  1. Hello,

I just received Form I-797C, Notice of Action in the mail. It gives Priority Date of October 24, 2012.

Preference Classification is 201 B INA SPOUSE OF USC

I don't understand, I thought that there is no need to wait in the immigrant visa queue if you sponsoring your spouse.

    Please clarify.

P.S. And I am yet to find the receipt number, starting with MSC in the system....

  2. On the upper right corner of your screen next to your username, there is a white arrow. Click that arrow and a drop down menu will appear. On that menu click " my settings" then click the "profile" tab and then click "change signature" option. You will have to input the information yourself. Once you have typed whatever you wish to type, click the "save changes" button. Your timeline at the bottom of your posts will then be visible.

    Thank you :D

  3. Yes, my Receipt # starts with MSC.

When I called the National Customer Service Center and entered it in, they say the number cannot be found.

I shall wait till I receive hard copy of Receipt Notice (Form I-797)

I sent the G-1145 form along with my petition, that's how I was able to get the email and text message that they received the petition.

How to reach a human by calling National Customer Service Center at 1.800.375.5283 ?

  4. Hello everyone,

    I am tensed.

I submitted I-130 on Oct 22, and I got text message on Oct 26 saying they received the I-130 and they provided me with receipt number. However, when I check status of case, it says, "Your case can not be found at this time in My Case Status. Please check your receipt number and try again.". However they cashed the $420 check I sent in.

    Any advice?

  5. I've read most of the existing threads asking if one should get their third-party affidavits of support for the i-130 applicaiton notarized or not. Most responses said they don't need to be notarized, particularly because affidavits aren't that important unless other evidence of a bonafide marriage is thin. Well, we're a little thin: we don't cohabitate, and we live in a country that doesn't allow for joint ownership of property--including joint bank accounts. So, all we've got, really, are photo evidence and third-party affidavits. In this case, is it necessary to get the affidavits notarized? We live in a country where notaries aren't really that common and will only notarize our "foreign language" document for a very steep price (about $225, which is hard to swallow considering you can get it done for free in the USA).

I'm paranoid - I made sure all our marriage affidavits (to state under penalty of law that our marriage is bona fide) was notarized. And I had my husband courier those notarized marriage affidavits all the way from India. You have no idea how much I had to convince him this was necessary and would make me a happy wife :-)

So yes, notarize your third-party affidavits of support. If you feel something in your gut, go with it!!!!!

  6. Here are the reasons:

he forgot to sign the i-130 form and it says that the application/petition was filed on an outdated version of this form. But we used the latest version from uscis. Please resubmit the petition on the current version. Well, this is not really a bad news because we can resubmit it again.

Oh my goodness, that is terrible. I am really sorry to hear about this trouble. This weekend, I was very nervous, trying my best to package the I-130 for my hubby. And on USCIS website they say they accept the older I-130 forms

    Edition Date :

    01/08/12; (08/15/11; 11/23/10; 06/14/10; 05/27/08 and 01/31/08 editions also accepted)

Note on Expiration: USCIS continues to accept the 01/08/12 edition of Form I-130 available here despite the passing of the form's expiration date. An updated form will be posted as soon as it becomes available.

I pray that all goes well for you both!

  7. Regarding your entry in Embassy -

If you husband has interview in Delhi, then you can enter normally with him in Embassy.

Well, I hope they let me come with him .... and I hope my being there will help him!

    Regarding pictures -

    ...

And also, I have numbers the sheet, and pictures and referenced them in cover letter.

e.g.... "I have submitting a affidavit from my wife's cousin brother who was present in the wedding (see tab # 4, picture sheet # 5, picture # 3), he is standing on my left side wearing ....cloths)"

Good luck with your journey...

    Keep us posted.

Good point! I shall identify the people in the photographs, especially if I am submitting an affidavit from them.

  8. Please take a note of following -

    1. How did you know him before marriage?

    2. Your meeting with him leading upto marriage?

    3. Wedding pictures

    4. honeymoon picutres, hotel receipts, plane or rail tickets

    5. trips you both have taken to visit family together and provide pictures or evidence.

    6. Any thing that proves that you are in married to him. (letters, emails, greeting cards, other things), some of those are very personal...USCIS want to see those.

    Good luck.

One of the affidavits will actually mention how we met before marriage, i.e. it was arranged marriage done by elders, then we were introduced :-)

  9. Hello,

I have been following this forum as it seems the most active and informative.

Right now, I am gathering the necessary documents to include in the I-130 petition for my Indian Husband to live in USA with me.

I have two sets of questions:

    1. USCIS recommends how to assemble documents here

Use ACCO fasteners to hold together thick or bulky applications or petitions. Two-hole punching the top of the material for easy placement in the file is appreciated.

    a) Does this mean it is ok if I punch two holes on top of the I-130, G-325A and the G-1145?

    b) I am also submitting several 8" x 10" photographs of the wedding, should I punch holes in these, or is there a special paper-protector with two holes punched on the top already?

    c) And what if I need to use two folders with ACCO fasteners, i.e. one for the documents, and another for the photographs?

    2. VISA Interview. When my Husband's VISA interview comes up, will I be allowed to join him in the interview? If so, I need to plan ahead. Right now, I have job, and I want to make sure I have appropriate leave, give advanced notice to my employer so that I still have my job when I return. Can you give your experiences with this?

    Thank you for any help

  10. Hello Ryan,

Thank you for clarifying my issues.

Right now, I am trying to assemble all the paperwork for the USCIS based on what they are asking. If they ask for one or more affidavit, I want to provide three signed, and notarized affidavits that state our marriage is genuine.

And of course the wedding photos .... there were nearly 300 of them, but I'd like to send 10 to 15, where it shows we are with our families, and photographs that capture true happiness and cheer.

  11. Hello,

I am a US Born Citizen and my Husband is an Indian Citizen. I wish to bring him to the United States so we can start our lives together.

I was reading through the forums, researching the Internet on the process to Immigration Visa for spouse. I want to make sure that all the forms are filled out completely and accurately so that everything goes smoothly.

There are some questions I would like to get cleared before filing the I-130 petition to avoid any roadblocks later on, please help:

    Question # 1:

Our traditional Hindu marriage ceremony was completed on September 28, 2012, yet we received the legal Marriage Certificate from Registrar Marriage on October 1, 2012. What does USCIS consider to be the “Date of Present Marriage”?

    Question # 2:

On Question # 15 of I-130 it asks, “Name and address of present employer (if any)”. Are they asking about my present employer, or my foreign husband's present employer because question # 15 is listed in the same column as “C. Information about your relative”

    Question # 3:

On Question # 17 of I-130 it asks, “List husband/wife and all children of your relative.”. But I am filing the I-130 for my husband, so do I list my husband's name, date of birth, and place of birth here?

    Question # 4:

Page 3 of I-130 instructions ask for “Any other relevant documentation to establish that there is an ongoing marital union”. We are including wedding photographs. The question is, what size must the wedding photographs be, and how many wedding photographs should be included?

    Question # 5:

On G-325A, it asks for Mother's place of birth. My Mother was born in the early 1940s, before 1947. Prior to 1947, the place she was born was part of India, i.e. Lahore, India, but after 1947, it went to Pakistan, so that place is now Lahore, Pakistan. For Mother's place of birth, shall I put down Lahore, India, because it was India at the time of her birth, or Lahore, Pakistan, because the place is now part of Pakistan?

I really appreciate any guidance you have whatsoever.

Thank you, and have a Blessed Day!
