  1. Hello All,

    I, the USC filed I-130 for my wife and got an NOA1 a few days back. Unfortunately, I used her maiden name to file. We wanted to change her last name to my name. How do we go about doing this?

    1)I am guessing we have to start with changing the name on her passport in India?

    2)If so, how will it affect the immigration process? 3)Will it make it slower or more confusing with USCIS or NVC or the embassy? 4)Is there a good time to tell them about the name change? Or do I wait for approval from USCIS and then submit a name change to NVC? I have heard that some people go for their interview and ask for their last name to be changed on visa?

    Also, can the name be changed once she comes to the US? I am guessing it wouldn't be too much use, since they need her passport when at DMV applying for Drivers Licence and if her passport has her maiden name, then its pointless. Also I am guessing applying for SSN, they would need her passport.

    I would love the name change, but the last thing I want is our case to be delayed due to confusion :)

    Well I had a similar case, but I did not change her last name, instead I added my name in to her passport as a spouse, however if you want to change the name, you need to provide marriage certificate. I presume you got married in India and have marriage certificate from India.

    She should go to nearest passport seva kendra and apply. She will need to provide marriage certificate and your passport copies. If you do not have a resident in India(if you do still I advise not to change the address as they would wanna see your utility bills/phone bills on your name) and if she is using her parents address then she will have to write a letter saying that she is not willing to change her address as her in laws family live abroad. (I know its stupid but they want that). Ask for post passport verification and you will get your passport in 3 days.

  2. I have seen K-1 applicants submit evidence to VFS along with their packets prior to the interview.

    Is it recommended/mandatory for CR-1 applicants as well?

    I know in New Delhi, the Consulate Officer's do not take a lot, if any, time to look at new evidence brought to the interview.

    Please share if you had your interview already and you were a CR-1 applicant. Did you submit evidence to VFS prior to your CR-1 interview?

    I am not sure about weather you have to submit to VFS or not, but can tell you if you are going to VFS, make sure you ask them couple of times, because it is my personal experience. When I was on a dependent visa, I had to get a visa and just because VFS lied about many things, I had to suffer months of sitting in india and my whole family was in state. I was so depressed and decided never to visit consulate just because people in VFS decide not to include some documents required by consulate. So the point is, do not trust what they tell you, call consulate, make sure they provide you with right direction and then approach VFS, re confirm with consulate and then go ahead with your interview.

  3. @ robinhood, how do you know if your case is transferred, coz am in the same boat here; 4 months and nothing!!!

    As everyone else said, You need to call USCIS and ask officer to transfer you to Tier2 officer(wait is about 20 to 30 mins to get to T2 officer). Ask officer if your case is transfer to local office, and ask them where and when. Call again to confirm as sometimes they do not provide accurate information so you wanna make sure. Once you know that your case is at your local field office, take an info pass appointment to get more detail information on where they are currently with your case, if any one assigned on your case or not and how long it will take. Transfer is normal as post Aug 15 most of the cases started getting transfer to local office.

    You need to provide more details on charges and the reason you were sentenced to prison. If the charges were federal and you were convicted of those charges, you have very small window.

    President Obama announced changes to Department of Homeland Security policy that would allow certain undocumented immigrants who were brought to the United States as children the opportunity to apply for a two-year stay that would shield them from deportation. Under the proposal, illegal immigrants under 30 years of age who came to the America illegally before they were 16 will be protected from deportation and can apply for a two-year work visa (which can be renewed indefinitely) given that they have lived in the United States continuously for at least five years, have not committed any crimes, have a high school diploma (or GED equivalent), or have served (or are currently serving) in the military.

    Hopefully I will get my NO2 soon.

    I haven't got the RFE but took an info pass, they told me they are currently processing NOV/DEC cases. I filled on Nov 30 but my case was at NBC and on JAN 9 got transfer to Newark, so hopefully they will start looking into.

  7. Well i don't exactly know when but to the local office in DC

    You need to find out when it was transfer to DC office. You should call USCIS, talk to Tier 2 officer(MAKE SURE YOU TALK TO T2 OFFICER - WAIT TO GET TO T2 IS ABOUT 20 to 30 MINS) and specifically ask him/her about when and where it was transfer. Call USCIS again to confirm that it was transfer(Some officers are Lazy and do not provide enough details so you have to call couple of times to confirm), then take an info pass and visit your field office, ask if your case is assigned to anyone and where are they currently in the process. Field office will be able to tell you what month they are currently processing.

  8. It's hard to believe that all those who have entered the U.S. on the K-1 have never tried marijuana in their lives. Which suggests that MANY people have lied in order to avoid the one year ban consequence. With this policy the United States is encouraging people to lie about their past experiences with marijuana, and punishing those who are being honest.

    If the reasoning behind the drug testing is to keep out drug abusers.. a simple drug test should prove that the person is able to stay clean, or at least get clean. But the automatic one year ban only encourages lying and continues to allow those people, who they are trying to weed out (excuse the pun), to enter anyway by doing what they have no problem doing: lying. :wacko:

    Agree with you, also there are thousands of F1(students), B1/B2, H1b/H4(work) issued every year, none of these people go through 1 year ban, infect they don't even ask them to take blood test not even after they migrate to State and file for their green card.

  9. OMG!!!!!!!! Why my husband decides to admit during the medical to smoking weed 4 years ago is a mystery to me.. I coached him forever and urged him not to ever tell that but he did... After all this waiting he does a dumb thing like that... So will we be denied help!!!!!!!!!!!!!!!!!!!!!!!!!!!!! I am so devastated a mind is a terrible thing to waste... Why does he not use his mind...that's only common sense.. so depressed now

    You are absolutely right... common sense nothing but common sense... how can he do that? I feel bad for you as you will have to wait for whole year just because he decided to say something which he did 4 years ago. bravo bravo boiii...
