    After Filing Your Petition

If your parent is currently in the United States, your parent may be eligible to file Form I-485, Application to Register Permanent Residence or to Adjust Status, at the same time as you file Form I-130, Petition for Alien Relative. For information on how to file this application, please refer to How Do I Become a Lawful Permanent Resident While In the United States?

You will be notified by the USCIS if your I-130 petition is approved or denied. If it is approved and your parent is outside the U.S., your parent will be notified to go to the local U.S. consulate to complete his or her visa processing. If your parent is legally inside the U.S. and did not file the Form I-485 Application concurrently with your petition, he or she may file at this time. For more information on adjusting to lawful permanent residence, your parent may refer to How Do I Become a Lawful Permanent Resident While In the United States?

  2. Hello Everyone,

I will be USC soon, as I have filed my N400 5 months back.

I am planning to file for my parents green card right after I become USC.

My parents has visitor visa, and they both have been here before. My mom is coming this August for 5 months to stay, while my dad will visit for a month or so at the end of December.

    Few questions:

    1) Which documents are needed for filing my parents' Green card?

    2) Which address should I provide as their resident? As my mom will be staying longer than my dad, do I put two different addresses for both of them? And Adjustment of Status, if I file, and they are not here at that time, what happens?

    3) My parents are ~55 Years old. They will be getting insurance from India for few months, but going forward, what are my options? I doubt they will work here, or even if they do, it would be more of work from home thing, which won't provide insurance. Obamacare or any other options?

    4) Filing AOS here is easier or filing it by providing their address as my home country (India) will be better/easier option?

    Thank you all so much.

    Thanks,

  3. You're still stuck waiting on being put in line for an interview. People have mentioned that means you're stuck in background checks and I'm assuming it hasn't even been forwarded to a local office yet. Not sure what you can do under those conditions. Did you speak with a tier 2 representative, or just the first person who answered? The first person can't see any more than you can, so they're pretty much worthless unless you don't know how to look up the information yourself.

I talked to tier 2 just now. the guy said he doesn't have information if the background check is done or not.

but he sent a message to field office asking for interview date to be scheduled. and asked me to check back again in 2-3 weeks. and he said that the office's reply might be different than what he's assuming the reply should be.

it was all confusing, but i'm keeping my finger crossed.

  4. Nope. There is no case status change for biometrics. Mine went from Case Received to In Line.

    mine still says

  5. guys, I have indian passport, expiring in mid june this year.

do i need to renew it or should i wait for my interview and get it renewed if needed

I have applied for my US Citizenship N400 in Feb 2016. So in 4-6 months, I'll be getting US Citizenship.

also, I am not planning to travel anytime soon. so i really don't need indian passport

but do i need indian valid (non expired) passport when getting OCI or something like that?

  6. If you're keeping Indian citizenship, then you likely want to renew it. My wife plans to keep her Philippine citizenship after she obtains US citizenship. A passport is one of the best proofs of your citizenship when you need it.

I am not planning to travel.

I will get Indian government's Overseas Citizens of India (OCI) and Person of Indian Origin (PIO) card, but that wouldn't give me indian passport.

not sure, when you become US citizen, do you need to give your original conuntry's passport back to them? if yes, does it need to be non-expired?
