  1. I'm from a third world country where men are always right, and women don't even have the right to file for divorce. And I would go back. OP thinks she can get back on her feet with 8k or half that, 4k. Well if she does win her divorce battle, she still has to win her immigration battle which in this case, I don't see it happening without the help of a professional. So she would have to hire a lawyer, and then wait till her green card comes, and get a job, you need a down payment for a car to get a job, and without a job you can't have the down payment. See where I'm going with this? That's the bad thing about coming from a third world country and marrying someone in the military. Because you can request advances,because if you live on housing you don't have to worry about rent, utilities and so on,you don't get a clear image of what's a priority and what's not and how much things can cost. OP needs to reevaluate her priorities.its fine and natural to want to visit your family during a time like this, but if you want to stay in the states, win your green card and and get on your feet you can't worry about seeing your family and going back home and all that.

  2. That's a pretty big gap. We vj members usually suggest marriage for High fraud and specially African countries, but because of the thirty year old age difference, and the fact that she is literally an elder citizen, I don't know how that is going to help.   3. I appreciate all of the response so far. Okay let me try to add some history here so maybe I can get some suggestions and some help rather than just criticisms. We met 6 months ago and we talk almost everyday morning noon and night. She has a married sister living in the US for the past 3 years who I also talk with on a regular basis. Also spoke to her husband who met the entire family. The both assure me she is a good girl and comes from a good family. The subject never came up until recently when we began getting real serious with each other. She told me about being denied a fiance visa on Dec 14, 2011 with another man. She emailed me the documents showing the reason for denial and when I saw that I was shocked. She is also very upset to be considered a prostitute when she has never been involved in that kind of work and has not worked in any bars. She works in an internet cafe. She is from Samar but now living in Angeles City. I think the interviewer already believes she is working in a bar just because she lives in Sin City. So at the end of the interview he began to ask her about her work and kept on insisting that she works in the bars as a prostitute even though she kept on denying it until she says he started to talk very loud accusing her and she became very scared and nervous and said yes just to end the interview. i have yet to visit her in the Philippines and I have not applied for any sort of visa. I am thinking to marry her there and try a spousal visa. I only sent her money for her birthday so she could buy a gift and have a cake and some foods for her friends and relatives. I attended the party myself via web cam. Sorry this is so long

    Here is the thing,Angeles might be the sin city, but the COs are not naive. Is not like uscis and department of homeland security mass train a group of officers and send them off to different countries. Each consulate has officers who are aware of the norms and cultural differences. So don't be dead set in justifying denial with the idea that the CO couldn't tell the difference between an Internet cafe and a bar or that they think everyone from Angeles is a prostitute .

    The Counselor Officers have a tough job. It would be refreshing to see a petitioner or beneficiary who has failed come here and admit that they didn't meet the requirements [regardless of how well they think they were prepared] and that the Counselor Officer made the right call.

    Well then you would have been delighted to see my interview review had I been denied. I had very little pictures, my fiancé wasn't into taking pictures and in each step I was requested evidence I sent the same pictures, we had no phone records because he didn't own an international phone and I was ready to get denied, and If I had gotten denied I would have completely understood. While my CO seemed very... Sneaky for the lack of a better word, she was an angel to approve me with the little evidence we had. I do feel its unfair to COs or uscis officers when people think they have a say or choice in what we are told or what happens or like they do thinks out of prejudice., however I didn't think like that two years ago while I was going through k-1

  5. I guess I'm misunderstanding what a deployment is??lol I'm not trying to go to war zone and my fiance(air force) is not going to war zone either. Just his next base is Fort worth, texas which people get jealous cuz the base is easy and not trying to make people work like crazy here in misawa. Is deployment going to war zone thingy? or just next base order? I would not be alone in the states since my fiance is gonna be there. I'll be alone here in japan for a few months(hopefully!) till I leave here for my man. And I don't know how to call you, should i call you that girl2? but anyways, thank you!     The next base order is getting relocated. A deployment is when someone goes to war.well you see being alone while your partner is oversees or being in different states is a part of this life style.how it goes, is your fiancée leaves for Texas, you get your visa paperwork and interview all out of the way, you fly to Texas, you get married, then he gets deployed to a war zone, the real deployment, for real. Now if the us citizen is getting deployed, you can expedite and it will 99.99% get approved. From the looks of it you be eligible for expedite for your green card after you come to the states. Fort Worth is a regular old army base. The reason people get jealous, IF they do, is because there is an air man getting stationed in an army base. Don't worry. And if you had any questions feel free to ask others here or if you need emotional support message me , I know my immigration knowledge isn't complete , so it's better if you ask others and make sure as well.

  6. Okay well I'm guessing his addresses for both his current japanese base(mailing) and residential adress? are fine. He's going to call USCIS for changing the address about 2 weeks before he leaves here if that's fine. We're gonna call Military help line this weekend and ask them if that's fine to put his japanese base PO address for residential and mailing address. What I'm really concerned about is the address where I intend to live in the states. Like I said before, we put his new base address which is in Fort worth texas(It's the base address, no street and blah). We didn't put his order so I don't know if they would figure out that he's going to be deployed there.

    And I'm thinking about trying to expedite our case whether it works for us or not, but if it didn't work then, it would be a reason or something like that to our case to get denied or something?

    I wish I could marry him now here in Japan but I still am stuck in high school sadly. I went to the states as a rotary exchange student for about a year. even though i did my senior year, i had to re-do my senior year back in japan so im stuck in school... so sad! cuz i was supposed to graduate last march! well anyways it's what it is.

    No, denied expedition doesn't mean denied case. And why are you so set on finishing high school in Japan when you have done your senior year in the states and go to college here? You won't be denied. Your case is completely easy and straight forward. Trust me, I have seen some twisted cases with red flags and overstays with people from high fraud countries that got accepted. Yours is nothing.

  7. try to do expedition but your not married to USC military personnel , your just fiance , .... if u want to expedite your case , get marry now in japan, its more easier , less hassle, expedition will be granted!!!!!!!!

    in case of him going to war zone area. they will not give you expedition bcause he will be deploy in war zone , govt will not allow you to go with him in war zone........... for sure you dont want to go there either.

    Umm no, you get expedited when the armed forces partner is getting deployed, regardless of your visa , green card or citizenship status, because you will be left in the states alone.you won't be able to go to the war zone but that's not why or how expediting works.

  8. Ah Thank you guys for the replies! It made me feel a lot better but I still am concerned about my future address.

    We put his next base in Texas for my future address because we thought we would not get our NOA2 by he leaves here which is on January 22. Do you think that's fine to do? but we didn't put his order in our package. I'm guessing we should have done it??? And we're currently thinking to call military help line this weekend. But here's a problem. That is a deployment to go to Fort Worth, Texas but how can we expedite our case? If he is now in the states and going to Afgan or somewhere in a few months for a year then things would be different but how could we? If we expedite our case, it would be just awesome! cuz the waiting is so hard even though I know Love is patient. Even though he leaves here in Jan, I cannot leave here till March 1st due to my school. It would be nice if I can go to the states to see the love of my life right after my graduation.

    Ok look I'm making a cross country move in January, and I'm changing my address on file to my mother in law's because I need to have someone to hold on to it. That's the problem. Will anyone be able to hold on to his mail before he gets to Fort Worth ? In case things get lost uscis does resend noa 2s and RFEs as long as you KNOW you got one and you call them and explain yours got misplaced. As far as the request for expedite goes, you type out the letter that I'm pretty sure you could find under " military expedite request for I-129f ", he signs it, attaches his orders and adds a copy of his noa 1 and mails off to the service center, some people like to fax it too.as far as what is in the book with the specific definition of deployment goes, it's deployment to a war zone that makes expedites really easy, but if the word " deployment " is mentioned in his orders go ahead and give it a try.

    As far as the wait goes, don't even worry about it. By the time you get done with your interview you're going to laugh at yourself for being so stressed. I know it's hard to believe but k-1 is as black and white as people make it sound like and it is as easy if you go on by the guides of visa journey

  9. They are very dis-honest people who are told to say those things.,.,.,I am a June 28th NOA 1.,.,. and I know of 20 approved K 1's on this site alone.,.,.,.,so how can they say they are working on May 14.,.,.by the way, how do you get to talk to a teir 2 person? Anybody know? Thanks, Raven

    And why are they dishonest? Because they are not telling us what we wanna hear? Approval doesn't take five months because they hate the petitioner or are racist or because of discriminations. It isn't personal and those officers are not lying monsters.

  10. This subject and issue comes up every year, around every holiday. The truth is, there is no method to this madness.you can't say because ONE petition from X month got approved, they are looking into that month. Sometimes files get mixed up. Sometimes someone expedites and they randomly choose to accept, sometimes some cases are left behind, the petitioner makes a service request and they become priority. You can't count on ANYTHING. The only thing you can keep track of, is how long your case has been dragging along. If it is outside of the service centers window, that's when you CAN be outraged or demand faster processing and all. Know it's hard for Americans to understand and be content with the fact that there is nothing they can do, but in immigration, because its a privilege and not a right, there really isn't anything you can do.

  11. 1.no, he has two year green card, he can apply for ten year himself with a divorce waiver.

    2.it won't be an issue in a sense that it won't be ground for denial. BUT it will come up, and you WILL have to do more than usual explaining considering you first got fraud verdict and then got separated so soon after his arrival. As far as your options before filing goes. Sure. You can get married and live together , but don't fall for those who try to convince you to file for adjustment of status instead of ir-1. That's visa fraud.on and all, your case is nothing special, don't get scared or nervous, just study similar cases.

People are not the hardcore Muslims now as they were 20 years ago, so it's understandable for a Muslim woman to be fine wi a Christian man. Is not a red flag, it's not an issue, it's just something that you might have to explain. My mother who was my legal guardian at the time wrote a letter, stating she is aware of my fiancé's religion and country of origin and that she is fine wi it. We got it notarized and sent it in with packet 3.dont get discouraged OP. I can also suggest a Farsi website for your fiancée to gather information and feel better about the process.   13. That is complete and utter bullshit. That lawyer doesn't know whack. I'm a Muslim iranian citizen, and my now husband then fiance, who was also in the marines applied for my k-1 two years ago. EVERYTHING went smooth and normal, with no problem what so ever .I did EVERYTHING myself. Back then FedEx offered services to Iran so I even mailed things to the embassy myself. People have this image of iranian people getting discriminated against because of their government and political issues, but that has never been the case. Specially for liberal Muslims wo adapt to the western way and culture and fashion and speak decent English. I can honestly say you need to look into a new lawyer or doing it yourself

  14. Expediting mostly works for military members when there is deployment is involved. So you CAN try,you're entitled to it, but dont get your hopes up. As far as the address goes, he can all USCIS and change the address.My now husband was stationed in Okinawa when we filed and he used his base address too. It just took a lot longer for noa 1 and 2 to get there and noa 2 got lost a couple times. It's best to change the address a couple of weeks in advance so if they have already sent you noa 2 or rfe he will be able to get it.

    Ps. Make sure he calls the military number. They are way better than regular uscis

  15. Views processing estimates are not to be taken seriously, EVER , in any case. The amount of people who fill their timelines and keep up with it are low, it doesn't keep out of control things under consideration like an officer taking time off or the electricity getting cut or someone having to leave early and all that, BUT generally EAD and APs arrive before the biometrics appointment.
