    They do need to be reminded of it. "They are working on it." They have been "working on it" forever. The only thing they are really working on is re-election and fundraising.
    Useless career Politicians.
    Some of you VJ members should run for State Rep or Senator. Forget the paperweights that are currently in office making a mess out of everything. Then some change might truly happen.
    Regular people representing their neighbors for a short period of time, then going back to their real lives... Not some out of touch politicians. No wonder why nothing gets fixed.

    Hahaha imagine how ridiculous it would be for a non-immigrant visa holder to accidentally come across such a piece of info and step into the US with a "don't fall in love don't fall in love don't fall in love you are NOT ALLOWED to fall in love" mantra running through his or her head. That would suck.

    Read the instructions, submit a new petition with the attached documentation required. Filing an appeal will cost more and take longer. Forget it. File a new petition.
    You are not entitled to an RFE. USCIS can simply DENY a petition IF you do not submit enough evidence that you have a petitionable relationship with someone. If one or two things are missing, they send an RFE for the missing things. If all you sent was an I-129f, they are not going to bother with you and just deny it.
    1. READ THE INSTRUCTIONS carefully, interpret literally. EVERY thing you claim must be proven with attached documents. You are a citizen? Prove it. You intend to marry? Prove it. You have met in person? Prove it.
    2. Collect the needed documents and file a new petition
    DO NOT submit an appeal. Just send in a new petition. The appeal will cost more and take longer and you will lose

    If she has overstayed her visa, she needs to leave. She is going to get caught, and her odds of being allowed to re-enter after will be severely affected. Everyday she remains in the US illegally will make it harder for her.
    Time to go. If she flies, chances are she will be caught quicker. Help her get home.

    Most people in the US have never been out of the US... Yes, it is going to give them a closed minded view of things, and their main source of information is the news. You can't change that. Only thing that would is them leaving the comfort of their couches and exploring the world we live in a bit...
    Your an American, married to an Egyptian. Time to get thick skin, and don't expect people to be accepting. They won't be, even the ones that seem ok with it will change their tune real quick if anything happens. I go through it all the time. Half the people think my wife trapped me, or that she was a call-girl I fell for. The other half focus on religion. There's just no getting around it.

    The CR-1 application states no where that I have to be living in the US though... where do you find that information? It's sure not stated anywhere...
    Having a GC also doesn't state that you have to live in the US, we can easily maintain an apartment there, and go back and forth so show we're there throughout the year. As long as we file taxes, that fulfills that requirement.
    We leave, file the notice of leave forms...
    Meh, its a screwed system, with a screwed sense that everyone wants to go there. Only people from countries that are ####### would want to migrate there. I've seen more homeless people in one city alone then I have in the entire time I've lived in Malaysia... go figure.

    Well, I suppose if we went thru the process of getting the GC, then it gets taken away, we should be able to obviously prove that we have no intent of staying in the US at the subsequent tourist visa interview again...
    "I ma here for a tourist visa"... I had a GC, but since I did not stay in the US, it was taken away, hence clearly demonstrating that I have no intent to migrate to the US"
    ...that might be enough proof for them?

    I think you're misunderstanding Mimolicious. We do not want to migrate into the US.
    The legal way for us is a tourist visa, since we only want to be able to visit. By denying the tourist visa, we're being forced to apply for a greencard, that we don't want.
    I just don't understand that mindset of "everyone is an automatic immigrant". I double don't understand the interviewer who doesn't even look at the proof that clearly shows all the ties OUTSIDE of the US. How to prove when they don't even look at the proof?
    I'm lad for everyone who WANTED to move to the US with their spouses, and went thru the paperwork to do so. This just isn't our case, but it appears we're being forced to go thru this avenue, because of the assumption that it is what we must want to do...
    Pretty arrogant policy.

    IF, for some unholy reason, I ever move back to the US, I am running for Congress. This system could have been designed smoother by Chimps.

    You missed it aaron. I file. I'm not required to pay. It's simple really. I'm not required to pay because I am not a burden on taxpayers, and I make below the guidelines that would require it.
    This entire visa process is paid for. Believe me, the US Embassy is raking in the $$ from all these application fees collected! You taxpayers back home aren't footing the bill, you're benefiting. Just to apply for tourist visa costs 512 each time... Funny my tourist visa into Malaysia was free, as many times as I want it. US Government greed I suppose? I guess the million collected from greencard applicants wasn't enough...
    Not asking to be an exception either. I think you're assuming as much as the embassy staff. Just want a tourist visa to go in, say hi, and split. We'll leave the snow far behind without a second thought. We can see it on the tv just fine.

    See, I was stating hypothetically, IF she wanted, we would apply properly. The plan is only to visit, then return to our home, job, business here in Malaysia. We don't want to stay there!
    And yes, every year I file my US tax return forms, stating my income overseas. As long as it is below a certain amount, it is tax free... since I am not a tax burden to the US.

    You mis-read. We don't want to adjust status. We are both happy living abroad. My business is abroad. My home is abroad.
    You understand wrong about the taxes. Americans are only required to pay taxes if they earn above a certain income threshold if they live and work abroad. I just have to file stating my earnings, and ensure they are below the guidelines. I am just taxes on anything above.

    But see, I think you're missing the problem. There is a legal way. It's called a tourist visa. We do not want to live there, nor should we be forced to apply for I-130, a greencard (that can then be taken away if we don't live there!)
    When we say we just want to visit, that's it. There is no intent to stay. My life, and hers is outside of the US. Why apply for a greencard when we won't be needing it, and someone else can use that number who wants to be there? We just want to visit once a year. If we apply for the I-130, get the greencard, and then are gone for most of the year every year, it can be taken away. Then we're back to square one all over again.
    We're not wanting to break any rules. We just want to be tourists!

    Yes... Tax free. You only are liable after you earn a certain amount. File doesn't mean pay I don't work for a US company. I'll pass on the 33% taxes I was stuck with back there!
