A lot of queueing in San Diego, several thousand new citizens. Lots of cheers for all the individual countries called out I was not sure about the dancing display, but I guess I should not be a grouch. I was irritated by the two girls in front of me who were watching the world cup soccer on their phone during the Oath of Allegiance. They were teenagers but come on...

when u have the naturalization interview, does the Officer approve it right away? or he tells u at the end of the interview, " i will review your case and let u know if u were approved or not" ?

Depends. The officer said "I am recommending your file for approval". But other places do the oath the same day as the interview, so they probably will be approved on the spot.

I am a little confused or maybe just a little retarded, but I recieved a yellow letter stating that I had to bring drivers licence and arrest records to the interview. is that what is known as in line for interview?

I got the exact same yellow letter on friday, and I am also in San Diego. Today I was notified by email that I am in line for interview scheduling.

It is funny they say 'arrest records' considering it was three traffic offenses. Speeding and two stop sign violations. I can't get the records for the first two offenses as I did traffic school. I am bringing my email that said I completed traffic school.

And the officer also told him that the fact that he was deported was by his parents own doing and himself as well. So they took no responsibility whatsoever.

Congratulations. I hope he can turn his life around.

Was he represented by a lawyer at his criminal trial or immigration court? If he was, he should make a complaint about that lawyer (Although I do not know the circumstances - perhaps your cousin was not helpful to the lawyer, or the sharpest tool in the box). It seems negligent to fail to notice you have a potential US citizen undergoing deportation proceeding. Certainly not the fault of the government.

Those are some of the questions I've been trying to raise - without being too intrusive Homeland Security will definitely look into that. This guy (aka cousin) may have not actually known all of that, since his parents mostly like filed for him LPR.

It is obviously a load of BS. When he went to immigration court after being convicted why he didn't just say "I'm a citizen". The process of getting your LPR removed is a separate process from the criminal trial.

Don't waste your time people!

1: He didn't realize he would be deported during his sentence or sentencing? You know when the judge said he would be deported on the completion of his sentence.

2: He was admitted to the US on the basis of a Honduran birth certificate?!

3: When completing the LPR application what did they write under the parents citizenship box? (As everyone here will recall you had to give the names, places of birth and citizenship of parents when completing the green card application.)

This story makes zero sense and i have my doubts on the veracity of the information. I'm out.

When did he apply for the ROC and when did the incident occur?

The I-751 instructions say:

"If you have ever been arrested or detained by any law enforcement officer for any reason, and charges were filed, or if charges were filed against you without an arrest, submit an original or court-certified copy of the complete arrest record and/or disposition for each incident (e.g., dismissal order, conviction record, or acquittal order)."

Hopefully he did not fail to disclose this charge on the I-751.

No, i think the USCIS allows a permanent resident to apply for naturalization 3 years after marriage to a US citizen. In essence the clock restarts when the PR remarries.

Although second marriages are statistically more likely to fail than succeed. Perhaps just aiming for the 5 year card is more realistic.

The USCIS assigns each case a 'fraud level'. Fraud level 'A' is the worst:

· Reasons for Assigning Fraud Level A. Fraud level A should be assigned when the adjudicator strongly suspects fraud. Reasons fraud level A might be assigned include:

- the petitioner fails to sign the form;
- there is insufficient evidence;
- a large age difference exists between the spouses;
- the married couple is not living together;
- a prior I-751 was denied;
- the petition was filed untimely without a good reason for being late; or
- any other reasons as the service center director may determine.

You separated in Feb 2010, and filed for divorce in Mar 2010? That was fast.

You started dating in May 2010 and had baby 11 months later? Wow, that was very fast.

First - The Senate Bill is not pased - In other words, there's a good chance that nothing is going to change....the F4 category will not be eliminated..

This was a democratic bill. I doubt the house republicans are going to reinstate the family ties.

Assuming this is not a troll this case reeks of fraud.

First, paternity testing kits are very cheap. Get one and find out who is the father. Contraception is not infallible.

Second, your wife is looking after her child, but not living with the child? It is hard to believe a mother would leave her child, and appears very odd. Are you being truthful about the living circumstances?

Third, you should have declared the child. Legally you are just as responsible as the mother for the child's well being while married. "MARRIAGE" is more than about love, it is a legal term used by the state to think of you as a single unit. Even if you got divorced you MAY be expected to provide for your ex-wife and your child. The law is complicated in this area and a lot depends on your state.

Fourth, poor child.

Get your shots at the county health clinic. These places are either free or minimal cost. $600 is absolutely ridiculous for DTAP and MMR. It makes me really angry to see a doctor abuse the system by charging so much. Funny how people always say insurance companies and hospitals are evil, but give Docs a free pass.

Hello bewildering. I'm actually a Spaniard, not Irish. Since I'm a EU citizen I assumed it should be easy enough for me and my wife to reside in the UK. I could easily fulfill the requirements you mention, but to be honest I wasn't expecting to have to go through any hoops. Thanks for the info.

Laughably enough, as an EU citizen you will probably have less hassle than a UK citizen - as long as your wife gets permission to live in spain before going to the UK. Many UK citizens are choosing to live for six months with their spouse in EU countries before moving to the UK together - so they can enter under EU law.

Poor UK citizens are under UK law - very strict. 30 page form to get visa, strict financial standards, huge evidence burden etc. Also almost impossible to work without visa. Also, teh border agency is overwhelmed and seemingly incompetent, with the UK parliament changing the rules constantly.

Also, check out the britishexpats forum. I have no direct experience but there were several threads on there about what a nightmare the UK is at the moment for spouses. They really tightened up the rules in July 2012. You will need a job offer in the UK, AND will also have to have either 64,000 in savings OR evidence of earning above $26,000/year. Apparently the UK border agency make the USCIS look like a paragon of efficiency.

Here's a list of what we sent, maybe it'll be helpful to others - and, comments and opinions on the content are also welcomed!

• Cover letter listing the items in the package.
• I-751 form, filled out by conditional resident, signed by conditional resident and petitioning spouse
• check for $590 ($505 filing fee+$85 biometrics fee) made out to US Department of Homeland Security
• Copy of conditional resident's green card, front and back
• List of previous addresses
• Proof of bona fide marriage spanning from July 2011 to present, including:

- Joint lease from an apartment in Brooklyn between July 2011 and July 2012

- Joint lease from an apartment in Bangalore, India, from August 2012 to July 2013

- Bank statements from July 2011 to present showing joint bank account and continuous activity on the account (I printed out one statement for every three months)

- A bill from Freelancers Union showing joint health insurance (and shared address)

- A bill from Guardian showing joint dental insurance

- E-tickets showing travel to Finland for Christmas 2011 and a visit to Lapland in January 2012, and E-ticket purchased for conditional resident by petitioning spouse on his credit card

- Petitioning spouse's record from Indian foreign registration office showing conditional resident listed as spouse, and conditional resident's Indian visa, showing that visa was issued for the purposes of "accompanying spouse"

- Copies of 2011 and 2012 tax returns showing taxes filed as "married filing jointly"

- Proof of joint travelers insurance from July 2012 to July 2013

- Photos spanning over the past two years

- A letter explaining the current living situation of the couple (petitioning spouse is still in India for another two months, conditional resident is in the US) and a letter from petitioning spouse's employer stating that he had to to temporarily relocate to India in August 2012, and has resided there with the conditional resident with the intention of returning to the US in Summer/Fall of 2013

In most cases i would say that you have enough. But in your case, you are not even living together - major red flag - see the section from their manual below!

You have a lot of random stuff that they do not specifcally request (cover letters, pictures, e-tickets, Indian visas). While you miss some stuff that they actually request. Read the instructions carefully.

What about "insurance policies that show the other spouse as the beneficiary,". For example, you named as beneficiary on your spouses work retirement and life insurance.

Also "joint utility bills" are requested, are you both on the bill?.

Instead of a letter from the employer, get an Affidavit from the employer that explains the living/workingsituation.

Also get an Affidavit from other friends that know you that explains why you do not live together.

Your marriage is obviously bone fide, and will not be denied in the long term, but to avoid hassle just get the affidavits...
