But the OP is not actually so close to the GC because after moving to the US there is AOS.
OP: What country are you in? Are you sure DCF is still there? How are you able to be in that country legally?
Yes, DCF is still there. I contacted them and clarified. I'm dual citizen. After having seen how unpredictable and frustrating the K1 process is I am really not looking forward to AOS.
-
I'm thinking about abandoning the K1 process at a quite late stage - NVC forwarded file to consulate. We waited so long for the NOA2 that I became eligible for DCF while spending time with my fiancee. The DCF looks to me like a much better option even at this stage ... 3 months to green card instead of another year to green card via K1.
Am I missing something? Are there any disadvantages of this move?
-
Is NVC involved in Direct Consular Filing and are those cases subject to the recently long processing times at the NVC stage?
-
Could anyone quote some official source which clearly states this would be a breach of some law?
-
What speaks against leaving the country after marriage on K1 before advance parole is granted and once the parole is granted and mailed abroad use it to reenter?
-
i have seen u post on several feeds about this subject....and looking at ur timeline you really need to butt out....u only waited a mere 3 months for a NOA2 and your whole paper work process took less than a year
WE ARE WAITING OVER 8 MONTHS JUST FOR AN NOA2!!
so we should just let the world know...it's ok to come to america illegally don't worry we will take care of your children....think thats pretty damn good incentive to try to get in this country
That needed to be said.
-
If DACA cases deserve that much attention then we should explore the issue even further. How about the children of parents who didn't have the courage to cross the boarder illegally and are living now outside US. I am sure many of them would like to live in US now, but are being punished for having parents who respected the law.

Your time line says that you would have been approved
"Based on timeline data, your I129f may be adjudicated between March 30, 2013 and April 9, 2013*. "
I think this might be a coincidence and not your congressman....
Like I said Senator Blumenthals office ( connecticut) call the VSC and they said they will not approval before unless there is a hardship....
You just don't like the fact that there is some unequal treatment, do you? Understandable. Have a look at the forum contents of the people that have been approved at CSC in the last month. You will realize that nearly all of them got congressional help. Now not every senator or congressman office is willing to help. but some apparently do while some will just want to get rid of you and tell you there is nothing that can be done.
-
well no, you wouldn't wait then... obviously.
And in your opinion we didn't reach that point yet?
-
How can you tell, we here are just a portion of what USCIS have for K1 petitions. They could have approve 20 cases just none of those folks came to VJ forum site to be a member. Remember, things go alot faster if you believe the glass to be half full or just don't stare at it all day long.
But here is to wishing the process to speed up for all us.
God Bless
Have a look at VSC and you will see the difference unless of course they receive 15 times as many applications as CSC, which I highly doubt is the case.
-
You need to wait. Not until you're at about 10-12 months out would I call out the troops.
You got your NOA2 in 3 months. What gives you the moral authority to post such advice?
-
The stress is part of the process. Those who can't handle it should never consider marrying a foreigner or should instead move to the country of residence of their loved ones. I don't mean it callously. IMHO people need to understand, evaluate and ponder the consequences of their decisions before they make them. Those whom the stress of the wait is enough to break up a relationship should never consider marrying a foreigner.
And you are making the rules? You decide that stress should be part of the process. Who are you to tell me how much stress I should endure when marrying a foreigner?

I would disagree. I don't see why anyone would want to rush into a lifetime commitment with someone who is unable to withstand the slightest shake in the ground.
You seem to like the theory that inflicting pain is a good test of strength. You might get some result that way, but you will cause damage too.
-
Totally right in this one... the time apart, on a k1 or a cr1 visa will make a couple stronger... or fall apart. That is the whole point of this long process if you ask me. I believe they could have made this process shorter but they want to see which couples are truthful and which ones are not!
Most couples will fail after x amount of time spent together. Being apart puts the relationship on hold and very little is happening during that time. So most couples will survive the waiting time because of their beautiful dreams and expectations and many will fail once they are finally together because they didn't spend enough time together before or they changed during the wait. The whole concept of K1 visa with people meeting each other only for few weeks, then being separated for many months and then forced to marry in 90 days is a big cause of marriage failure.

Companies can use premium processing, individuals can not. I am surprised that nobody gets mad at the corporations that can pay expedite fee and get visas for their employees expedited. But if an individual suggests expedite fee for family based visas that's a big NO?
-
What!?!? Since when? Do you have any proof to that?
First have a look here: http://www.visajourney.com/timeline/monthly_filers.php?form=1&visa=1&scenter=1&option=2&sortby=2
In the last month there have been less than 15 visajourney members approved in the last month in CSC.
You can compare to Vermont center: http://www.visajourney.com/timeline/monthly_filers.php?form=1&visa=1&scenter=2&option=2&sortby=2
There 15 members have been approved within 6 days. This already shows that CSC is not doing mass processing.
Now if you scan the content of the members who were approved at CSC in the last month, you will find that nearly all of them talk about having used congressional assistance at some point.
That may not be a proof but it's quite of an evidence.
-
A senator or congressman is generally contacted when the petition is already outside of normal processing times. They aren't jumping ahead of anyone.
I love a good conspiracy theory. What do you think they're hiding from us?
Just that the senators or better say their proxies have their own judgement about what is inside or outside normal processing time. Like mine wouldn't want to look at it but some other people who filed after me have been already approved with senators help.
-
Oh, please tell me of this VIP line.
Look at the few petitions being processed out of order in the last month at CSC. All of them asked for congressional help. So if the Senator in your state happens to be nice you are jumping the line. Is that fine? Better than expedite fee? That's only something we already know. How about the stuff that's not made public?
-
The question I ask you in return is, how can you not envisage spending a few months away from the very person with whom you will swear to spend the rest of your life?
If you and your fiancee enjoy the separation as way to confirm the strength of the relationship then maybe it works for you.
However I would never ever leave my fiancee alone. Which means I have to spend time abroad costing me tens of thousands in expenses in a foreign country and business loss at home. An expedite fee of any order pales against that. Additionally the money would be kept in US.
-
I think there should be a VIP K1 processing where they can process your K1 within a month for an extra fee. I am sure a lot of us would gladly pay more rather then just wait
Obviously the name would not be VIP but you get my point.
Don't you guys agree?
I totally agree with you.
To all that disagree why should immigration be an exception? Everything else in this country is money driven. That's called capitalism.
BTW there is already a VIP line, it's just not (only) money driven, but you need to know the right people. That's even worse and more unfair than a transparent expedite fee.
I don't want to jump the line ahead of you. I just want to sponsor an additional adjudicator who is going to process my petition and in his remaining time possibly even yours.
-
I got helped from my senator. I'm pretty sure i got a timely result cause my senator inquired on my behave.
Where do you guys find those nice senators? I have contacted offices of 2 of them and they both acted like USCIS call center reading to me the status from the USCIS website and telling me to wait. BTW I filed before you.

In case of an RFE do you get a text or email if you signed up for one?

GET MARRIED AS SOON AS SPOUSE ARRIVES IN USA!!!! I DO NOT UNDERSTAND WHY THIS IS SO HARD FOR PEOPLE TO COMPREHEND!
DO NOT PLAN WEDDING CERAMONEY UNTIL SPOUSE ARRIVES IN USA! AGAIN, I DON'T UNDERSTAND WHY PEOPLE PLAN WEDDING CARAMONY BEFORE SPOUSE ARRIVES OR BEFORE SPOUSE HAS ARRIVAL DATE AND THEN COMPLAIN THAT THE PAPERWORK IS TAKING TOO LONG!
IF YOUR SPOUSE HAS TO LEAVE THE COUNTRY BECAUSE YOU DIDN'T GET MARRIED WITHEN THE 90 DAYS, IT IS YOUR OWN FAULT. 90 DAYS IS MOR THAN ENOUGH TIME TO GET MARRIED!
IF YOU PLANNED A HUGE CERAMONY AND ARE UPSET THAT YOUR SPOUSE WON’T BE HERE WHEN YOU HAD PLANNED, AGAIN..YOUR OWN FAULT! DON'T MAKE PLANS UNTIL THINGS ARE SET IN STONE!
JUST TRYING TO HELP PEOPLE BEFORE THEY REGRET THEIR DESCIONS.
And who are you to tell us all that in this tone?

Why does he need to travel? Does he travel a lot for work?
Very curious. Unbelievable.
Countries with Easy Marriage

Does anyone know countries where you can get married without much paperwork? In some USA states this can be done on the spot with just 2 IDs. I've heard something about Hong-Kong but don't know the details. Denmark seems to be the easiest in Europe, but still nowhere close to US.
