  1. Hi everyone, Mine's priority date is June 13. The NOA1 said that it will be process on the national benefits center.

    Sounds good. We had our I-130 done through USCIS and we waited close to 10 month average for NOA2 approval.

    Hope NBC process runs quicker for you.

    After this you be with NVC for I-864 and DS230. This will keep you busy.

    Get your documents in order and organized for a speedy process.

    Originals plus copies of originals.

    Print out your 864 and 230...It helps to fill them out beforehand and provides some understanding.

    Just saying be prepared...and you have a smooth ride.

    We already send AOS checklist but still they remind us.Does this mean they dnt receive yet???

    You send it by express with tracking...right. You know they got it.

    This is possible just another computer click.

    I received emails more than one time in regards to my checklist.

    You give them a call next week and make sure.

Yes i will be but i never be so rude MIL smile.png, i call NVC just now,i ask about DS 230 the guy who answered said its in system,when i ask is there any checklist for DS 230,he replied like there is no checklist its fine ,(like DS 230 is set), and he said something "we are waiting for petitioner approval or something" its not very clear.

    Will they ask any approval for DS 230 from petitioner?

    then i ask about i 864 checklist process,he said you have to wait 20 working days from the day you send.

    This is good news. DS230 done.dancin5hr.gif I'm sure he meant petioners 864 to be approved. I'm sure this runs through next week.dancin5hr.gif

  4. I was sharing an apartment with a friend and a friend of her was married to a USC for a year and they got into a dispute, seperated ect..... on the interview date she got an attorney but didn't help much she was ask to leave US.

    Its rough. I think my first husband took care of all my paperwork back then through the Army. I don't recall much. I already had kids. My second husband gave me hell. I already had the unconditional. But he just wasn't nice. It can become a really tough life for some.

    Some don't understand that when children are involved its even harder. Just because you have a baby doesn't mean you get to stay. Neither do you get to take your child with you.

    Anyone going through IR-1, K-1, I-129F ..........will have 2 interview total. First one is the spouse (beneficiary) will be held at your country, second one will be here in US and this time both will need to be there. If your interview is approve, you are done and free willy from this point on. Neto you'll need to read others post carefully to avoid confusion.

    That's right! and if a couple still married after 3yrs, LPR holder can apply form N-400 to become USC, counting from the date you received your temporary GC. Now if they get divorce after 3 years meaning he/she have 10 GC on hand, an LPR will have to wait 5 years before applying for his/her USC. If a couple divorce before 2 years, beneficiary will need to prove abuse or other legit statement to CO during interview to be eligible for 10 year GC otherwise i'm sorry she/he need to go back.

    I saw this wierd couple at the time of my interview where a guy (must be usc, because he keep saying to his spouse good luck on your 10 GC) were with a new girlfriend and I assume ex-wife where with an attorney, CO interview them both seperately, not sure what the outcome were but she ( beneficiary ) and her attorney seem to be very happy when they came out.

    7.1)...Please explain "Conditional Permanent Residency"?

    A.. A two year Conditional Residency is granted to those who apply for Adjustment of Status based on marriage to a US Citizen. This two year period helps to deter visa fraud and marriages of convenience. During the "conditional" period, you still have all the rights of a Permanent Resident. Your status as a permanent resident expires at the end of this two year period unless you file for lifting of the conditional status.

    7.2)..When do I become a Permanent Resident (conditional status removed)?

    A..You become a permanent resident (conditional status removed) after approval of the I-751 "Petition to Remove the Conditions on Residence".

    7.3) ..Okay, when do I file the I-751 to lift conditional status?

    A..Option #1: If your passport is stamped with the I-551 at the adjustment of status interview, the stamp has the AOS approval date written on it. Your 2 year conditional period begins with that date. Ninety (90) days prior to the end of the conditional period, you and your US Citizen spouse will apply together for a removal of the "conditional" status by filing form I-751 together as a married couple.

    Option #2: As is more likley the case now, the I-551 stamps are not automatically given at the conclusion of an AOS interview now due to namechecks and files moving around. Green Cards are routinely mailed to the beneficiaries within 4 weeks (if approved) or delayed by months due to name checks pending. The accurate date of your PR is printed on the front of the GC as 'Resident Since:".

    Parent will automatically received permanent GC no question ask once they put a foot on US soil, unless one didn't pay the $165 fee laughing.gif. She/he will have to wait for 5yrs counting on the date of receiving his/her GC before applying for his/her USC there is no way out of this one.

    The people I responded to only questioned what the route is. I seen on their timeline K-3 . It just wasn't necessary....

    I hope Neto123 disregards all that. I just like for her to get through this still intact.

  6. They received 4th June ,its almost 8 working days completed last friday. My hubby dnt like to call NVC any more, he said let it happen whatever,i dnt like to call them,NVC people are so rude to answer my question.

    sad.png, so i cant ask him to call NVC.

    In some ways I agree, calling doesn't speed up anything. I don't really see it making a difference.

    But it helps when their is a checklist issued, giving us a little advance notice.

    And of course we feel by calling that we have done something.

    I kept my question really short. "Please check if my 230 is in your computer", when they actually told me YES, I asked if I had a checklist, which I did. This way I could quickly take care of it.

  7. Both of which require evidence. A GC will NOT be revoked if a waiver is filed. They will not 'take it `away'without an appearance before an Immigration Judge. It is far more complicated than that.

    This is true, the I-129 for the K3 is for a non-immigrant. However the K3 is unique in that you did NOT immediately file for adjustment of status. In the past you had to wait for a visa number to become available This is why the K3 is now outdated - because a visa number for the spouse of a USC is immediately available now. There is no point on entering on a K3 and adjusting status when it is a longer process than just filing the I-130 - anyone who thinks this is the correct route should be set straight.

    And on that note, I'm unsubscribing from this thread - since I now have my visa.

  8. Not true - you file the I-129f for the K3 concurrently with the I-130 for the CR1, however now that I-129s are taking similar time frames to the I-130s the K3 is essentially defunct.

    It's not an opinion - it's a fact.

    I'm not arguing that the GC is conditional, however even if you diovrce as long as you can prove the mariage was entered into in good faith and file the appropriate I-751 waiver you do no lose your GC.

    Please do research before you spout incorrect information.

    Essentially you said the same thing. Not everyone can proof they entered their marriage in good faith. Its easier for petioner to simply say before 2 years time he/or she was taken for a GC ride.

    The I-129 is for the K-3 to enter as NON -immigrant...Than you immediately file for Adjustment of status.

    But if you solely file I-130 with beneficiary still out of the states...the route is different.

  9. This just isn't true. Most people receive their 10 year GC without ever having an interview, and certainly without the USC being interviewed.

    Okay...than we have different opinion on this one.

    My opinion is that the GC is conditional for 2 years (to proof that the marriage is bona fide)

    People who divorce before 2 years lose their right to the GC (unless they can proof hardship (like abuse) in marriage and file for U5 visa...

    Parents of US citizen receive unconditional GC. But this is solely my opinion.

    I've seen you filed for K-3 visa. Its my understanding this is one visa the spouse can enter as NON-immigrant and you file for Adjustment of Status Form I-485 once inside the U.S.

    Everyone on this forum filed through the embassy of their country. We all started with the I-130.

    But if you do this, you disqualify yourself for K-3 visa.

    Not sure what direction you go.

    Ours been: Form I-130 ...DS 3032...Form I-864....DS 230...Medical...Interview

    This is for when spouse stays in home country until process is finished.

    You receive a conditional GC for two years. After the 2 years YOU and YOUR hubby have interview. After this than your receive your unconditional GC.

    I have never gone through this, but READERCHOICE is correct.... Don't think this far ahead.

    Answer all the questions to the best of your knowledge....if you don't know the answer....tell the officer....Never make anything up.

  12. Yeah that is what you said last time when submitting DS230 laughing.gif . At this point I don't see anything else could be a problem with your interview and should be quick and smooth sailing. Only thing is you will face is a the inflation of airline ticket price during high peak season laughing.gif can't help you there.

    There is nothing else...cray5ol.gif I have someone who owns his travel agency. Through him there is no middle man I have to pay.

    I have hope..diablo.gif I like all this faces. When I send my son home I paid 800 Euro. Booked 2 weeks before depature.

    But who knows. He might be on vacation himself at this time...hahah...

    I'm sorry. It sounded worse than it should. You just did overcome your 864 obstacle. You send it out.

    As long we follow what they want from us...we eventually get done.

    I am sure you get through NVC stage by end of this month.

    The interview appointment is worse on me. The waiting...I can't do nothing until I have my passport back.

    Its really awful feeling. You can't buy an airfare ticket....Its really tough waiting.

    Everything else before was leading to the next step...but when its the final...its really emotional.
