You want to know why the system is like it is?
Very simple non-participation.
A perfect example is this petition. It's a simple, logical, non-partisan solution. I have posted it several times here on VJ and many other places. It's been seen by thousands of people like us.
But it only has 29 signatures so far. We all complain about how process is so slow and unfair, but we do nothing. We don't even take a few seconds to sign a silly petition.
Companies lobby and spend money in their interest.
Even racist nut cases have insane petitions with more signatures.
"Show the video "STOP WHITE GENOCIDE" in all Federally funded Diversity Training!" 721 signatures
"Teach public school children the truth: ANTI-RACIST IS A CODE WORD FOR ANTI-WHITE!" 826 signatures
"STOP WHITE GENOCIDE: Halt MASSIVE third world immigration and FORCED assimilation in White countries!" 966 signatures
We b*tch about the system but take no action. How can we expect to be taken seriously when even the crazies are more organized and motivated than us?
Don't be surprised when there are another 12 million people in the system if it takes a year or two to process a visa. After all why should they care when we don't even care enough to speak up.
You really want it faster? Sign the petition, put it on your facebook, and tell others. Even people who are against immigration reform can agree that US citizens who sponsor visas should be given equal consideration.
If you do nothing to change the system then stop complaining.
First get mad, now do something about it.
Yes, you are right. I was shocked too about the low number of signed petitions while there are thousands of VJ members while the petition is very well prepared and formulated. Some petitions with broken English get tens of thousands of signatures.

I plotted the data myself from VJ, ignoring the obviously expedited ones, and all those with RFE's.
Not a pretty picture.
Looks like there are 2 piles of applications...
Good job!

You are obviously new to all this. Chill out and keep waiting. There is no way you can "ping" them. Do you really want to know where your case files are? They are in a box, stacked up along with other boxes, boxes and boxes of case documents. They do them one box at a time. It takes on average aboutt 5-6 months.....but you didn't count the holidays did you? They were on holiday then and no one worked on any boxes. You can call and they WILL tell you to call later, in 30-45 days. They really do not know exactly where your case is at, except how it was logged in and how they mark those boxes.
VSC is presently working, on average, NOA1 dates around July 29, Your NOA1 date is in August, so on average, they are not expected to get to your until a couple more weeks.
You really have to learn to be patient since this is only the beginning, you have similar waiting for AOS and then ROC and then of rGC renewal and maybe Naturalization.
Chill out and relax, your documents are just fine and should be worked on soon.....more or less.
I cannot hear that 'wait patiently' like a sheep anymore. No, absolutely not. Be active. Flood them with calls and requests. Protest where you can. Write letters, talk to the media, use your rights. If everyone is waiting patiently nothing will ever change with this inhuman process.

I am convinced this is an intentional delay. The workload is the same they are just taking several months to do the work. Essentially they are just 6,7,8 months behind on the work they are required to do. Expedites is the entire problem. There are people getting their K1's from application to interview in less than a month. If everyone had to wait the same and expedites were eliminated the "important people" would make sure the process got changed so it would be quick for everyone. This process is severely flawed if the wait times and requirements were actually preventing fraud then it would be worth it, but there will never do the things that would actually reduce fraud. Instead we wait in a queue for someone to do about 20 minutes of work when actually this should have been done the day after they got the application. What is there to do? we cant actually go to their competition for faster service.
There are people getting their visas faster but they are not the type of people that read and post on groups online. I wished I had done me homework a little better and educated myself a little more. I am not a wealthy person but there is many things more important than money. A judge or government agency in charge of family decisions and they make these decisions like they are ordering lunch and with no compassion I don't know how those people sleep at night worrying about the decisions they make.
Of course it is intentional delay to discourage people from filing. The work load will not accumulate for them endlessly. At some point the wait will become so long that very few people will bother filing and chose different ways.

Unless the fee was truly astronomical (and I hate to be unromantic, but if it was I'd have to live in the real world and pass on it) I suspect a lot of people would pay more money, which would result in the expedited service slowing down and not being very different to how things are now. This could be detrimental generally - continued slow service but higher fees - lose/lose?
It would have to be some staggered fee with a decision time guarantee. eg. $1000 one month, $5000 one week. Like most countries have for their visa process. The more you pay, the faster you get it up to same day service.
-
Most ppl would pay it so the expedite process would then become as long as the regular wait so in the end it wouldn't be worth it.
If done right this would not happen. They should not use the fee to just put you in front of others. They should hire new stuff with the expedite fee. If the expedite fee were $5000 it is more than 10 times the actual costs. So this would benefit also the people in the regular processing.

Has anyone experienced an expedite request causing any retaliation on the side of USCIS? Like if they deem it unjustified they send RFE as a punishment or intentionally process the petition slower?

Funny I've never heard of one person having been asked of their "intent" at their marriage based interview, let alone being denied for it. Not to mention that it's not even asked on any application associated with getting a green card (while being a drunkard or prostitute is). It's a non-issue with AOS based on marriage and is an issue that is dealt with at the POE when the alien talks to CBP. Certain countries are in good standing with USA and the benefit of that is not having to obtain a Visa to enter thus allowing an AOS based on marriage. There aren't millions of British Citizens trying to crash the border to get a "better life" with a marriage of convenience. If the marriage is GENUINE, I'm pretty sure a blind eye is turned to their possible intent.
The OP was already aware of "intent" and was simply asking which was quicker. Yet, No-one could answer without using the words FRAUD or CRIMINAL.
Well said.

What I find amusing is people that post their thinnly veiled intent to violate immigration laws on a board that is monitored by immigration. Doesn't anyone know about IP addresses and the governements ability to know these things ?
If immigration monitors this board - which quite possibly is the case - it explains the ridiculously long processing times.

Is this visit for a long term affect our aplication to K1 visa?
If you do not overstay the at the entry granted period of time it can only help your K1 as you have a solid ongoing relationship. You probably don't want to make false statements at any point as this could come back to haunt you.
-
I'm agree with them. Even if you dont mention the k1, or that you re quitting your job, I wouldn't take any risk. the 1st part of the k1 package (the one he need to send) it's not complicated. He must follow instructions and that's it.
What's the risk? Being denied at the entry point and wasting a plane ticket? On the flip side is spending many months of the K1 process alone. Of course I would take that risk. This is one of the very few human ways of going through the process, another one being moving to her or 3rd country for the duration of the process.
-
If you mention the word K1 at the entry there is a high probability you will get denied. Otherwise a good plan to wait out the painful K1 process with your loved one. Not sure about your daughter's school.

Am confused! U applied for k1 visa then why do u need a tourist visa?
Maybe he wants his fiancee to visit him during the waiting time. I think this thought must have crossed the mind of most of us including me. So far I deemed the probability of obtaining a tourist visa very low. I think trying to cover all the standard criteria for a tourist visa are pretty much pointless since the applicant already stated the intent to live in the US by signing the letter of intent to marry. You would have to come up with some exceptional and convincing reasons why the applicant will return to regularly complete the K1 process rather than using the tourist visa as a short cut and adjust status from that.
The problem with US tourist visa is that actually the consular officer is not interested in listening to any special explanations which is in complete opposite to visa applications to any other country where you can submit a letter of explanation and such a letter is always very welcome as it allows the CO officer to make a picture of the situation. I was able to get my fiancee tourist visas to any any country in the world including our Northern neighbor without any problems, but still have no idea how to go about US tourist visa.

Yep I'm in the same boat :S it does seem like they are going slower...I looked last week and it said they were Processing the end of September & NOW it seems to say July Again ^^;;
Forget the charts on Visajourney. They simply use wrong algorithms. They should be corrected or torn down. The way they are now they create more harm than good by misleading people and causing wrong planing.

FYI wait times are long from a combination of factors, not just this new program. It is mostly because USCIS has laid off half their employees and dramatically cut funding in the last 2 years. That you can thank Congress for.
If you don't have the money for a complicated process, make the process simpler.
-
This country is treating its citizens with disrespect. Rather than making proper laws they try to do natural selection. The longer the process the more people will be discouraged from filing. So the processing time will increase until the rate of incoming petitions decreases to what they can or are willing to process. This may well be the unofficial policy.

Noah Lot's posts are rarely supportive. He might be working for a government agency (USCIS, DOS or something similar). I would recommend to everyone not to post on this site with an account containing a timeline. He does not have one either. This site has a huge privacy problem. You can nearly always be uniquely identified by your NOA1 date and beneficiary country. However so many people post sensitive information assuming they remain anonymous.
-
Because nobody protests. That's why they can take our money and treat us with disrespect.
Would you pay expedite fee?

As an individual you have very little chances and if you try hard alone you may make it even worse for yourself. Only as a mass you can move something. And I do think that someone in the background of USCIS is pulling the strings to make sure the system is as inefficient as it is.
