  1. Last March 29 the USCIS sent us an email that our case (I-130) was routed and transferred to the National Benefits Center. My papers would be on its 6th month now & still no updates happened. Does the NBC transfer the case to a local office without notifying the petitioner? My husband called them (USCIS) yesterday & they never told him if our case was move to local office they just told him same stuff every-time he calls.

    typically there is no notice .. the reason for this is that there was an official notice on the uscis website when this started

    to find out, you have to get a willing IO on the phone to check.. takes time and persuasion

    but yes, you can plan that your file was transferred

    he has to speak with an IO not a CSR

  2. The doctor might not always know what is best to do, so I decided to consult fellow VJers smile.png

    of course the doctor will know

    you call the doc and tell them you are going to need a us immigrant physical examination and then ask what they need from you to perform it

    they will tell you EXACTLY what you need for them

    after all they are the ones who do this all the time

    fyi.. I got several different answers from doctors about medicals and was able to get mine done before case complete at nvc btw

  3. why would you want to help someone who is basicly a scam artist and trying to take advantage of the system by falsely accusing a USC of abuse?

    do you think everyone is scamming? obviously you think the greatest percentage is, and I think it is the opposite... and this knife too cuts both ways with the usc spouse being the scammer.. lots of those stories here too.

    here is my quote again.. you keep wanting to address people taking advantage of the system and that is not what this site is designed to do

    so I needed help and my wife is a foreign national.. is she guilty too? is everyone guilty?

    do you have any reason to be here other than to voice your agenda? I am sure there is a lot of help for you too should you need it if you have a foreign spouse.

    • This part about sponsorship worries me, as I have to quit my current job to move to China. I will also not have a job in China, as I've heard it will take ~6 months to get a work visa. However, I suppose I could just apply for a job as soon as I get back, since my salary requirement for sponsorship is evaluated at the interview?
    • Will the long period of unemployment affect my eligibility as a sponsor?

    It sounds like they won't let her come to the US unless I actually have a job. Sounds like a catch-22. Does that mean I cannot be her sponsor? Or can I just show them a mound of cash and property equity? Thanks, everyone.

    you will need to have the job or sufficient assets before the interview.. several months actually.. at the nvc

    your current salary is used, although a recently acquired job doesn't always work for you, but also doesn't always go against you.. depends on how constipated the interviewing officer is that day

    long period of unemployment affect it?? shoot man I hope not.. I am unemployed almost 2 years and am using assets only to sponsor. the mound of cash of which you speak should not be a spike in your bank account. if you have a home and sufficient equity then you are good too.

    as for how that works.. get back to me on Oct 2 and I can let you know ;)

    also give your lawyer a call and see if he/she brings up this goodie bag after you tell them your plans.. you might get some of your money back

  5. I have read every entry of all the monthly filers I-130 from January thru August. I keep up with this every day. I'm not sure what your used to seeing on these threads but instead of up dates about where files are sent I just see people crying about the delay and lack of information.

    There are a lot of opinions shared on VJ. A lot of these opinions contradict the opinions of others, so now I ask people how do you know that and where can I read this for myself.

    Would you know why the VJ charts are set up showing CSC,TCS and VSC? I mean if the files go from NBC to local offices then why are the Charts reporting Service Centers? Are these because the Service Centers still control the work that the field offices are working on?

    yes there are a lot of people crying and frustrated mostly due to the lack of understanding and patience.. unfortunately a good dose of both is necessary for this. Most don't know anything about local offices which is beyond me. if you look at the last several pages of petitions dating back to jan-april you will find lots of conversations about local office transfers. in addition there are lots of threads for specific offices which discuss at length the problem. yes lots of opinions, this is not an opinion it is fact. it is on the uscis website and has been for over a year and we both know this will change with the new facility.. will your petition go there? maybe maybe not.. it will be the same mess the k1rs went through a few months ago with all the transfers to catch up. in the end you will be approved and move on to really fun stuff like the possibility of the nrc delay and of course the lovely increase in wait times at nvc and the possible self inflicted checklists at the nvc. unfortunately I experienced each and every one of those mishaps.

    I wish you luck and speed with your petition.. the advance search tool will help a lot and read stuff that you don't think pertains to you, as you will find lots of surprises in there

  6. Right, the I-485. We have done this for the denied K-1 already, and they did not find issue with it, except for Item 10 (eligibility for a K-1 visa): she was inadmissible by INA212(A)(3)(D)(i), shown below with my own emphasis. Her communist party status was required for her job as a government official, of which she was a rank-and-file member. However, we could not convince the consulate to accept that she needed the CCP membership for her job, as stated in section (ii), thereby being eligible for a K-1. But this time around, we are trying to utilize section (iv) to bypass this inadmissibility barrier, as I am a US citizen. I'm hoping that this strategy will completely bypass any AP, since no RFE will be necessary, as the exception is already codified in the INA.

  7. Need help please !!!!!! my US citizen wife has filed I 130 for spouse (me ) on 25/02/2013 near new york..it is national benefit center..its been 7 months now,,,,there is no updates or news from NBC.....

    now its been so long ,,,,i m worried now,,,can somebody please plz help me to find current processing date for i 130 for spouse at national benefit center. (MSC)

    My NOA 1 is 28/2/2013......how do i find out where is my file at the moment ? is NBC transfers most of files to local field office...

    My wife called the uscis and they said call back in 15 days,,,,,i m very frustrated n confused ,,,whts happening with my case ...no record on online case status,,,,,

    who is tier 2 officer.....can anyone tell when we call to USCIS,,,wht information can i ask to find the status of my application,,,who to ask,,,what to ask......plzzzzz help me guys,,,!!!!!

    what is your local office?

    if it is ny city.. sorry to say bud, but that place is a mess

    there is a thread dedicated to that office specifically and I think they are now at a year for 130's

    if your local office is different you might be in a little better shape

    if you do find something out about your petition.. you will only find out that it is transferred or not and/or if it is the process of being adjudicated

    best advice is READ as many threads as you can in the cr1 forum.. even if they do not apply to you read them.. take a week or two just reading those and you will learn plenty

    heck have your wife do some of the reading too !

  10. How do you know the K3 stays at nbc?

    august 2012 the 130's began processing at nbc.. if it was a stand alone 130 it would be forwarded to a local office for processing (most of the time.. as in 99%) if the petition had other individuals attached to it or something else.. i.e. k-3 it stays at the nbc. (as far as I have seen)

    you can do a double check on your petition with a call to an IO, but this will involve several calls, making sure someone is really looking at the many screens they must scroll through to get to know where your file actually is, and then you have to do it again and get the same answer from them to confirm.. totally frustrating yes

    you can also go through all the various threads in the cr1 forum where this is discussed at nauseum

  11. I highly suggest to contact US attorney. This is not as easy situation as you think. Only US domicile can sponsor spouse to get VISA. I would contact attorney in the US and get expert opinion as your husband has to strongly prove that he will be residing in US in future. He has to prove that he will be staying in USA for long period of time and will make it permanent domicile. Please do not try to prove his domicile as he never stayed in the US because NVC has all details of how long person lives in US and outside. I would not try to make something up because they will ask for more evidence.

    there are several threads speaking of domicile.. why is an attorney needed?

    it is not about proving domicile now, it is about proving "intent to establish domicile"

    two totally diff things

    OP - have your lpr spouse read up on what they need to do, then take a read through the applicable threads and forums.. after a week of homework.. come back

  12. What date are they looking for on a filing date for a previous I-129 ?

    Date the petition was signed, mailed or received ?

    Receive date or Notice date on a NOA 1 or what ?

    Had a melt down over the new form but after staring at it for hours I am ok with it. huh.png

    I am going against long time VJ instructions on the old forms to never leave blanks and am following the NEW instructions

    for the new form : If an item is not applicable or the answer is "none" leave the space blank.

    Question to mods....We will have lots of questions coming about this, so can someone change the VJ guide on this ?

    Minor freak out but logic wins. Hope the logic of new trainees at USCIS is in sync with the new instructions and we won't get spanked

    filing date is the date your noa1 notice indicates it was received

    often changes in forms cause a vj website meltdown throughout the forums :)

  13. HI, I WANTED TO KNOW IF ANYONE HAS EVER BEEN APPROVED FOR THEIR I-130 AND THEN WHEN YOU GO TO THE NVC SITE PORTAL, IT SAYD YOUR CASE IS IN PROCESS TO BE TERMINATED? WHY DID MINE SAY THAT, NO ONE ELSE HAS MY CASELOAD INFO, AND I DONT KNOW WHY THE SYSTEM IS SAYING THIS AT ALL. MY I-130 JUST GOT APPROVED AUG, 26, 2013...... HELP PLEASE. I CANNOT CALL UNTIL MONDAY MORNING

  14. I brought the subject up in the VAWA thread and was banned from the thread.

    I then created a new thread to specificly discuss it and it was immediately closed.

    This is a very real problem.

    There are thousands of spouses who have been falsely accused of abuse by immigrants looking to exploit this law.

    Why is this not allowed as a topic of discussion?

    you have so much energy for this problem in your eyes, I am sure there is a website out there for you to be able to fully vent and get supported other than this one where we are all trying to HELP each other

    This my friend is the very basic and elementary reason you are having so so many problems with mods here and are the only one who is spewing forth this type of agenda

  15. actually Ive never been rude or argumentative if that is what your getting out of my frustrations here, ive been supernice to every single human being I spoke to from the beginning.of this journey and nobody I spoke to was as awful like them,they have been utterly rude from the start of getting a case number till this, so you had the good ones and I got the crappy ones, I had a lady that was a tier 2 that scream at me as I was asking my question because she had been asked the same question too many times that day, I had a guy hung up on me with out even letting me inquire about my case, I asked one question I got a no and have a night day and a hung up literarly, I had an old lady telling me in a very rude way to basically go #### myself because I asked.about my case number too many times when it was only 3 times after waiting almost a month,l with out even coming near their number and a complete jerk that told me that I didnt send required documents when I already did and told me well we dont have and you need to resend it with out explaining what might've happened. and so did my husband they treated him bad, and my friends that delt with them said the.same exact thing, so im not crazy lol....

    and yes I may seem that im the bad guy and im rude to them first, but I never once was.and neither was my husband and we still get the crappy attitude and that what gets us.....

    and I did already I emailed them twice and they said we.are.waiting on the nvc to schedule and that was that!!!!!

    either way im not really here to mainly vent over these people it just happenes to be part of the subject, my purpose for this post really to get an answer to the question that the nvc people seem so hard to answer if this is normal for them and if my valuables are safe with them as in with the nvc staff that handle the files, because i getting sick of the same scripted line they say when you get an interview you will be informed, which is an answer that has nothing to do with what I asked for to begin with.

    so yes, all your valuable information is safe at nvc and this is the reason they have contracted dhl worldwide, for the safety of your information as well

    it is okay to stop calling nvc, my interview date and appointment letter came the same day by email that the nvc was informed.

    I hope you get your date soon, I know it is totally overwhelmingly frustrating

  16. I would like to study routing but I don't know where to start. I'm very confused because I think all the I-130 are now sent to NBC and are staying there. I think that's the USCIS plan from now on, but maybe I am mistaken. I have read on some of the threads that it has been this way since Aug 2012. But the VJ stats still list the 3 service centers with members input and up dates. So I really don't understand.

  17. I'm more frustrated that there is 0 talk about fixing the broken legal immigration system. I know stuff needs to be done about the undocumented and dreamers but I never hear anything about fixing things for people going the legal route. There should be a discussion about both. I make sure to explain the legal process to anyone I talk to so they understand how difficult and expensive it is. So many people say, why doesn't he just come here and you guys get married? They are oblivious that its not legal to do that and the legal way takes many months. Worst part I think is the separation. If we could be together during the wait it would be so much better.

    I am convinced that they are trying to fix the system.. there was a fix last year when local offices were solicited for 130's to get them away from service centers and now there is a new center to handle lots of things

    the flood of paperwork came august 2012 and if these are evidences of some of the fixes, I think they are not doing that badly considering how long things take government or otherwise
