When I go to open an eRquest on USCIS website, the only option it gives me is to file a request for letters I have not received. How do I file a service request for case beyond normal processing time?
You should find out where your file is first.. more likely than not it is at your local office.. once you get that, you can check the volumes there and make an infopass.
The service request can be generated by calling uscis.
If they give you any ####### you can always go the congressional route or .. https://cisomb.dhs.gov/oca/form7001.aspx
Beware of those local offices.. my file has been approved and stuck at the office for over six weeks now for an unknown reason

Please help! Everyday I am checking the status of our application on USCIS website and got "Initial Review" status update. But on May 23, there was no status update instead I got this message...
"At this time USCIS cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information."
What does this mean? Anyone experiencing the same thing?..please help.
Thanks!
Usually means that your file was touched.. that is a good thing
I was never able to see my status until it was approved.. that being said I would call them every 2-3 weeks.
Hold times are long to speak with an IO, but they will be able to see your case status, the CR will only see what you can and will have to transfer you for further information

I am so hoping I can join this thread

Oh really? I am a resident of Hawaii (which I know has a higher required income) and my Dad is in Missouri. When filing the forms would I be filing it saying I have a household of 2 (anticipating my husband) or is it just one? My Dad can still be a joint sponsor right? He just has to file a separate I-864 right? Thanks for your help!
Oi shoot I didn't see the Hawaii part.. sorry
I know it is a little more in Hawaii, but don't have the reference in front of me

Hi! We are re-filling I-130 because it was denied due to abandonment. (RFE was sent to the incorrect address provided by the USCIS customer service). On the letter D. Other information, question 2. Have you ever filed a petition for this or any other alien? If "Yes" give name, place and date of filling and result.
My. questions are,
1. Which is the place? Will it be Chicago lockbox? Since that was where we sent it.
2. For the result. Can we write, Denied due to abandonment (RFE was sent to the incorrect address) ?
Will appreciate your help.
Thanks in advance!
1. I am not sure, check the instructions for the 130
2. absolutely, but I would include who's mistake it was as well

So we are still in the holding pattern with the NBC waiting to hear about our I-130 decision. Monday is the two month mark for waiting, and from the look of Igor's list, we could hear any day now (or next December, I guess you never really know until it happens). I'm trying to get everything ready to go so we can get through the NVC process as smoothly and quickly as possible.
Some background:
I am a graduate student and a part time employee of the federal government. I don't know what the cut off is, but I'm sure my wages don't cross whatever the threshold is to look like I'm able to support my husband.
So I'm sure I'll need a co-sponsor. Natural choice would be my father (my mother is deceased). However, he is retired and is living off his savings/pension/social security, which is also not a huge amount.
So what do I do? Will my father and I be adequate proof that my husband won't become a burden to the state? That's what makes this so frustrating, my husband will definitely be the main wage earner until I graduate. He's had several good offers here in the past, he just can't accept them until this is over!
for a two person household
total assets for someone who is not working is just under 60 thousand
total annual earnings necessary just under 20 thousand
your father's money can only be combined with yours if you live at the same address, otherwise one of you will have to qualify individually

The police and birth certificates for my fiancee are Russian... do they HAVE to be translated into English? Some say that it is not necessary because the officers at the embassy speak Russian.
someone please shine some light on this, my fiancee is about to receive her packet from the embassy
translate everything that is not in English.. it doesn't have to be a professional, just accurate

It's not the norm for K-1 at all, no. I've been watching Igor's List too, and although not everybody inputs the NVC dates, those that do range from 3 days (sigh, I wish!) to about 3 weeks, so a month still stuck at CSC is absolutely atrocious.
It's my impression that CR-1 takes quite a bit longer to get to NVC, so I wouldn't extrapolate from CR-1 dates.
The reason the cr-1's take additional time is that most of the files are consolidated and then batched out to nvc. .there was another user who got this answer from their congressman. This is the situation since local offices have gotten involved in approving the 130's
-
I'm not inclined to think it's the norm. I researched igors list, and of the people who were approved the same day as me, over half were at the NVC before 5/10, and none arrived after that.
So either people weren't updating their timelines, or something else is going on.
It seems to be happening more these days.. especially for folks on the spouse route. There have been posts for months about this. I have not been following Igor's list .. personally I find no benefit in watching other people's progress.
Have you started anything other than a service request? Congressman, Representative, Omnibudsman, etc??
That is where you will get the real action.. uscis responds quite quickly to inquiries outside of their own domain.
-
I feel like i'm soo close because last infopass they told me it was on an officers desk..he even have me the officers name....
darnell is quite good with suggestions.. I would use that as your speaking points for your next infopass.. but like I said before, you are really close right now.. just sit tight
-
I stopped asking why a long time ago.. now it's just about trying to understand what needs to be done to get the ball rolling.
I guess the only good news is that it is not lost and my guess is that this rear room is some kind of document staging area for consolidation and then forwarding out in batches.

After over a month of waiting for my file to get to the NVC, I find out today that It's still at the CSC. I put in a service request last week, and just found out. So basically it's like I just got my NOA2 today, even though it was approved April 24th.
Apparently the request response said something about expediting it, but the wording was to vague to know for sure what, if
I'm curious to know how many other people had or are having a similar situation, and what things might cause it, and if you've been through it, what you did to move things along?
Seems to be the norm now instead of the exception.. I am a week ahead of you and only found out with an infopass.
My service request was generated yesterday.. I am expecting NVC intake within two weeks.. hope you get the same... and just in case I already have another infopass appointment for June 12.
Good luck

We're still nowhere close filing one but I've been wondering how it works.
Do I need tax returns AND a letter from my fiancè employer AND pay stubs to show he has an income?
How do we know whether we meet the requirements or not?
I think the poverty guidelines were involved somehow, and the sponsor, or co-sponsor that is, were meant to make at least 125%... something along those lines. Just feeling confused. Also, would be have to send the same documents with the AOS? Can my money count too if transferred on a joint bank account?
pull the guidelines for the 134 document .. this is what they will use at the interview. requirements for the 134 I am pretty sure are 100% of the poverty guidelines.
the consulate officer has discretion as to what he/she will or will not accept for sponsorship when there is a co-sponsor.
when status is adjusted, the 864 will be filed which is the contract and the 125% comes into play.
hopefully someone else chimes in if there is something left out

still waiting on nbc to forward our petition to nvc...
It's not at the nbc.. it's sitting at the local office that approved it waiting to be batched out.
Turns out that this a normal process. I had this confirmed at an infopass appointment.
I have already started the complaints and congress involvement.
Sometimes you have to make a lot of noise or it will just take it's sweet time.

stevie-b ya- i read your stuff recently - good on ya !!!
the problem I have with NRC, though - is that it's the storage location normally used for AOS and I-130 petitions filed by permanent residents.
It's cool you found a sub-unit inside the local office, no worries there - I'm talking/writing about the BIG NRC office where the casefiles are warehoused. After I-130 approval, a casefile can go to either NRC or NVC.
What yer saying, if I'm reading this right, is that the NRC sub-unit there at the local office is used for temp file storage ....
I'm not sure about the warehouse part, but when the officer said, "oh my I see it was sent to the national records center" I of course replied omg please don't tell me that.. she responded.. don't worry, that just means it is here in another room. either way I now have started the omnibud complaint, a congressional consent form and about half a dozen emails to different oversight agencies within the organization.
With that being said.. I am done hi-jacking this post

ask for the I-130 adjudication unit supervisor.
Once you get that human, ask:
1. has my casefile been assigned to an adjudicator yet? if yes,
2. how much longer will it take for my casefile to be adjudicated?
3. what is your normal turn around time from approval to send-out to NVC? I know you have to scan stuff into the A-File - how backlogged is the records unit on doing the scanning, currently?
4. You know the case is to go to NVC, right? My spouse is not chasing after 'adjustment of status' in the USA, so please DO NOT SEND my approved petition to the NRC.
ask those questions, as that stuff seems pertinent (at least to me) for what's what, with your casefile, at the local office.
hey darnell..
when I went to an infopass this past week, I found out that NRC is the tagged file location inside the office where the file was processed, it is not actually sent out to another office... just an fyi, I know you are very well versed all the way around

Hi everyone! I just called in to Vermonth this morning and ended up having a service request be put in for the confusion of all the transferring of cases. My question is does a service request do any good for a case or just have someone look at it and give an answer for the confusion(or whatever the reason was for other requests)??? Has anyone put in a service request and seen an approval shortly after?
I have placed two service requests.
The first one went unanswered and no receipt was mailed as promised by uscis, but was taken care of by the time my petition was approved.
My second request is still pending.
It is doubtful that any service request will speed up the process.
Most service requests are met with a statement of allowing uscis 45 days to respond so patience is key

hi my husbands visa application was put on administrative processing aaand they told us it would take up to 3 months but they did not take his passport they gave it back to us is this right or what i thought they were suppose to hold on to it untill the visa is ready and they just stamped it. has any one went threw this before
please tell me what i should expect to happen
Yemen is one of those countries where you can expect to be put on AP, especially a male applicant.
There will be no determined amount of time for this process and no real opportunities for help.
After the 90 days you can call the state department for an update.
There are a variety of background checks that will be taking place for your husband.

I keep trying to speak to a live representative at the USCIS help line but its so difficult. Every time I think I'm bout to reach an operator, it either hangs up or tells me to go online. Is there another number I should call so I can reach them directly? Please help
Don't push any buttons, just wait and you will be connected with a Spanish speaking CR.
Tell them English please and go on with your request.
CR's have limited access to your file, so it is always best to ask for an IO.. I called Tuesday morning and total wait time was almost two hours.

This will be my second infopass. In the first infopass the guy at the window, told me my file is on a desk right now...that was in April. What should I be asking at the infopass? What are the correct questions? And if it id on a officers desk what's taking soo long...is there a higher person in charge I should be asking for?..help with the right questions guys...:-(
The only person I think that can help you with that is going to be the supervisor of the 130 unit.
I wouldn't expect much in terms of answers.. there is no way to know what kind of work load the officer has that is adjudicating your file.
The good news is your file is being worked on.
I would also ask if there are any RFE's that have been generated or if there is any additional information they can give you. They have a half dozen screens they can look through for additional information.
Your office is busy, but looks like you should be complete soon.

The main differences between them are that a spousal visa allows the spouse to work and travel immediately on approval and it costs less. It also takes a few months longer to get approved. The fiance visa is generally a few months faster, but once you get married, you then have to apply for adjustment of status and EAD and AP. This takes a few months at best to get the EAD and AP so you can work and travel. Filing these later, makes it a little more expensive over all than the spousal visa.
That's just a generic overlook of the two, hopefully people who have been through them can chime in and add a bit more detail for you.
spouse visa is generally faster than the fiancée contrary to other posts
this of course is subject to change due to the uscis backlogs

yes they send me the first letter NOA 1 with the receipt NUMBER ON IT.BUT WHAT AM WAITING FOR IS THE NOA2 MEANS THE APPROVED OF THE I 130 .ITS BEEN ALMOST 6 MONTHS SINCE NOA 1 RECEIVED .AND AM STILL WAITING FOR THE DECISION .BY THE WAY THEY DIDN'T ASK ME FOR RFE .THANK YOU A LOT
I would call to see if your file is at a local office.
You can inquire at the local office with an infopass. the local offices are all dependent on volume, I have seen some cases take the 5-7 months but it is rare.
Additionally, keep calling every two weeks, there are plenty of petitioners who did not know they had an approval or an rfe without calling.
Good luck
for people who got APPROVED

There really is nothing you will be able to do to speed up the process.
Algeria is a high fraud country, so AP should be expected.
There will be no definitive time frame
Congressman, White house, etc.. will not go anywhere
There are a whole set of background checks that are taking place and must be completed before the case gets out of AP
You can get an idea of what you are facing by searching your embassy specific interview experiences
