if the baby ends up coming before and if we’re out of the hospital by then. That could be an option if we’ve not heard back yet by then! 

     

  8. Hi Everyone, 

     

    After a very long wait my husband finally received notice that his interview for citizenship has been scheduled at the Baltimore Office. The only catch is that we're expecting our first baby and they've scheduled him for a date that's less than a week out from our due date. I'm obviously concerned that I could go into labor and he will have to miss the interview. We reached out via the phone number on the interview notice that was provided to reschedule in case of covid symptoms and they gave us a confirmation number for our request and said that we should hear back within 30 days. I have two questions regarding this:

    1. The original interview is scheduled for less than 30 days out... if we don't hear back before then does he just not show up? What would happen in that case?

    2. I'm seeing in other forums on here that people say you have to write a letter to have the interview rescheduled. Should we do that too or do we think that calling will suffice? 

     

    Thanks for any help anyone can provide! Of all the weeks we could have gotten for the interview of course it turns out to be the week our baby is due! As if I needed one more thing to stress over in the lead up to the big day 🙃

    I'm not familiar with exactly how this works, but I've seen people on here mention being able to get a walk in appointment prior to their scheduled date. I think you might have to already have received the biometrics letter though. If you try searching around on VJ you may be able to find more details on that option

    We have just received an RFE requesting more proof of having met within the two year period immediately preceding the submission of the I-129F.

     

    Most people it seems who apply for this visa are in a situation where the US citizen is living in the US, and the Fiance(e) is living in their home country. For us though, I (the US citizen) and my Fiancee were living 4 Kilometers away from each other in Ontario, Canada. When we decided we wanted to move to the US, I first made the move, and immediately filed for the K1 visa. When they asked for evidence from the last two years in the I-129F form, I figured, "We've been together for 9 years! I'll just give our passport stamps from 2008, and lots of pictures over those 9 years!" Apparently the passport stamps were invalid as they were beyond the two-year window preceding my submission of the application.

     

    On the RFE they state only two types of primary evidence:

    - Copies of airline tickets with the date on them

    - Copies of passport pages showing the stamps and date

     

    Obviously we didn't have a need to fly to see each other, as we would just walk or drive to see each other every single day in the two years prior to this application. The only evidence we have are digital pictures which don't have date stamps, and the RFE states that pictures are considered secondary evidence.

     

    Has anyone else been in this situation? We are scared we will get denied for lack of evidence. I tried calling the USCIS today to ask them, but they sidestepped the question and said I need to either contact an immigration attourney (can't afford it), or request an appointment at my nearest office using their InfoPass website (nearest office is a 4 hour drive away, with no appointments available).

     

    Should I provide photocopies of my drivers license or T4's with my old Canadian address? Should I print a Google Map showing how close the distance was between our two addresses? I'm at a loss for what more we could provide them with. We gave them as much evidence as we thought we had in the original I-129F application.

     

    We need to submit this additional evidence by May 9th. I hope someone can shed some light on this sticky situation.

    Did you go on any trips together within Canada during the time period? My husband and I both lived in Peru prior to filing, we submitted a lot of copies of boarding passes from domestic flights showing we traveled on the same day and with seats together, same for bus tickets. If you don't have that maybe any kind of tickets to events that have your names on them? Hotel reservations with both of your names on them? Credit card statements with consistent use could also perhaps prove that you were in Canada the whole time and explain the lack of passport stamps. 

     

    Aside from those I second the affidavits, as many as you can get. Show the Drivers license to prove Canadian address for sure. If you can swing the 4 hour drive though it may be worth going to the info pass appointment prior to responding to the RFE, better a 4 hour drive than risking a rejection. Appointments can only be made up to 2 weeks in advance, if you check at exactly midnight you can usually get one as soon as the next day opens.

    Hi! I see you've gotten the NOA so you're good in that respect, but just wanted to suggest as well that you have someone check your mail while you're traveling to be looking for the biometrics appointment notice. That generally follows within about a month of the NOA. Our NOA arrived on 01/04/16, the biometrics was scheduled for 02/01/16. I remember there being not much notice either between the receipt of the biometrics letter and the date of the appointment. Good luck and enjoy the trip!

  12. Hello All,

     

    Just wanted to give an update, we went to day to (attempt) to get the passport stamp extension but were told by the officer at the Baltimore field office that the receipt letter extends the GC validity one year from the expiration date of the green card and that they could not give the stamp until within 30 days of that date : ( They said to make another appointment and come back if not approved by then. They did check the status of our case and said that it had recently been assigned to an officer for review. So hopefully an approval is near and we won't end up needing to go back to get the stamp! Fingers crossed!

  14. Hello All,

     

    My husband and I filed his I-751 in January 2016, his letter is dated 01/04/2016. I was under the impression that the one year extension is from the date of the green card's expiration, which would be end of March, but reading through some of the posts here it sounds like it may be from the date on the letter? I'm wondering if any of you who have made info passes to get the passport stamp have been successful or have they told you to wait until the expiration date of the green card? I was really hopeful that that Vermont would get to January applicants before the stamp was necessary, but it's looking more and more like that won't be the case : (.

If you decide to change the date do it through the embassy rather than NVC, the embassy in Peru is fairly flexible, I have a friend who did it because she wanted to be able to attend the interview with her fiance but couldn't get time off work on such short notice, she emailed them and they pushed the date out a month for her with no problems.   17. For all those who got the interview waiver letter dated 3/12, we just checked our case number online and the status says card in production as of 3/29!!! I'm still kind of hesitant to believe that it's really true because we were ready to wait at least another few months, but we double checked the case number 3 times and it looks like his green card is on it's way!!!

    We just received a letter in the mail stating that USCIS has identified our application as a potential interview waiver case. I'm just wondering what to expect from here? I know before the interview couples are sent a list of proof to bring with them... in the case of a waiver do we mail that in? Or do they really just process it without asking for any further information? Also, does anyone know if an interview waiver normally speeds up or slows down the process? It says 6 months on the letter, which seems about par with what our local office's processing times are. Any experiences from others who have gotten this notice are appreciated!!

  19. Hello All,

    I think I have this down after reading a bit on here but I just wanted to make sure. My husband immigrated to the US on September 21, 2013. We were married on October 11, 2013 but didn't file for AOS until December and he therefore didn't work in the US at all in 2013. He just received notice that his EAD has been approved but has not yet gotten the card in the mail. He does have a SSN but doesn't have his green card yet.

    From what i've read on here we can either file Married Filing Jointly or Married filing Separately. If we do Married filing Joint we would need to declare all income he earned while working abroad in 2013 and submit a statement saying that he is a non-resident spouse but we would like for him to be treated as a resident for tax purposes. If we're doing this with turbo tax would we just attach the statement to the printout that it prepares?

    If I do Married filing Separately then he just doesn't file and I just declare my income only on my filing.

    Is this correct? I know that married filing jointly is probably going to be the route that will get us a bigger return, but honestly i'm ready to go the path of least resistance if filing separate looks easier...

  20. Hello...." A friend" of my wife filed for green card and EAD the 1st week of December, They

    have an appointment for GC interview the first week in March. She has been working at a major worldwide, public image concerned company for 1 week now. She told them she did not have EAD yet, but would arrive soon in the mail.

    The company put in her SSN in the place of work authorization box and also SSN in place of A #. ( she forgot to bring with her) She will get her first paycheck next week and is concerned she will be deported because she is working illeagally. I keep telling them they should get EAD in the mail anyday, but nothing yet.

    What is the worst that can happen?

    What is likley to happen?

    Is she supposed to get EAD before GC interview?

    Tell her to check the status of the EAD card using her case number on the USCIS web site, if the card is on it's way it should have the status as card in production. My husband's just changed to that status on Monday, we filed for AOS/EAD the first week in December, he had his biometrics interview on January 10th, it took a little under 2.5 months for the EAD to be approved, we're still waiting for the card to arrive in the mail. She's right to be worried though, if she hasn't yet received the EAD she is currently working illegally

  21. If you post in public forum you can expect the public to respond. I will respond as I wish including pointing out that you don't know how to pose the question correctly. Incorrect questions mislead the public therefore the answers.

    Thanks for clarifying that 6 year olds cant apply alone. I wouldn't have known that.

    No matter what question you ask nor who responds the actual outcome is ALWAYS decided by the embassy. You are asking the public to answer questions that you know can only be decided by the same embassy. Have them all go in after submitting these petitions or applications to be judged by the embassy. That's how it works anyway.

    Domestic partners are simply people living together. They remain citizens of another country and will apply as such. You think the embassy has different rules for people that live together?

    All I would like to know is if a domestic partner is eligible to be added as a dependent as a sub application for a tourist visa the same way a child or spouse would be. When you fill out the tourist visa there is an option to "add dependent"

  22. I am not sure what you mean by " petition " as it applies to tourist visas. Maybe this is done differently in Peru.

    I would think its difficult for this sudo family to gain entry into the USA on tourist visas so the outcome of this will be informative for many people. Its hard to believe they can just go in and apply as a family to be granted tourist visas.

    Correction: By petition I mean application. Families apply for tourist visas all the time. If you want to go on a family trip to disney world the family applies together. A 6 year old child cannot submit her own visa application to the US alone. She has to apply with a parent, this is what I mean by "together" I know husband and wives can present themselves together for the interview. My question is can domestic partners also do this. If you dont know the answer to my question please stop passing judgement as to weather or not they will be denied or granted the visa. That is for the embassy to decide.
